대통령 피선거권 제한 중 국내거주 요건 (Requirements for Domestic Residence among the Conditions for Presidential Candidacy)

초록

대통령의 경우, 피선거권을 헌법과 법률에서 정하고 있다. 헌법에서는 “국회의원의 피선거권이 있고 선거일 현재 40세에 달하여야 한다”(제67조 제4항)고 하고, 공직선거법에서는 “선거일 현재 5년 이상 국내에 거주하고 있는 40세 이상의 국민이 대통령의 피선거권이 있다”고 한다(공직선거법 제16조 제1항). 그런데 대통령 피선거권에 대한 선행연구는 찾아보기 힘들다. 교과서에서는 해당 조항을 있는 그대로 설명하고 있을 뿐이다.
대통령 피선거권에 있어서 국내거주 요건 중 “선거일 현재 5년 이상 국내에 거주하고 있는 국민”의 해석이 문제된다. ‘계속하여 5년 이상’ 거주할 것이 요구되는지 ‘통산하여 5년 이상’ 거주할 것이 요구되는지 해석이 대립하고 있다. 문언상 계속이라는 표현의 유무에 따라 해석을 달리하므로 계속이라는 표현이 없는 현재 조항에서 계속이라는 의미로 해석하는 것은 바람직하지 못하다. 또한 해당 조항의 역사적 의미, 제정 및 개정 취지를 고려하였을 때에도 ‘계속하여 5년 이상’ 거주할 것으로 해석하는 것은 타당하지 못하다.
1987년 헌법 개정 당시 대통령 피선거권에서 국내거주 요건은 각 당의 합의로 제외되었는데 그럼에도 불구하고 이후 법률에서 국내거주 요건을 정한 것은 문제가 있다고 할 것이다. 또한 헌법 제67조 제4항은 대통령의 피선거권을 국회의원 피선거권을 가진 40세 이상의 국민으로 하고 있어 국내거주 요건을 규정하지 아니하였고, 현재 국회의원 피선거권은 법률에 의하여 25세 국민으로 되어 있는 점에 비추어 보면, 현재 대통령 피선거권으로 국내거주 요건을 정한 「공직선거법」 제16조는 위헌이다.

영어초록

In the case of the president, the conditions for eligibility to run for office are specified in the Constitution and in the Public Official Election Act. The Constitution states that “Citizens who are eligible for election to the National Assembly, and who have reached the age of forty years or more on the date of the presidential election, shall be eligible to be elected to the presidency.”(Article 67 paragraph 4), and the Public Official Election Act states that “A national who is 40 years of age or above and who has resided in the Republic of Korea for at least five years as of the election day shall be eligible for election to the Presidency.” (Article 16 paragraph 1). However, there has been no previous study on the restrictions that determine the eligibility of a presidential candidate for that office.
The question is how to interpret “A national who has resided in the Republic of Korea for at least five years as of the election day." This is because there are conflicting interpretations whether the intention is “for more than five years in a row” or “for more than five years in total.” In the written language, the interpretation differs depending on whether the expression “in a row” exists, so it is not desirable to interpret it as “in a row” in the current legal paragraph without the presence of the expression “in a row.” Moreover, it is not reasonable to interpret the clause as “for more than five years in a row” when considering the historical meaning, enactment, and purpose of the amendment.
When the Constitution was revised in 1987, the requirement for domestic residence was excluded with the agreement of each party, and it would be said that it was problematic that ‘the law’ later set the requirement for domestic residence.
In addition, Article 67 paragraph 4 of the Constitution did not stipulate the requirements for domestic residence. the Constitution only states that “Citizens who are eligible for election to the National Assembly, and who have reached the age of forty years or more.” However, the law, the Public Election Act, stipulated the requirements for domestic residence for presidential candidacy, not stipulated for election to the National Assembly.
Therefore Article 16 of the Public Election Act, which sets the requirements for domestic residence under the conditions for presidential candidacy, is unconstitutional.
