초록

스토킹관련 법안이 국회에 처음 발의된 후 22년만에 스토킹처벌법이 입법화 되었다. 하지만 스토킹처벌법이 시행되기 전부터 입법내용과 방식에 대한 비판의 목소리가 높았다. 특히 ‘신당역 스토킹 살인사건’ 이후 스토킹 피해자를 보호하는데 한계가 있다는 지적이 있었다. 이에 여야를 불문하고 정부 또한 스토킹처벌법 개정안을 발의하였다. 모든 법률이 그러하였듯 시행초기 단계에서 겪게 되는 과도기적 상황으로 이해할 수 있을 것이다. 그러므로 현시점에서 무엇보다 중요한 것은 제정·시행되고 있는 스토킹처벌법을 어떻게 가다듬을 것인지에 논의의 초점을 맞춰야 할 것이다.
스토킹처벌벌은 피해자 보호에 방점을 둔 법률이다. 이에 스토킹처벌법의 개정방향은 피해자를 실효적으로 보호할 수 있는 방안을 중심으로 논의가 이루어져야 한다. 이에 본문에서 스토킹범죄 피해자 보호방안에 관한 몇 가지 개선안과 정책적 제안을 하였다.
현재 국회의안 정보시스템에 국회의원 대표 발의안과 정부 안을 포함하여 총 33개 법안이 국회법제사법위원회에 제출되어 있다. 최근 발의된 개정안의 주요내용 또한 스토킹 범죄 범위 확대, 온라인 스토킹 처벌규정 신설, 스토킹 가해자 위치추적 도입, 피해자 통지제도, 피해자 보호명령 제도 등 피해자를 실효적으로 보호할 수 있는 방안들로 구성되어 있다.

영어초록

It is a serious situation worldwide as the act that started as stalking has led to a violent crime. So, stalking punishment laws have been enacted, amended, and implemented in each country. In Korea, the stalking punishment law was legislated in 22 years after the stalking-related bill was first introduced to the National Assembly.
However, even before the Stalking Punishment Act came into force, there were high voices of criticism about the contents and methods of the legislation. In particular, after the 'stalking murder case at Sindang Station', it was pointed out that there was a limit to protecting stalking victims, and after that, the government proposed an amendment. This current situation can be understood as a transitional situation experienced in the initial stage of implementation. Therefore, the most important thing at this point is to focus the discussion on how to enact and enforce the stalking punishment law. Punishment for stalking is a law that focuses on protecting victims. In this regard, the direction of revision of the Stalking Punishment Act should be discussed centering on measures to effectively protect victims. In this regard, several improvement plans and policy suggestions regarding victim protection were made in the text.
Currently, a total of 33 bills, including lawmakers and government bills, have been submitted to the National Assembly Legislation and Judiciary Committee since the 'Stalking and Murder Case of Sindang Station' in the National Assembly bill information system. The main contents of the recently proposed amendment are also composed of measures that can effectively protect victims, such as expanding the scope of stalking crimes, establishing online stalking punishment regulations, introducing stalking perpetrator location tracking, victim notification system, and victim protection order system. It is impossible to predict in what direction the revision of the future stalking punishment will proceed. However, I hope that the legislation of the Stalking Punishment Act will proceed in a direction that meets the purpose of the legislation, not the purpose, so that the victims can be effectively protected.
