국민주권 실질화를 위한 국민투표 제도 활성화 방안 (A Revitalization Measure of Referendum System for Realization of Popular Sovereignty)

초록

제18대 대선을 통하여 ‘헌법개정’은 국민들에게 새롭게 인식되었고, 앞으로 제18대 정부의 국정 최대의 화두가 될 것이다. 우리나라에서 ‘헌법개정’을 하려면 헌법 제130조 제2항에 의하여 국민투표를 반드시 거쳐야만 한다. 국민투표는 국가정책의 최종결정을 국민에게 확인하는 절차로서 대의민주주의 하에서 예외적으로 국민이 직접적으로 주권을 행사할 수 있는 제도이다. 그러나 지금까지 우리나라의 국민투표는 헌법개정에 관하여 여섯번의 국민투표가 있었지만, 통치자 주도의 국민투표였기에 진정한 국민투표로 평가받지 못하고 있으며, 헌법 제72조에 의한 국가안위에 관한 중요정책에 관한 국민투표는 한 번도 시행된 적이 없다. 즉, ‘국민투표’는 헌법상의 권리이면서도 주권자인 국민이 지금껏 제대로 활용하지 못하고 있었고, 그 권리는 헌법상에서 잠자는 권리로 방치되고 있었던 것이다. 대의민주주의의 위기라고 할 만큼 지금은 국민이 주권자가 아니라, 의회가 주권자이고, 정당이 마치 주권의 주인인 듯 그 본질이 훼손되고 있는 현실에서, 이제는 국민투표 제도를 활성화하여 헌법상의 잠자는 권리가 아닌, 살아있는, 현존하는 권리로서 국민이 진정한 주권자로서의 지위를 확고히 회복시켜야 할 때이다.
이에 국민투표 제도의 활성화 방안을 제시한다. 첫째, 현행 헌법 제130조에서 뜻하는 ‘헌법개정’은 헌법의 법조항을 문자만 수정･삭제하여 수정하는 것만이 아니라, 대표자들이 정책 결정을 함에 있어 그 내용이 우리 헌법이 추구하는 본질에 어긋난다면 그것도 헌법개정으로 넓게 해석하여 국민투표로 결정하여야 한다. 둘째, 현행 헌법 제72조의 정책국민투표는 대통령에게만 독점적인 국민투표 부의권을 규정하고 있는데 대통령뿐만 아니라 국민에게도 확대하여 그 권리를 보장하여야 한다. 셋째, 정책국민투표의 대상범위를 ‘국가안위에 관한 중요정책’으로 한정하지 말고 ‘국가중요정책’으로 개정하여 국민이 언제든 국가정책결정에 참여할 수 있도록 하여야 한다. 현대사회에서의 국가안위는 단지 외적의 침입이나 내부 쿠테타에 의해서만 위협받는 것은 아니다. 더 위험한 것은 국민의 뜻을 무시하는 대표자의 잘못된 결정일 수 있기 때문이다. 그러므로 이제는 진정한 국민주권을 실현하는 방법으로서 국민투표 제도를 활성화하여야 한다.

영어초록

Through the 18th Presidential Election, a “Constitutional Amendment” was newly recognized by the people. In the Republic of Korea, all changes to the constitution must be done by referendum according to Article 130 Section 2 of the Constitution of the Republic of Korea. A referendum is a procedure that is held to verify the final decision of the national policy by the public and to ratify a proposed constitution or constitutional amendment - which is an exceptional system that enables the public to directly exert sovereign authority under representative democracy. Until now, six referendums have been held about the constitutional amendment in Korean history but it was exerted by the rulers, not by the people.
Moreover, there was no referendum regarding national security, pursuant to Article 72 of the Constitution, ever performed before. In other words, although a "referendum" is one of the constitutional rights the public have and should therefore be exercised, it was never properly utilized. Instead of sovereign power residing with the people, the Congress now exerts sovereign power, as well as the political parties acting on their own for their own good, it is safe to say that the true essence of representative democracy has been deteriorated and the situation is bad enough to be called the crisis of representative democracy. It is absolutely necessary to revitalize the referendum system to restore the power of the public and to help them to properly perform their constitutional rights. thus, the revitalization plan of referendum are presented here.
First, a word “Constitutional Amendment”, pursuant to Article 130 of the Constitution, should not be interpreted and understood only as legal provisions that are to be revised by just editing and deleting the words but should also include representatives to see whether the context of the provision is in accordance with the true purpose of the Constitution or not first and then decide if that provision is subjected to a constitutional amendment or not - and if so, the final decision must be made by referendum. Secondly, Article 72 of the Constitution states that the president has the exclusive right to submit to a national referendum only when and if he deems it necessary. However, this exclusive right should be expanded to the people as well to ensure and exercise the rights they have. Lastly, the public should be able to submit proposed amendments to the Constitution to a national referendum when the revision is deemed necessary and important for the national policy, not just for the purpose of national security. Therefore, the national referendum system should be revitalized as a way to enable the public to fully exercise their rights, fulfilling the true sovereignty.
