한국의 정부형태에 대한 개선방안에 대한 연구 – 제왕적 대통령제인지 제왕적 의회인지에 대한 논의의 문제점과 해결책을 중심으로 – (Constituinal Review on Current Reformation of Government System Focusing on Dicussion of Imperial Presidensy or Imperial Congress)

초록

최근 윤석열 대통령의 비상계엄으로 야기된 국가의 혼란은 제왕적 대통령제 자체 의 문제라고 대다수의 정치학자와 헌법학자, 언론 원로 정치인이 보고 있는 듯하다. 과연 그러할까? 현행 헌법은 제도적으로 대통령에게 통제받지 아니하는 제왕적인 권한을 준 것일까에 대한 검증이 필요하다고 보인다.
최근 윤석열 대통령의 비상계엄 자체는 그 수단이 헌법상 요건을 충족하지 못하여 문제가 심각하지만 그 발생원인 중 탄핵소추의 남발로 인한 행정부 수장들의 업무정 지로 인한 행정기능의 마비 등도 이러한 제왕적 의회의 문제점임을 인식하고 이에 대한 대책도 마련하여야 한다. 최근 윤석열 대통령의 비상계엄 선포로 야기된 한국의 혼란은 대통령제 자체보다는 대통령 부인의 각종 비리에 대한 특검법의 통과와 그로 인한 여야의 극한 대립과 이재명 야당대표의 성남 시장의 각종 비리에 대한 현 정권의 수사가 여야 간의 극한 대립이 근본적인 원인이라고 보인다. 이는 집권 세력과 차기 집권 세력 간의 부정부패의 문제가 큰 원인을 차지한다.
한국에서는 대통령제가 타당한데 이는 국민적 의사적 측면에서 국민의 대다수가 대통령제를 선호하고 있기에 국민투표로 확정되는 현행 헌법 개정하에서는 국민의 의사에 반하는 헌법개정은 불가능하기에 당연히 고려하여야 할 것이고 기존의 의회 정치권 불신에 오는 새로운 지도자의 열망, 의원내각제의 전제조건인 대화와 토론을 전제로 한 의회정치의 부재로 일당독재의 제왕적 수상의 등장 위험이 있기에 오히려 현행 대통령제하에서 야당과 국민에 의한 통제를 실효성이 있게 하는 것이 필요하다 고 보인다. 결국 한국에서 대통령제하에서 혼란이 야기되는 것은 결국 대통령제 자체의 문제점보다는 선출된 대표자로서의 엘리트로서의 대통령의 자질 부족과 이러한 대통령을 보좌할 여당의 진정하고 정당한 직언의 부족과 야당의 무조건적인 반대 등의 여야정당 내부의 비민주성과 그로 인한 공천권의 남용에 근거하여 소선거 제도로 인한 대표제 자체의 문제가 크다고 보인다. 이는 의원내각제로 변환하여도 동일한 근본적인 대표제의 문제점이기에 이번 기회에 반드시 개혁을 이루어야 한다. 제왕적 대통령제나 제왕적 의회를 방지하기 위해서 현행 대통령의 권한이나 의회의 권한을 상대방에게 이전하기보다는 대표제의 문제점을 보완하기 위하여 직접민주주 의 실질적 확대가 필요하고 특히 국민발안제의 도입과 국민투표 대상의 확대와 국회의원을 포함한 국민소환의 확대가 필요하다. 이는 대통령중임제나 의원내각제, 분권형 대통령제도 경우에 따라서는 제왕적 지도자가 나올 수 있는 위험이 있기 때문이기도 하다. 그리고 다수파의 횡포에 대하여 정치적⋅법적인 엄격한 책임을 지게 하는 가장 실효성 있는 대안이라고 보인다.

Absolute majority of political scientist, constitution scholar press think that recent national chaos caused by announcement of President Yoon's emergency martial law comes from imperial presidency. is it true? recently in Korea, a special committee advisory report on constitutional amendment under the Chairman of the National Assembly in 2009, 2014 and 2017 was published, and people seem to be obsessed with the idea of discussing constitutional amendment to solve the problem of imperial presidency. However, in the doubt that our society may be making a fundamental mistake in discussing constitutional amendment, we wrote this paper to examine the problems of existing papers and various reports from a new angle. It seems that newspapers and television are not always right and need more discussion as to whether it is based on the fallacy or inaccuracy of the generalization of exceptions.
Generally imperial presidency means that the president as the head of the administrative branch of the government, has a strong influence on the legislature and judiciary. in korea 1972 year Revitalizing Reforms constitution is a typical example. but 1987 current constitution weakened the power of president. unlike 1972 year Revitalizing Reforms constitution, president can not disperse national congress and control judiciary.
now in korea, the main opposition Party has has a absolute influence on the executive and judiciary. of course including legislature. I assert this situation is imperial congress. in conlusion, in korea, we need the solution to solve the problem of imperial president’ abuse of right and imperial congress’ abuse of right.
Many constitutional scholars and political scientists argue for a parliamentary cabinet system or a SemiPresidential system, a form of mixed government system. However, the majority of the people approve of the presidential system. That is, of course, why most countries in Europe, which are political advanced countries, have parliamentary cabinet systems. However, Japan, which has parliamentary cabinet system, is widely considered, because of factional political situation, and boss politics, a politically backward country. so some scholars propose that japanese peoples must elect a prime minister, instead of the majority party in the parliament.
What really is needed in Korea has come to the conclusion that we should find a picture of a wider country's political system and a governance structure that suits us, many special committee advisory reports on constitutional amendment under the Chairman of the National Assembly, was written in the light of the true meaning of the principle of separation of powers based on the principle of checks and balances of power to resolve the evils of the imperial presidency by strengthening the power of the National Assembly, But I think these reports are not true because imperial president’ abuse of right and imperial congress’ abuse of right. happen at the same time.
So I propose we must broaden direct democracy including people's initiative. people's vote and people's recall. And finally, because all constitutional amendments are decided by referendum, many proposals of Constitution revisions, must not be decided by one voting, but every proposal must be decided by one by one voting. so reform of Korean constitution should be one point reform because of direct democracy.
