자동차관리법상 중고차 성능ㆍ상태점검 책임보험 제도에 대한 입법평가 (Legislative Evaluation of Performance and Condition Inspection Liability Insurance System for Used Cars under the Automobile Management Act)

초록

자동차가 일상생활에 있어 중요한 도구가 되는 만큼, 자동차의 안전한 관리는 중요하다. 「자동차관리법」은 자동차의 등록, 안전기준, 자기인증, 제작결함 시정, 점검, 정비, 검사 및 자동차관리사업 등에 관한 사항을 정하여 자동차를 효율적으로 관리하고 자동차의 성능 및 안전을 확보함으로써 공공의 복리를 증진함을 목적으로 하는 법이다.
자동차는 신차시장 뿐만 아니라 중고차 시장도 활성화되어 있다. 신차의 경우 보증제도가 잘 되어 있지만 자동차 매매상에서 판매되는 중고차의 경우 종래의 경우 자동차성능ㆍ상태점검자 및 중고차딜러에 따라 중고차 매매 시 발급된 성능ㆍ상태점검기록부 내용과 실제 차량 상태가 상이할 경우 분쟁이 있을 수 있었다. 구매자, 성능점검자 및 판매자 사이의 정보의 비대칭성, 판매자와 성능점검자마다 책임에 대한 인식차이가 있을 수 있는데 이는 분쟁으로 이어지게 하기도 하였다. 이러한 문제점을 해결하기 위한 것이 자동차관리법상 중고차 성능ㆍ상태점검 책임보험 제도이다.
중고차 성능ㆍ상태점검 책임보험은 중고차 매매 시 발급된 성능ㆍ상태점검기록부 내용과 실제 차량 상태가 달라서 중고차 구매자에게 손해가 발생했을 때, 보험사가 이를 중고차 구매자에게 보상하는 보험이다.
자동차관리법 제58조의4와 동법 시행령에 의거, 성능점검자는 책임보험 가입이 의무화되었으며, 성능점검자는 본인이 점검한 차량에 대해 국토교통부에서 정한 항목을 보장해야 하며 이를 책임지는 보험에 가입할 의무를 진다.
중고차 성능ㆍ상태점검 책임보험 제도를 포함한 자동차관리법 일부개정안은 2018년 4월 25일부터 시행(법률 제14950호, 2017년 10월 24일 일부개정)되었으며, 중고차 구입 및 이용이 국민의 일상생활과 밀접하다는 점에서 중요한 제도로 지속적이고 안정적으로 발전할 수 있도록 입법에 따른 제도의 현재를 확인하고 현행법을 점검하는 입법평가가 필요하다.
중고차 구매는 일상생활과 밀접한 구매이며, 자동차관리법에서는 중고차 구매에 따르는 성능상 발생할 수 있는 문제점의 관리제도(법 제58조의4)를 가지고 있음에도 불구하고 입법목적의 달성과 현재의 문제점을 진단하는 선행연구를 찾기가 쉽지 않다.
이에, 본 연구에서는 자동차관리법상 중고차 성능ㆍ상태점검 책임보험제도의 입법체계성, 규범적 적절성, 입법실효성 등을 평가하고 현행법을 보완할 수 있는 법규범의 방향성에 관한 입법평가 결과를 제시하였다.

영어초록

Today we live in an era where we cannot imagine life without cars. As automobiles become an important tool in everyday life, safe management of automobiles is important. The “Automobile Management Act” is a law aimed at promoting public welfare by efficiently managing automobiles and securing the performance and safety of automobiles by prescribing matters concerning the registration, safety standards, self-authentication, correction of manufacturing defects, inspection, maintenance, inspection, and automobile management business of automobiles.
Not only the new car market but also the used car market is active. In the case of new cars, the guarantee system is well established, but in the case of used cars, there could be a dispute if the actual condition of the vehicle differs from the performance and condition check record issued when the used car was sold. Information asymmetry among buyers, performance inspectors, and sellers, and differences in perceptions of responsibility between sellers and performance inspectors may lead to disputes. To solve these problems, it is the liability insurance system for performance and condition inspection of used cars under the Automobile Management Act.
Used car performance and condition inspection liability insurance is an insurance that compensates used car buyers when damage occurs due to the difference in performance and condition inspection records issued when used cars are sold.
According to Article 58-4 of the Automobile Management Act and the Enforcement Decree of the same Act, performance inspectors are obligated to subscribe to liability insurance, and performance inspectors are obligated to subscribe to insurance that is responsible for the items specified by the Ministry of Land, Infrastructure and Transport for the vehicles they inspected.
Some revisions to the Automobile Management Act, including the liability insurance system for performance and condition inspection of used cars, have been implemented since April 25, 2018 (Act No. 14950, partially revised on October 24, 2017), and a legislative evaluation is needed to check the current status of the system under legislation and check the current law so that the purchase and use of used cars can continue and stably develop into an important system.
Therefore, the purpose of this study is to evaluate the legislative system, normative appropriateness, and legislative effectiveness of the used car performance and condition inspection liability insurance system under the Automobile Management Act, and to present the results of legislative evaluation on the direction of legal norms that can supplement the current law.
