온라인 플랫폼 규제를 위한 플랫폼 작용의 이해 필요성 (Necessity of understanding platform functions for online platform regulation)

초록

온라인 플랫폼이 성장하고 이용자수가 증가할수록 이에 따라 발생하는 문제들도 늘어나고 있으며 몇몇 부분은 사회적 문제로까지 인식되고 있을 만큼 심각성이 상당하다. 따라서 이러한 문제점들을 해결하면서 동시에 온라인 플랫폼에 대한 규제환경을 개선하여 발전을 촉진시키기 위한 입법안들이 발의되어 있다. 그러나 이러한 법안들이 실제로 그 목적에 따라 현재의 플랫폼 현상을 제대로 반영하고 있는지는 상당한 의문이 제기된다. 또한 지금까지의 온라인 플랫폼의 규제방향은 규제대상으로서 온라인 플랫폼을 정의하고 해당 플랫폼에게 의무를 부과하는 식의 포괄적 규제형태를 나타낸다. 실제로 온라인 플랫폼을 통한 거래에서 발생한 문제의 상당부분은 플랫폼운영자가 적극적으로 해결하려 하지 않았다는 것이고, 결국 해당 플랫폼에 대한 직접적인 규제가 문제 해결을 위한 가장 강력하고 효과적인 수단일 것이다. 그러나 플랫폼 내에서 발생하는 문제들이 다른 영업모델들 내에서 발생하는 문제들과 어떠한 차이가 있으며 왜 규제를 해야 하는지 내용을 정확하게 이해하지 못한 채 단지 플랫폼이기 때문에 수많은 의무와 책임을 지운다면 오히려 과도한 규제로서 새로운 플랫폼 환경에 걸맞은 온라인 시장의 균형발전과 새로운 경제성장의 기반 확충을 저해할 수 있다. 이하에서는 이와 같은 문제의식을 가지고 온라인 플랫폼에 대하여 경제학 이론 중 법적 규제에 의미가 있는 현상들을 중심으로 서술한다. 그동안 플랫폼에 대해 설명하고 이와 관련된 문제들을 연구한 많은 문헌들이 발표되었다. 하지만 플랫폼에 대한 일반적인 설명은 간략하게 표현된 부분이 많아서 정작 플랫폼을 이해하기는 쉽지 않았다. 그러나 플랫폼의 작용으로 나타나는 현상들을 살펴봄으로써 현재 통일적 개념정립이 불가능한 플랫폼을 이해하는데 도움을 주고 특히 경쟁법 영역에서 플랫폼의 시장지배력과 공정한 경쟁의 문제를 다룰 때 논의의 기초를 제공한다. 이를 통해 온라인 플랫폼의 규제 필요성과 대상을 논할 때 고려해야할 기본방향을 보여줄 수 있을 것이다.

As the online platform grows and the number of users increases, the problems that arise also increase, and some parts are serious enough to be recognized as social problems. Therefore, legislative proposals have been proposed to solve these problems while at the same time improving the regulatory environment for online platforms and promoting their development. However, there is considerable doubt whether these proposals actually reflect the present platform phenomenon in accordance with its purpose. In addition, the regulatory direction of the online platform thus far represents a comprehensive form of regulation that defines an online platform as an object to be regulated and imposes an obligation on the platform. Indeed, much of the problem with transactions through online platforms is that platform operators have not actively addressed them, and probably direct regulation of the platform will be the most powerful and effective means of solving problems. However, if it isn't understood precisely why the problems that arise within the platform are different from the problems that arise in other business models and why they should be regulated, regulations can hinder the balanced development of the online market appropriate for the environment and the expansion of the foundation for the new economic growth. In the following, it will be focused on the phenomena of the economics theory on the online platform which are meaningful in the legal regulation with the consciousness of this problem. In the meantime, many articles have been published explaining the platform and researching related issues. However, since the general description of the platform is briefly expressed, it is not easy to understand the platform. However, by examining the phenomena that are caused by the function of the platform, it helps to understand the platform which can not be established as a unified concept, and it provides the basis for discussion when dealing with the market dominance and fair competition of the platform in the field of competition law. This will show you the regulatory directions of the online platform and the basic directions to consider when discussing the subject.
