공인탐정업 법제화의 쟁점과 입법 방향: 제21대 국회 발의안 비교를 중심으로 (Legalization of Private Investigation Services: Issues and Legislative Directions Based on a Comparative Analysis of Bills in the 21st National Assembly)

초록

본 연구는 공인탐정제도의 제도화를 위한 입법과제를 고찰하고, 제21대국회 발의안들의 한계를 극복하는 새로운 입법방안을 제시하는 데 목적이있다. 현재 대한민국은 OECD 38개국 중 유일하게 공인탐정제도가 법제화되지 않은 국가로, 5,000여 개의 무등록 민간조사업체가 활동하면서 개인정보 침해, 불법 도청, 협박 등 각종 사회적 부작용이 지속적으로 발생하고있다. 이 문제를 해결하기 위해 제21대 국회에서 발의된 이명수안, 윤재옥안, 황운하안 등 3건의 법률안을 조문 단위로 정밀 비교ㆍ분석하였으며, 미국, 일본, 영국 등 주요국의 탐정제도와의 국제 비교를 통해 한국형 탐정제도의 방향성을 검토하였다. 분석 결과, 기존 발의안들은 경찰청 중심의관리체계로 인한 수사권 침해 우려, 자격제도의 공정성과 투명성 부족, 직무범위의 모호성으로 인한 직역 간 갈등 심화, 협회의 법적 지위 불명확 등의구조적 한계를 드러냈다. 이를 극복하기 위해 본 연구가 제시한 새로운 제정안의 핵심 특징은 주무부처를 경찰청에서 행정안전부로 변경하여 중립성확보, 시ㆍ도지사와 자치경찰위원회 연계 분권형 관리체계 구축, 수사기관경력자와 탐정학 학위자를 포함한 포용적 자격체계 도입, 변호사 등 전문직과의 협업체계 법적 명문화, 대한공인탐정협회 법정단체 설립을 통한 실질적 자율규제 등이다. 이러한 제도적 설계는 공인탐정업의 공공성과 전문성을 동시에 확보하는 혁신적 입법 기반을 제공한다.

영어초록

The objective of this study is to examine the legislative tasks involved in establishing a certified detective system and to propose new legislative measures that address the limitations of bills proposed in the 21st National Assembly. Presently, South Korea stands as the sole nation among the 38 OECD member states where the legal framework for private investigators has not been codified. The prevalence of unregistered private investigation firms has reached an estimated 5,000, contributing to persistent social concerns, including personal information breaches, illegal wiretapping, and extortion.
In order to address the aforementioned issue, the present study conducted a detailed comparison and analysis of the three bills proposed in the 21st National Assembly— namely, the Lee Myeong-soo Bill, the Yoon Jae-ok Bill, and the Hwang Un-ha Bill—at the clause level. Furthermore, the study examined the directionality of a Korean-style detective system through an international comparison with the detective systems of major countries such as the United States, Japan, and the United Kingdom. The analysis revealed that the existing bills have structural limitations, including concerns about infringement of investigative authority due to a police-centric management system, lack of fairness and transparency in the qualification system, exacerbation of conflicts between professions due to ambiguity in the scope of duties, and unclear legal status of the association. In order to surmount the aforementioned limitations, the new bill proposed in this study contains the following key features:- The main ministry in charge would be changed from the National Police Agency to the Ministry of the Interior and Safety to ensure neutrality.- A decentralized management system linked to provincial governors and local police committees would be established.- An inclusive qualification system that includes former investigative agency personnel and those with degrees in detective studies would be introduced.- A cooperative system with professionals such as lawyers would be legally codified.- The Korea Certified Detective Association would be established as a statute.
