초록

지금 한국 사회에서 4차산업혁명이란 단어는 사람들에게 매우 친숙한 용어가 되었다. 신생용어가 1년도 안되는 짧은 기간에 이렇게 사람들에게 친숙한 용어가 된 것은 그만큼 4차산업혁명이라는 현상이 우리 사회 각 분야에 끼치는 영향이 매우 중대하고 심각하다는 데에 기인하는 것이라 본다. 본고는 그러한 분야 중에서 특히 교육, 의료, 교통, 환경분야를 중심으로 어떠한 변화가 있을지 검토해 본다.
먼저, 교육 특히 학교교육분야에서는 영어나 수학 등 소위 중요과목에 치우쳐 왔던 교육으로부터 창의력향상을 위한 교육, 원만한 인간관계의 정립을 위한 교육, 건강한 신체와 건전한 정신을 함양하기 위한 교육 등으로 중심축이 움직이는 근본적인 변화가 예상된다. 영어나 수학 등에 관한 지식은 이제 인공지능이 멋지게 대신할 것으로 예상되기 때문이다. 교육에 이러한 변화가 일어나면 이를 계기로 그 동안 한국사회의 고질병 중 하나였던 사교육문제도 저절로 해결이 되지 않을까 기대를 할 수 있겠다. 이러한 교육분야의 변화는 소위 8학군으로 대변되는 한국 교육의 병폐를 해결하는데 크게 기여하면서 동시에 거주지역에 대한 선호에도 변화를 일으키어 토지법의 주요 관심분야를 도시토지문제에서 교외토지문제에로 이동시키는 변화도 예상할 수 있다고 본다.
다음, 의료분야에서도 인공지능에 의한 진단과 처치 등이 널리 보급되면서, 동시에 원격진료도 대중화되어 환자들이 굳이 대도시의 병원을 찾지 않아도 되는 시대가 곧 올 것으로 예상한다. 이러한 변화 역시 토지법 관심분야의 변화에 일조를 하게 될 것으로 본다. 교통분야에서는 자율주행차의 보급에 따라 일상생활에 다양한 변화가 예상된다. 예컨대, 초고령사회에서 노인들의 이동권 보장, 접근성의 획기적인 발달에 따라 도시로부터 교외지역으로의 거주지역의 변화가 뒤따를 것으로 본다. 그리고 현재 개발 중인 자율주행차는 대개 전기자동차 내지 재생에너지를 이용하는 자동차가 주종을 이루므로, 이에 따라 자동차 배기가스에 의한 환경문제에 대해서도 걱정하지 않아도 좋을 만큼 획기적인 해결책이 등장할 것으로 예상이 된다. 그리고 환경분야 역시 태양광발전이나 재생에너지의 활발한 이용, 자율주행차의 보급 등으로 해결책을 찾을 가능성이 높아 보인다. 이러한 낙관적인 전망들이 가능하다면, 지금까지 토지법의 이론이나 실무가 주로 도시지역의 토지문제에 관심을 보인 데 대해 반성이 필요하다고 본다. 이제 4차산업혁명의 시대에는 교외지역이나 비도시지역의 토지문제가 토지법의 주된 관심영역으로 부상할 것으로 예상한다.
한편, 4차산업혁명은 공유경제의 활성화를 촉진시키는 데에도 중요한 기여를 할 것으로 본다. 공유경제 아래에서의 토지문제는 토지의 법적 성질을 다시 한 번 조명하게 하는 데에서 시작해야 할 것으로 본다. 사견으로는 현행법상 토지를 다른 재산과 마찬가지로 단순히 재물로 취급하면 곤란하다는 점을 주장하고 이에 대한 약간의 검토를 하였다. 즉, 토지는 공공재로서의 성질을 본래적으로 가지고 있는 물건으로 봐야 하지 않을까 하는 의문을 제시하면서,시론적 차원에서 사견을 밝혀 두는 바이다. 그러나 4차산업혁명의 시대에는 토지의 공공재적인 성질을 강조할 필요가 있다는 사견은 아직 까지는 시론에 지나지 않으므로 앞으로 이 문제에 대해서는 더욱 정밀한 검토가 필요하다고 본다.

영어초록

The term Fourth Industrial Revolution has become a significantly familiar expression for many people in Korean society. It is suggested that such a new term could become a familiar word to most people, because there has been a social consensus that the influence of the Fourth Industrial Revolution has a critical and serious impact on various fields in our society. This study focused on reviewing the educational, medical, transportational, and environmental changes among various other fields.* Professor at the college of law in GNU.




First of all, in the field of education, especially in the field of formal schooling, it is expected to see a fundamental shift from the so-called 'important' subjects, such as English and mathematics, to the education for the cultivation of creativity, amicable interpersonal relationship, and healthy body and spirit on the grounds that the knowledge of English or mathematics is predicted to be excellently replaced by the artificial intelligence. If we see such a change in the field of education, we might expect to have a simultaneous resolution of the issue of private education, which has been one of the deep-seated problems besetting the Korean society. Such a change in the field of education will have a significant contribution to addressing the ills of Korean education, represented as so-called the School District 8, while bringing about the changes in the people's preference in terms of their residential area. Accordingly, it is also anticipated to see the transition of the major interest in the field of land law from the urban land issues to the suburban land issues.
Next, in the field of medical treatment, it is expected that patients need not visit the major hospitals in large cities to get a proper therapy, as the diagnosis and treatment conducted by artificial intelligence will come into wide use, while the telemedicine system will be widely spread in the near future. Such transition is also expected to contribute to various changes in the areas of interest of the land laws. In the field of transportation, we will be able to see various changes in our daily life due to the spread of autonomous vehicles. For example, in a super-aged society, it is expected to cause a transition in terms of residence from the urban to suburban areas, as the society seeks for the right of movement of the elderly citizens, along with the innovative advancement of accessibility. Also, as the currently developing autonomous vehicles are mainly on the electric or renewable energy sources, we might expect to see an innovative solution to deal with the exhaust gas emission problems. Likewise, in the field of environment, it is likely to see applicable solutions through the development of solar energy generation, active implementation of renewable energies, and the spread of autonomous vehicles. If we assume that such optimistic prospects are reasonable, it could be argued that there should be a self-reflection that the theories or practices of the land law have mainly been focusing only on the land issues in the urban areas. Now, it would seem that the issues of suburban or non-metropolitan lands will become a major field of interest of the land law in the era of the Fourth Industrial Revolution.
Meanwhile, the Fourth Industrial Revolution is expected to have an important contribution to the promotion of sharing economy. It is suggested that the issues related to land law under the sharing economy system should begin with the review of legal nature of the land. In this study, it was argued that it might be inappropriate to consider the land ownership, under current law, equivalent to the ownership of other properties. Hence, the relevant consideration is included in the study to a certain extent. In other words, such argument was suggested along with a question from my private opinion on the level of the contemporary public sentiment: should not we consider the land as a thing that has the inherent property as a public good? However, the private opinion of seeing the necessity of emphasizing the land as the public good in the era of the Fourth Industrial Revolution is no more than just a contemporary general opinion, so there should be a more precise review with respect to this issue.
