디지털 플랫폼과 AI에 의한 국회 전자청원시스템 활성화 연구 (A Study on the Activation of E-legislative Petition System by Digital Platform and AI)

초록

4차 산업혁명의 시대에 여러 사회변화는 민주주의에서 국민의 정치참여를 디지털 플랫폼을 통하여 그 참여 방식을 변화하고 있다. 2011년을 중심으로 소셜네트워킹 서비스는 소셜 네트워킹, 소셜 협업, 소셜 퍼블리싱, 소셜 피드백으로 구분되어 디지털 플랫폼을 이용한 다양한 의견 소통의 방법으로 구현되고 있다. 여기에 디지털 플랫폼을 이용하여 직접 민주주의의 구현이 구체적으로 실현되고 있다.
국가와 국민의 입법에 대한 요망을 실현하는 방법으로는 톱 다운(top down) 방식과 보텀업(bottom-up) 방식이 있다. 대한민국 헌법 제26조에 “①모든 국민은 법률이 정하는 바에 의하여 국가기관에 문서로 청원할 권리를 가진다는 구정의 구체화를 위해서, 우리는 종래 청원법 외에도 국회법에서 구체화하는 청원제도를 디지털 플랫폼을 이용한 합리화를 도모할 필요가 있다. 국회법 제9장부터는 청원에 관하여 구체적인 규정을 두고 제123조(청원의 제출)에서 국회에 청원을 하려는 자는 의원의 소개를 받아 청원서를 제출하도록 하고 있다. 그리고 제3항에서 재판에 간섭하거나 국가기관을 모독하는 내용의 청원은 접수하기 아니하도록 하고 있다. 이미 국회법에는 제123조의2 제1항에서 “국회는 청원의 제출ㆍ접수ㆍ관리 등 청원에 관한 업무를 효율적으로 처리하기 위한 전자시스템(이하 "전자청원시스템"이라 한다)을 구축ㆍ운영하여야 한다.”고 전자청원의 근거를 만들었다. 따라서 앞으로 국회법과 국회규칙을 검토하고 디지털 플랫폼을 통한 정치의사 촉진 및 입법으로 통한 구현을 검토해야 한다. 국회에 입법에 관하여 청원을 하는 경우 현행법을 그대로 둔다면 국회에 디지털 플랫폼을 만들어 이 청원 내용을 각 의원실에 제공하여 의원실에서 선택하여 의원 추천하게 하는 시스템을 갖추어야 한다. 이것이 안 되면 청원의 단계에서 의원의 추천 외에 국민의 입법청원 동의의 인원수에 따라 추천을 강제 혹은 추천을 의제하는 제도로 변경하는 방법도 검토해야 한다.
그리고 국회의 청원에서 의원의 추천을 강제하는 제도는 삭제하고, 디지털 청원 플랫폼 시스템을 통해 추천 및 입안활동이 관리되고 지원되고 공개되며 감시되는 합리적인 시스템의 구축을 제안한다. 디지털 플랫폼을 이용하여, 전술한 소셜네트위킹 서비스의 소셜 네트워킹, 소셜 협업, 소셜 퍼블리싱, 소셜 피드백의 기법을 수용하여 e-청원제도를 활성화 할 수 있을 것이다. 이러한 디지털 플랫폼을 통하여 청원의견 제시하도록 하면, 이를 ① 관련 정부기관, 관련 위원회 소속 의원(실)에 대한 통지하고, ② 청원 동의인이 일정 인원 이상(1만 명 이상 등) 될 경우 관련 정부기관과 소속 위원(실)에 중간답변의 기회를 제공하도록 하는 것도 좋다. 그리고 ③개별 의원, 국회사무처, 관련 기관 중간 답변을 할 수 있도록 하고 이 과정에서 국민과 국회사이에 토론도 가능하도록 하여, 구체적인 입법이 가능하도록 하는 것이 좋을 것이다. 독일에서와 같이 청원의 공개 및 비공개를 정하는 제도를 둘 필요도 있다. 디지털 플랫폼과 빅데이터, AI를 접목한 디지털 청원제도를 통에 민의를 수렵하고 합리적인 입법, 효과적인 입법활동이 이루어지는 대한민국 국회가 되기를 바란다.

영어초록

In the age of the Fourth Industrial Revolution, various social changes are going the way people participate in democracy through digital platforms. The digital participation system in the digital Platform of social information processing will play a supporting role in the method of hunting and realizing collective intelligence using the platform and political judgment through AI. This change is what I call PoliTech, which is an increase in efficiency and rationality through the combination of politics and digital technology.
From 2011, social networking services are divided into social networking, social collaboration, social publishing, and social feedback, and are implemented in various ways of communication using digital platforms. Then, the implementation of direct democracy using the digital platform is concretely realized. The e- Petition system, which incorporates IT technology, began in the Scottish Parliament in 2000. In 2005, the German Parliament introduced a system similar to Scotland, in 2006 the British government and in 2001 the Obama administration in the United Top-down and bottom-up methods are available to realize the desire for legislation by the state and the people. Article 26 of the Constitution of the Republic of Korea stated about right to petition. In the National Assembly Law, a person who intends to petition the National Assembly in Article 123 (submission of petitions) with specific provisions concerning petitions is required to submit a petition by introducing the member. Therefore, in the case of petitions for legislation in the National Assembly, if the current law remains in place, a digital platform should be created in the National Assembly to provide this petition to each member's office, and to have a system for recommending members. If this is not the case, in addition to the recommendation of the members of the legislature at the stage of petition, the method of changing the recommendation to a system of compulsory or recommending agenda, depending on the number of people with the consent of the legislative petition, should be considered.
We also remove the system of compulsory recommendation from legislators and propose the establishment of a rational system through which the digital petition platform system is managed, supported, disclosed and monitored. Using the digital platform, the e- petition system may be activated by adopting the above-described techniques of social networking, social collaboration, social publishing, and social feedback. If the petition is submitted through such a digital platform, ① it will be notified to relevant government agencies and members of related committees. It is also a good idea to give your committee a chance to answer in the middle. ③ It would be better to provide individual legislators, interagency offices, and intermediaries with relevant institutions, and in the process to discuss the matter with the public and the state company, enabling specific legislation. As in Germany, there is a need to have a system for making public and non-public petitions. We hope that the Korean National Assembly will be able to hunt for civil rights, rational legislation, and effective legislative activities through the digital petition system that combines digital platform, big data, and AI.
