전자주민증 도입을 위한 법제정비방안에 관한 헌법상 고찰 (A Constitutional Study on the Improvement of Laws and Regulations for Introducing the Electronic Resident Registration System)

초록

정보사회에서 전자주민증의 도입여부는 주민등록법에 대한 헌법적 판단으로까지 거슬러 올라가야만 한다. 따라서 이미 추진되고 있는 전자주민증의 도입은 전자주민증 자체를 어떻게 만들 것인지, 그 안에 무엇을 담을 것인 지라는 논의만으로 해결될 수 있는 것이 아니다. 게다가 외부로 드러나지 않는다 하여 전자주민증에 담길 정보 자체의 위헌여부 시비가 사라지는 것도 아니다. 그렇다면 전자주민증, 개인식별번호의 필요성이나 그 도입여부 등은 행정의 효율성이나 편리성차원이 아니라 ‘헌법’차원에서 과연 허용되는지를 ‘규범적’으로 살펴보아야만 한다. 농경사회에서 산업사회를 거쳐 정보사회에 이르기까지 국가는 국민의 신원을 확인하고 거주관계를 파악할 권한과 의무가 있다. 하지만 현행 주민등록법이 많은 문제점을 가지고 있는 상황 속에서 단순히 전자주민증에 대하여 적극적으로 대처한다고 해서 해결될 일은 아니라고 판단된다. 오히려 적극적으로 국가에서 이러한 문제를 풀어가기 위한 장단기 법제정비방안을 제시하고 그에 따라서 지금 해결해야 할 문제와 시간을 두고 해결해야 할 문제에 대한 고민이 필요하다. 결국 이에 대한 헌법적 판단은 해당 분야의 문제로만 한정되지 않고, ‘정보사회’, ‘첨단과학기술사회’에서 국가의 역할과 기능 및 이러한 사회에서 국민의 기본권이 어떻게 보호되어야만 하는지에 관한 논의를 시작하게 하는 아주 중요한 문제이다.

영어초록

Since 2013, Korean Government has been promoted in the process of revising acts to introduce the electronic resident registration. It is a welcome measure that ministry of public administration security launched an improvement of legal system to protect personal information and to resolve problem of existing resident registration system. But it is not enough that discussing only methods and contents of e-resident registration to resolve many related problems. Because there could be still the unconstitutional possibility of the personal information contained in e-resident registration card. Then the introduction of electronic resident registration system must be checked to be constitutionally friendly now. The introducing the e-resident registration should be decided in the view of constitution especially the protection of constitutional right. In other words, considering the constitutional suitability of resident registration system is more important than examining the administrative convenience and effectiveness before introducing e-resident registration system. For this reason we need to check the e-resident registration system runs counter to the sprit of the Constitution or not in the aspect of sound social norms.
In the resident registration system, people need to report part of their personal information. But, in identification system, all people must get issuing certificates contains the unique number of many, many people. So that the resident registration system should be treated differently from the identification system. In reference to resident registration, it is needed to look over several foreign countries system like the Federal Republic of Germany in the aspect of comparative law. Some countries have only a system and related laws of resident registration without identification systems. Some countries like Germany have the resident registration system and also identification system. In Germany, types and ranges of personal information required can be varied according to the legislative purpose of related laws.
Thus on the whole, it is necessary to review systematically the current resident registration law. In other words, under the current resident registration law, they should collect and handle only personal information for surveying population movement like the residents’ relationship on neighborhood boundary and so on. In this connection, there must be a full understanding of reasons that resident registration system and the identification system should be treated differently. And, at the same time, there must be the consideration of redesign of legal system in social security area with taking effectual measures upon each legislative aim. In this context, the introduction of e-resident registration should be introduced in stages.
