지방자치단체 회생제도의 특징과 입법시 고려사항 ― 미국연방파산법과 주(州)의 지자체 회생대책을 중심으로 ― (Special nature of the municipality reorganization and matters to be considered in legislation)

초록

지방자치단체 파산제 도입이 논의되고 있다. 이는 일부 지자체에서 전시성 행사를 위하여 예산을 낭비하는 사례가 발생하였고, 이를 시장의 힘에 의하여 방지하고자 하는 제도로서 정확하게는 지자체 회생절차로 함이 옳다고 하겠다.
미국은 연방파산법에서 지자체 회생절차를 규정하고 있다. 지자체 회생절차에서는 제11장 회생절차의 많은 규정을 준용하나, 지자체의 자치권 보장과 지자체의 연방정부로부터의 독립성, 삼권분립원칙 때문에 제11장의 절차를 변경하여 규정한다. 미국의 주정부는 자체의 파산법을 제정할 수는 없으나 주 소속의 지자체가 재정적 어려움에 처할 경우 위원회 또는 관리인을 파견하는 등의 제도를 두어 지자체의 재정적 어려움에 대처하고 있다.
본 논문에서는 우리나라의 지자체 회생절차를 입법한다는 관점에서 필요한 범위에서 미국 연방파산법 규정과 주의 지자체 회생절차를 설명하고, 이에 비추어 우리나라의 지자체 회생절차에서 규정할 사항을 설명하였다. 우리의 경우에는 미국과 같이 연방주의에 의한 제한이나 연방헌법상의 제한과 문제가 없으나, 채무자가 지자체라는 점 때문에 회생절차에서 지자체의 회생조치에 대해 법원의 허가를 요건으로 하는 등의 규정을 둘 수가 없다. 이 점에서 지자체 회생절차가 개시되면 중앙정부에서 감독위원회를 파견하여 지자체 회생업무를 감독하거나 또는 감독위원회가 지자체 장과 협의하여 회생업무를 추진할 수 있는 제도가 지자체 회생절차의 효율화를 위하여 필요하다고 본다.
우리나라의 도산법에는 파산절차와 회생절차에서 채무자와 채권자가 절차를 신청할 수 있도록 규정한다. 지자체 회생절차에서는 채권자가 지자체 회생절차를 신청하는 것은 지자체의 자치권 침해에 해당하므로 채권자가 회생절차를 신청할 수는 없다. 지자체 회생절차 신청권자를 지자체에 한정할 경우 지자체가 정치적 이유 때문에 신청하지 않을 우려가 있기 때문에 지자체의 감독기관이 지자체 회생절차를 신청할 수 있다고 본다.
회생계획안의 제출에 있어서는 지자체의 자치권을 보장하기 위하여 지자체만이 회생계획을 제출할 수 있는 것으로 하는 것이 바람직하다고 본다.

영어초록

Introduction of the municipality reorganization is considered in Korea, the purpose of which is to prevent municipalities from spending their budget to events to show off for political purpose with power of the market.
The United States has the municipalities reorganization procedure in Chapter 9 of the federal bankruptcy code, in which many provisions in Chapter 11 are applied with necessary modifications due to protection of autonomy of the municipalities, to independence from federal government and to separation of power. State governments cannot set forth their own state bankruptcy code due to limitation of the federal constitution, however many states have their own system to cope with financial difficulties of their municipalities, which is supervisory committee or receivership.
This paper explains Chapter 9 of the federal bankruptcy code and municipality reorganization system of the states to the extent necessary for legislation of Korean municipality reorganization procedure, and explains the matters to be provided in Korean municipality reorganization procedure. Korea has no limitation originating from federalism and federal constitution, it may not have provisions which requires court approval for reorganization measures to be taken by municipalities because the debtor is municipality. In this respect, the procedure is necessary for which government dispatch supervisory committee to the municipalities which are under financial distress to have the committee supersive the reorganization procedure or to have the committee to set up the procedure with the municipality.
Korean bankruptcy code allows debtor and creditor to apply for the procedure under bankruptcy and reorganization procedure, however, may not allow the creditor to apply for municipality reorganization procedure because it may infringe on the autonomy of the municipality. If Korea limits the applicant for the municipality reorganization to debtor, it might not apply for the procedure due to political reasons. In order to prevent from that phenomena, it would be necessary to allow the supervisory institution of the municipality to apply for the procedure for the municipality.
