국제기구의 회원지위에 대한 연구 (A Study on International Organization membership)

초록

국제기구(International Organizations: IOs)에는 비정부기구와 다국적 기업이 포함되지만, 국제기구법에서는 통상 주권국가 등의 합의로 창설되는 정부 간 기구(intergovernmental organizations: IGOs)를 의미한다. 국제기구는 G8같은 국가 사이의 단순한 연합체와는 구별된다. 세계가 급격히 좁아지고 글로벌화가 눈부시게 이루어지는 국제화 시대에 국제기구는 글로벌 질서에서 매우 중요한 역할을 담당한다. 따라서 국제기구에서의 회원지위 확보는 국가안보나 국익과 직결되는 문제이고 우리의 경우에 통일의 이념이나 방향성은 세계평화와 안전 그리고 인권증진을 근본적인 이념으로 하는 국제연합(UN) 헌장의 규정을 벗어날 수 없는 것이 국제사회의 기속적인 질서이다. 국제기구의 회원자격에 대한 연구는 통일에 대한 방향성이 민주 평화통일일 수밖에 없음을 국제기구 헌장의 전범인 UN 헌장 규정을 통해서도 잘 알려 준다. 통일 대박론은 국민 경제적인 문제이지만 세계가 급속도록 가까워진 현대사회에서 통일 이후 국제기구의 주요 회원국이 되어 국제질서 형성에 능동적으로 참여하는 것은 더욱 중요하고 커다란 국익이기 때문이다. 미국 로스쿨의 경우에 국제기구법은 국제법이나 국제인권법과 별도로 매우 정치한 법규범적인 학문영역을 형성하는 바, 이에 본고는 국제기구의 회원자격과 관련된 법적쟁점을 구체적인 사례를 통해서 살펴봄으로써 통일을 지향하는 우리에 대한 교훈으로 삼고자 한다.

영어초록

Intergovernmental organizations(IGOs) are organizations comprised of sovereign states or of other intergovernmental organizations, on issues of common interest. Usually IGOs means international organizations(IOs), although IOs may also include international nongovernmental organizations such as international non-profit organizations(NGOs) or multinational corporations. In a legal sense, IOs should be distinguished from simple groupings or coalitions of states, such as the G8. Such group or association has not been founded by a constituent document and exist only as task groups for some time. The main purposes of IOs were to create a mechanism for the world’s common interest to work together in the areas of peace and security and also to deal with economic and social issues. In this current era of increasing globalization and interdependence of states, IOs have come to play a really significant role in global governance. For those reasons, IOs cover multiple issues and involve governments from every region of the world and IOs have become essential actors in the international community and their global impact continues to increase in compatible those of failed states.
For that purpose, IOs have various goals and scopes usually outlined in the treaty or charter. Some IOs developed to fulfill needs for debate or negotiation to resolve disputes. Others developed to carry out mutual interests with unified aims to preserve peace and security through conflict resolution and better international relations, promote international cooperation on matters such as environmental protection, to promote and preserve human rights, to promote social development like education, health care, economic development, to render humanitarian aid.
From these perspective of views, this paper examines closely the legal aspect of membership of the IOs and it's lesson to the reunification of Korea peninsular especially through the reunified German case. This thesis tells us that there is no alternative to the free and peaceful reunification of Korea peninsula under the UN system whose Charter aims to maintain international peace and security and to promote and encourage respect for human rights for fundamental freedoms for all.
