조직 및 구성 측면에서의 공수처 발전방향 (The Development Direction of the Corruption Investigation Office for High-ranking Officials in Terms of Organization and Composition)

2020. 1. 14. 「고위공직자범죄수사처 설치 및 운영에 관한 법률」이 제정되어 같은 해 7. 15. 시행되었고, 그로부터 약 1년이 지난 2021. 1. 21. 고위공직자범죄수사처(공수처)가 공식적으로 출범하였다. 다만 설립 후 현재까지 그 기능을 만족스러울 만큼 충실히 수행하였는지에 대하여는 의견이 엇갈리는바, 추후 여러 측면에서 제도적 개선사항을 짚어보고 발전을 모색하여 이를 바탕으로 고위공직자 등에 대한 성역 없는 수사라는 공수처의 고유한 기능적 가치를 증명해 보일 필요가 있을 것이다.
공수처의 의의 및 기능의 측면, 공수처의 인적‧물적 관할, 공수처의 수사권과 기소권 문제 등 다른 여러 중요 쟁점들이 쟁점으로 떠오르지만, 이 글에서는 다른 쟁점에 대한 검토는 차치하고 오로지 공수처의 조직과 구성의 측면에 국한하여서만 개선점을 고민해 보기로 한다. 구체적으로는 첫 번째 목표로 공수처의 정치적 중립성 및 독립성의 강화를, 두 번째 목표로 공수처의 업무 수행역량 제고를 삼아 각 목표에 대한 성취방안들을 도출해 본다.
공수처의 중립성 및 독립성 강화방안을 고찰하기 위한 선결문제로서 중립성 개념과 독립성 개념의 정립이 필요하다. 중립성과 독립성은 별개의 개념인 것이고, 공수처의 독립성이 확보된다고 해서 공수처의 정치적 중립성이 확보되는 것은 결코 아니므로 공수처의 독립성 강화와는 별개로 공수처의 정치적 중립성을 보장하는 장치를 충분히 마련할 필요가 있고, 독립성이 충분히 보장되지 않으면 결국 외부의 영향력에 취약하게 되어 정치적 중립성이 흔들릴 우려가 있다.
우선 공수처의 조직과 구성에 있어서의 정치적 중립성 강화방안으로 공수처장 등의 임명일 기준 최근 정치활동 이력에 따른 제한, 공수처장 등 임명절차상 법치주의적 정당성과 민주적 정당성 강화를 제안한다. 다음으로 조직과 구성에 있어서 공수처의 독립성을 강화하기 위해서는 적절한 신분보장을 통한 인사조직 구성상 독립성 강화를 꾀할 필요가 있다. 마지막으로 조직 및 구성에 있어서 공수처의 업무 수행역량 제고방안으로 인력의 확충, 공수처검사의 임기 확대, 타 수사기관과의 인적 협력관계 강화 등을 들 수 있다.

영어초록

On January 14, 2020, the "Act on the Establishment and Operation of the Corruption Investigation Office for High-ranking Officials" was enacted and enforced on July 15 of the same year. About a year later, the Corruption Investigation Office for High-ranking Officials(hereinafter referred to as the "Investigation Office") was officially launched on January 21, 2021. However, there are differing opinions as to whether it has performed its functions satisfactorily since its establishment. At this point, it will be necessary to seek institutional improvements in various aspects and, based on this, prove the unique functional value of the Investigation Office, which is to conduct investigations without sanctuary for high-ranking officials.
In this article, aside from reviewing other issues, I will consider improvements only in terms of the organization and composition of the Investigation Office. Specifically, the first goal is to strengthen the political neutrality and independence of the Investigation Office, and the second goal is to improve the Investigation Office’s ability to perform its duties.
As a prerequisite for considering ways to strengthen the neutrality and independence of the Investigation Office, an accurate understanding of the concepts of neutrality and independence is necessary. Neutrality and independence are separate concepts. Therefore, securing independence does not necessarily mean securing political neutrality. Therefore, apart from strengthening the independence of the Investigation Office, it is necessary to prepare a sufficient device to ensure the political neutrality of the Investigation Office. If independence is not sufficiently guaranteed, there is a risk that it will eventually become vulnerable to external influence, which could shake political neutrality.
At first, as a measure to strengthen political neutrality in the organization and composition of the Investigation Office, I propose restrictions based on the recent political activity history as of the date of appointment, and reinforcement of the legitimacy of the rule of law and democracy in the appointment procedure. Next, in order to strengthen the independence of the Investigation Office in the organization and composition, it is necessary to reinforce the independence of the personnel organization by ensuring appropriate status. Finally, the measures to enhance the work performance capacity of the Investigation Office in terms of organization and composition include increasing manpower, extending the term of office of Investigation Office Prosecutors, and strengthening personnel cooperation with other investigative agencies.
