자율주행자동차의 등장과 자동차보험제도의 개선방안 (A study on the appearance of the self-driving car and amendments of the Motor car Insurance)

초록

과학기술의 비약적인 발전은 기존의 법률체계에 많은 해결과제를 던지고 있다. 운전자의 조작없이 자동차 스스로 운행이 가능한 ‘자율주행자동차’의 등장 또한 그러하다. 이동의 편의성으로 우리의 발이 되어주었던 자동차는 각종 사고로 사람들의 생명이나 신체, 재산상의 손실도 가져왔다. 과실책임에 기초한 불법행위법리에 따라 운전자는 피해자에 대한 손해배상책임을 부담하게 되었으며, 이러한 위험은 자동차보험제도로 전가되었다.
그러나 자율주행자동차의 등장은 운전자의 과실에 기초한 자동차보험제도가 계속하여 필요하며 타당한 것인지에 대한 문제해결을 요구하고 있다. 운전에 관여하지 않는 자에게 자동차사고로 인한 손해배상책임을 부담하도록 하는 것은 합리적이지 않으며, 자율주행자동차의 제조자에게 완전한 자율주행기능을 탑재하지 않은 책임을 묻는다는 것도 기술의 발전을 저해하는 측면이 있기 때문이다. 그러나 자율주행자동차의 사고를 ‘제로(0)’로 만들 수 없는 현실이라면, 피해자 보호를 위하여 가장 합리적인 방안이 제시되어야 한다. 사고책임에 대한 주체와 범위를 둘러싼 해결기준을 제공해줄 법의 제정을 기다릴 수 밖에 없기에 입법자의 책임이 무겁다.
이 논문에서는 자율주행자동차의 발전단계와 입법현황을 정리하고, 현행 자동차보험체계로도 자율주행자동차사고시 피해자보호를 위한 보상이 가능한가의 여부와 제조물책임보험으로 해결 시의 한계를 분석한 후, 자동차보험제도의 개선방향을 제시하고자 하였다. 우선적으로는 현행 자동차보험제도를 보완하여 유지하는 한편 제조물책임보험의 확대방안과 자율주행자동차전용보험의 개발, 노폴트보험제도의 도입을 제안하였다. 자율주행자동차사고로 인신손해를 입은 자에 대한 보상은 사회공동체의 책임으로 받아들여야 한다는 인식에서 출발한 것이다. 자율주행자동차의 등장은 이동의 편의성을 넘어 사고의 예방과 손해의 감소, 피해자에 대한 구제가 우선되어야 한다는 우리사회의 시각변화를 위한 논의의 단초가 될 수 있기를 바란다.

영어초록

A rapid advancement of science-technologies provides assignments to amend our current legal systems. Self-Driving Car (SDC or Autonomous vehicle : AV) which can be driven without the drivers’ control is among those assignments. A vehicle undoubtedly provided convenience to our modern life but at the same time it brought some negative effects to our life such as injuries or death by accidents. As a result, victims were compensated according to the fault liability based tort law, and the risk of accidents therefore being monitored through the motor vehicle insurance. However, the appearance of the autonomous vehicle questions whether the tort based law should also apply to the driver who did not have the control of the vehicle. If it does, it would be unfair to punish the driver who had no fault on the accident as he was not controlling the vehicle and also it would hinder the development of new technology if the law punishes the manufacturer of the autonomous vehicle for not installing the appropriate autonomous system. Nevertheless, if it is impossible to prevent accidents caused by the autonomous vehicles, there needs to be a reasonable solution towards victims in order to protect them. In order to do so, we need a law to be amended particularly systematized for autonomous vehicle accidents. Therefore, legislators are becoming more responsible.
In this essay, it will outline the development process of the autonomous vehicles and its law system, also availability of compensation for the victims and it will inspect the limitations of the product liability insurance scheme and its road to a reform. This essay firstly proposes to sustain the autonomous vehicle insurance by supplementing the system. On the other hand it also proposes to expand the contents of the product liability insurance, the development of the autonomous vehicle insurance scheme, and the adaptation of the no-fault insurance scheme which emphasizes the responsibility for the victims of the motor vehicle accidents must be beared by the community as a whole. An appearance of the autonomous vehicle should go beyond the prevention of motor vehicles accidents to an alteration of our sight that victims must only be compensated.
