사회봉사명령의 특별준수사항과 원상회복 (Special Observances of Community Service Order and Restoration)

초록

대상판결은 피고인에 대하여 사회봉사를 명하면서 원상복구라는 내용의 특별준수사항을 부과한 것에 대해 보호관찰의 특별준수사항인 ‘범죄행위로 인한 손해를 회복하기 위하여 노력할 것’의 사항은 사회봉사명령 대상자에 대해서는 부과할 수 없다고 판시하였다. 사회봉사명령으로 원상회복을 내용으로 하는 회복적 사법을 고려한 것으로 보이지만, 사회봉사명령의 내용으로 할 수 없다는 한계가 있어 특별준수사항으로 원상회복을 방법을 사용한 것이라고 생각된다. 사회봉사의 성질상이 원상회복의 내용을 준수사항으로 강제할 수 있는 것인지 여부 등에서 문제의 소지가 있다. 이와 관련하여 사회봉사명령의 준수사항에 대해서 살펴보고 원상회복명령제도에 대한 도입 가능성에 대하여 살펴본다. 먼저 사회봉사명령의 일반적인 내용 검토를 통해 그 법적 성격 등을 규명하고, 개선방안으로 원상회복제도의 도입 가능성과 그 방식에 대해 검토하였다. 현행 사회봉사명령의 특별준수사항의 경우, 사회봉사명령의 특성에 맞지 않기 때문에 다양하고 효과적인 내용의 사회봉사명령의 특별준수사항이 개발하여 시행될 필요가 있고, 대상자의 기본권을 제한하는 특별준수사항의 경우 시행령보다는 법률에 직접 규정하는 것이 바람직할 것이다. 그리고 회복적 사법의 실현방법으로서 원상회복명령제도 도입이 필요하다고 볼 수 있다. 현실적인 피해자의 보호를 위해서는 원상회복을 제재수단으로 들여오면서도 이를 형벌과 결합시켜 원상회복이 이행되지 않을 경우를 대비하여 원상회복을 이행하지 않을 경우 형벌이 부활하도록 하는 방안이 타당할 것이다.

The judge ruled that the order “efforts shall be made to restore damage caused by criminal acts”, which was a special observation of the probation, shall not be applied to those subject to community service order regarding the imposition of special observation for restoration to the original state while ordering the accused to do community service, Originally, the restorative justice by doing the restoration to its original state through community service order was considered but the restoration is limited by doing the community service order. Thus, the special observation was used as a method of restoration. However, it is controversial to enforce the content of restoration as a special observation due to the characteristics of community services. In relation to this, this study discusses the observations of community service order and investigates the possibility to adopt the restoration order scheme. First, this study identified the legal characteristics through the general reviews on the community service order and reviewed the possibility and methods to adopt the restoration scheme as an improvement measure. For special observations in the current community service order, it is necessary to develop and enforce special observations of community service order with various and effective contents because the current special observations are not matched with the characteristics of community service order. It is also desirable to specify special observations that limited the basic right of the subject directly in acts rather than in enforcement decrees. In addition, it is deemed necessary to adopt a restoration order scheme as a method to realize restorative justice. It is reasonable to introduce a restoration order as a punishment means for realistic protection of the victims while reviving punishment if the restoration order is not fulfilled in case of not fulfilling the restoration order in combination with punishment.
