주요국의 민간경비산업 규제개혁 현황진단과 시사점:Button과 George의 분류 틀을 기반으로 (Assessing a Strategic Framework for Managing the Regulatory Standards Abroad and its Implications for South Korea: Based on Evaluation Criteria by Button & George)

초록

국제적으로 생활안전, 질서유지, 안보 전반에 걸친 민간경비의 사회적 역할과 기능은 나날이 증대되고 있으며, 우리나라 역시 이러한 세계적 추세에서 예외가 아니다. 불특정 다수 무차별 테러리즘의 위협, 무동기(묻지마) 범죄의 부상으로 대표되는 현대 ‘위험사회’(Risk Society)의 리스크관리․지원을 위한 필수불가결한 보완재로 자리매김하고 있는 민간경비의 건전육성을 위해, 오늘날 세계 각국은 공통적으로 체계화된 운영 기준을 마련하고 있다.
그간 우리나라에는 민간경비산업의 고도 발전이 진행된 주요국의 제도 진단․평가 연구가 다수 이루어진 바 있으나, 그 대상이 영미나 독일, 혹은 이웃나라인 일본 등 개별국가 중심으로 이루어진 면이 있다. 따라서 본 연구는, 민간경비산업 경쟁력 제고 논의에 기여하고 있는 주요 선도국들 가운데에서 유럽연합, 호주, 캐나다, 미국, 영국의 제도정비 현황과 특징을 요약 정리함으로써, 보다 통합적인 시각에서 선진국들의 제도개혁 기본방향을 파악하여 국내 개혁방향에 주는 시사점을 도출하고자 하였다. 국가 간 비교 분석에는 민간경비 제도 평가연구에서 보편적으로 수용되는 Button & George(2006)의 ‘무개입․방임(Non-Interventionist)’, ‘최소개입-좁은규제(Minimum- Narrow)’, ‘최소개입-넓은규제(Minimum-Wide)’, ‘포괄적 개입-좁은규제(Comprehensive-Narrow)’, 그리고 ‘포괄적 개입-폭넓은 규제(Comprehensive-Wide)’ 이상 5단계 유형의 분류 틀을 활용하였다.
분류 틀의 적용 결과, ① 유럽연합 회원국 대다수 국가들은 ‘포괄적 개입-폭넓은 규제’ 모델을 따르고 있었으며, ② 호주연방 내 상당수 주에서는 대체로 ‘포괄적 개입-폭넓은 규제’ 내지는 ‘포괄적 개입-좁은규제’ 모델이 운용되고 있음을 확인할 수 있었고, ③ 캐나다의 경우에는 현재 5-10개 업종에 관한 포괄적 제도개혁 조치들을 단행되고 있는 등 ‘포괄적 개입-폭넓은 규제’ 발전모델로 진입하기 위한 조정이 이루어지고 있는 상황이며, ④ 영국은 캐나다보다 한발 앞선 2001년부터 ‘포괄적 개입-폭넓은 규제’ 모델로의 도약을 이루기 위한 일련의 개혁조치를 적극 실시하여 이미 큰 진척을 거두고 있었으나, ⑤ 다만 민영화와 탈규제, 그리고 ‘비즈니스 프렌들리’를 표방하는 미국의 경우 여전히 ‘최소개입-좁은규제’ 내지 ‘최소개입-넓은규제’ 단계에 머물러 있어, ‘포괄적 개입-폭넓은 규제’ 발전모델로의 뚜렷한 진전을 보여주지 못하고 있는 상황으로 검토된다. 이상의 민간경비 제도개혁 추진방향에 대한 주요국 동향 검토결과와 선진사례 분석을 바탕으로 본 연구는, 2개 추가업종(예: 민간조사, 자문업)의 단계적 양성화를 통한 ‘좁은규제’ 접근방식의 개선 및 5등급 체계로 이루어진 국가공인 교육훈련 자격체계의 구축 등 우리나라가 포괄형 개입 모델로의 진입을 이루어내기 위해 선행돼야 할 요건에 대한 지침을 제시하여 정책적 시사점을 도출하였다.

영어초록

The private security industry has entered a mass-growth phase internationally in terms of the social role and function that range from maintenance of public security, order and national security, and, South Korea is no exception from this trend. In the modern risk society, the commercial-sector security is increasingly seen as an essential complementary good against the threats of new terrorism that targets unspecified mass as well as motiveless crime, and there has been widening common efforts pursued to develop a range of licensing standards in order to manage such growth.
To date, in South Korea, a growing body of industry review and evaluation studies have been conducted. However, the analyses have been conventionally confined to North America, Britain, Germany and neighboring Japan, on a piecemeal basis. This article is intended to survey the general direction in reform, togethjer with variations in the licensing and regulatory requirements existing in the Western Europe, Canada, Australia, US and UK in order to draw recommendation on possible reform standards for South Korea. This study utilized the widely excepted private security-specific 5-phase evaluation criteria devised by Button and George(2006) comprising Non-Interventionist, Minimum- Narrow, Minimum-Wide, Comprehensive-Narrow and Comprehensive-Wide approaches.
In doing so, this study has identified some notable regulatory trends : ① the rise and stabilization of the Comprehensive-Wide model of security industry regulation in European Union Member States, ② the continued divergence of regulatory practices across Australian states and territories from comprehensive-narrow to wide, ③ the progressive conversion towards a comprehensive-wide model of regulation in Canada that can include reforms of 5 to 10 industry sectors, ④ the major strides taking place in UK one step ahead of Canada since 2001, where comprehensive-wide model of regulation is becoming the norm across the sectors, rather than the exception, ⑤ yet US regulatory system still shows a trend towards minimal regulation, from Minimum-Narrow to Wide, and that the situation in US can be described as a stalemate due to the anti-regulatory and business-friendly ideology.
The lessons learnt from the case studies were taken into account in determining the following checks and balances that would provide the ideal setting for the Comprehensive-Wide arrangement: the need for the introduction of Minimum-Narrow approach through the regulation of two additional occupational license categories(i.e. private investigation, security consulting), and the need for the adoption of nationally endorsed training package that forms a tree-like hierarchy, comprising Certificates I-V(Levels 1-5).
