국가첨단전략기술의 지정․관리 및 보호조치에 관한 고찰 - 국가첨단전략산업법과 산업기술보호법과의 비교를 중심으로 - (A Study on Designation, Management and Protection Measures of National Advanced Strategic Technology - Focusing on the comparison between the NASIA and the ITPA -)

초록

본 논문은 국가첨단전략산업법에서의 전략기술의 지정 및 관리와 관련하여 산업기술보호법과 비교하여 고찰한 것이다.
보호대상 기술과 관련하여서 전략기술이 국가핵심기술에 포함되는 개념인지에 대하여 기술의 정의 및 지정요건을 비교하여 검토하였다.
전략기술의 지정과 관련하여서는 지정절차를 산업기술보호법과 비교하였다. 또한 전략기술을 보유하고 있는 기업 등은 수출, 해외 인수․합병, 형사처벌 등의 경우 직접적으로 규제를 받는다. 따라서 산업기술보호법상의 국가핵심기술의 지정과 같이 이 법에서도‘필요․최소한의 범위’가 필요할 것으로 보이며 전략산업의 육성의 측면도 고려하여 전략기술을 보호대상과 육성대상을 구분하여 지정할 필요가 있을 것으로 보인다.
기술의 수출 및 해외 인수․합병 등과 관련하여서는 산업기술보호법과 같이 ‘국가연구개발비가 지원된 경우’에는 ‘승인’, 그 이외에는 ‘신고’라는 형식으로 이원화 하여 규제를 완화할 필요가 있다. 그리고 산업통상자원부장관의 명령불이행이 침해행위 유형으로 열거될 필요가 있다.
전략기술의 보호조치와 관련하여서는 과태료 규정이 없다는 문제점에 대하여 산업기술보호법의 적용은 가능할 것으로 보인다. 전문인력 지정, 전문인력의 출입국 정보 제공과 관련된 규정과 관련하여서는 헌법상 직업선택의 자유, 개인정보 보호의 문제가 있어 이에 대한 유의가 필요하다,

영어초록

This paper examines the designation and management of strategic technologies in the National Advanced Strategic Industry Act(NASIA) compared to the Industrial Technology Protection Act(ITPA).
It is concerned that the technology to be protected, the definition of the technology, and the requirements for designation were compared and reviewed as to whether the strategic technology is a concept included in the national core technology.
Regarding the designation of strategic technologies, the designation procedure was compared with the ITPA. In addition, companies with strategic technology are directly regulated in the case of exports, overseas M&A, and criminal punishment. Therefore, like the designation of national core technologies under the ITPA, ‘necessary․minimum scope’ is likely to be necessary for NASIA, and it is necessary to designate strategic technologies separately from protection targets and foster targets in consideration of the aspect of strategic industry development. see.
Regarding the export of technology and overseas M&A, as in the ITPA, it is necessary to relax regulations by dividing them into ‘approval’ into cases where ‘national R&D expenses are supported’ and ‘reporting’ in other cases. And it is necessary to list the non-compliance with the order of the MOTIE as a type of infringement.
Regarding the protection measures for strategic technologies, it seems possible to apply the ITPA to the problem that there is no fine for negligence. Regarding the regulations related to the designation of professional manpower and provision of immigration information for professional manpower, there are issues of freedom of choice of profession and protection of personal information under the Constitution.
