초록

· 연구주제: 현실은 상상을 초월하는 과학정보기술의 발전과 개인용 컴퓨터의 보급과 접목하는 가상의 사이버공간에서 국경을 뛰어넘는 시공의 글로벌세계는 개인의 자유발현과 기업의 이윤 창출 또한 눈부신 발전을 거듭함과 동시에 사이버 공간을 통하여 스토킹, 악성 바이러스 유포, 무차별적 광고성 스팸메일, 업무상 기밀에 속한 고급정보를 해킹하는 불법행위가 범람하고 있다. 이에 본 연구에서는 이러한 가상공간에서 발생하는 수많은 불법행위 중 도박범죄에 대해 고찰함과 동시에 이에 국제적 대처방안과 입법 및 개선방안 제시를 목적으로 한다.
· 연구배경: 코로나19 펜데믹 확산 장기화로 인해 외부활동이 줄고 상대적으로 가택(방콕) 등에 있는 시간이 늘면서 도박중독으로 연결되는 사례가 사회적으로 큰 파장을 낳고 있다. 특히 최근의 Cyber 도박 유형은 스마트 폰이나 PC 이용한 용이하게 접근할 수 있는 ‘온라인 불법 도박’이라는 점에서 심각성은 배가된다. 본 연구에서는 도박중독 실태, 문제점 및 대책방안 마련에 그 배경을 두고자 한다.
· 선행연구와의 차이점: 인터넷 도박사범의 구체적인 사례에 대한 통계, 대법원 판례 등을 세심히 검토를 통해 사이버 도박의 행태, 범죄실태, Off-line 도박에 비하여 인터넷이라는 특수성을 감안한 도박의 강한 중독성이 개인적 사회적 폐해로 인간성 말살을 초래할 문제점 등을 살펴보았다 본 연구에서는 사회적․국가적 인력낭비, 외화밀반출, 비트코인 등 유사화폐의 은신처 제공(돈세탁), 사행심조장, 사기 등에 악용될 수 있는 다양한 문제점을 내포 있는 만큼 이에 대한 적절한 규제방안을 마련하고, 이를 지속적으로 보완해나가는 것이 필요하다. 이러한 맥락에서, 본 연구가 제시하는 인터넷 도박 대응방안은 인터넷 도박에 대한 형사법적 규제의 보완 또는 개정을 함에 있어 하나의 대안으로 제공될 수 있다. 또한 인터넷 도박 사이트에 대한 접근차단, 자금거래 차단 등의 정책을 강구함에 있어서 실효성을 제고할 수 있는 적절한 방안을 제공하여 도박 사이트의 규제정책에 지침서로서 활용할 수 있다. 아울러 인터넷 도박 규제 유관기관 및 학교 차원에서 인터넷도박의 폐해를 널리 광고하여 건전한 인터넷 사용에 대한 홍보교육을 함에 있어 유용한 자료로 이용할 수 있다.
· 연구방법: 출구없는 인터넷 도박, 가상의 사이버 공간에서 범람하는 범죄관련 기존의 선행 연구들을 검색, 탐구하면서 우선 사이버 도박죄의 이념정립을 명확히 정의하면서 전통적인 수사방법이나 증거수집 및 등에서 달리 취급해야 할 필요성, 법적 안정성, 범죄현상에 신속 대처성 등을 연구방법론으로 제시한다.
· 연구결과: 네트워크화한 가상의 공간(Virtual space)의 범죄들을 하나씩 유형화하여 그에 대응하는 범죄예방 방안을 제시함으로서 향후 발생할 수 있는 사이버범죄 예방 수사지침서를 마련하고 불법콘텐츠범죄를 영역별 형사법적 대안을 제시한다.
· 공헌점과 기대효과: 본 연구의 결론 부분에서는 익명성, 국제성, 쌍방향성의 특징을 가진 사이버범죄들 중 특히 사이버도박죄에 대하여 접근의 취약성을 극복할 수 있는 방안을 마련하고 국제형사법적 공조 수사대처 및 접근의 용이성을 강조하고자 한다.

· Research Topic: The global world of time and space that transcends borders in virtual cyberspace, which is combined with the development of science and information technology beyond imagination and the spread of personal computers, leads to dazzling development in terms of individual freedom and corporate profit creation. At the same time, illegal activities such as stalking, spreading malicious viruses, indiscriminate advertising spam, and hacking high-level information belonging to business secrets are overflowing through cyberspace. Therefore, the purpose of this study is to examine gambling crimes among numerous illegal acts occurring in these virtual spaces, and to present international countermeasures, legislation, and improvement measures.
· Background: Due to the prolonged spread of the COVID-19 pandemic, the number of outside activities is reduced and the time spent at home (Bangkok) is relatively increased. In particular, the seriousness of the recent cyber gambling type is doubled in that it is 'online illegal gambling' that can be easily accessed using a smartphone or PC. In this study, the background of gambling addiction situation, problems, and preparation of countermeasures is intended.
· Differences from previous studies: Through careful review of statistics on specific cases of Internet gambling offenders and Supreme Court precedents, the strong addictiveness of gambling considering the specificity of the Internet compared to cyber gambling behavior, crime, and off-line gambling is personal. In this study, we looked at the problems that could lead to the annihilation of humanity as a result of social harm. Therefore, it is necessary to prepare appropriate regulatory measures and continuously supplement them. In this context, the Internet gambling countermeasures presented in this study can be provided as an alternative in supplementing or revising criminal law regulations on Internet gambling. In addition, it can be used as a guideline for regulatory policies of gambling sites by providing appropriate measures to enhance effectiveness in devising policies such as blocking access to internet gambling sites and blocking money transactions. In addition, the harmful effects of Internet gambling can be widely advertised at the level of Internet gambling regulation-related institutions and schools, and can be used as a useful material for publicity education on sound Internet use.
· Research method: The need to deal differently with traditional investigative methods, evidence collection, etc. while first clearly defining the ideology of cyber gambling crimes while searching and exploring existing prior studies related to Internet gambling without an exit and crimes overflowing in virtual cyberspace , legal stability, and quick response to criminal phenomena are presented as research methodologies.
· Research Results: By categorizing crimes in networked virtual space one by one and suggesting crime prevention measures to respond to them, we prepare guidelines for preventing future cyber crimes and provide criminal legal alternatives for illegal content crimes by area. present.
· Contribution Points and Expected Effects: In the conclusion of this study, measures to overcome the vulnerability of access to cyber-gambling crime among cyber crimes characterized by anonymity, internationality, and interactiveness are prepared, and cooperative investigations under international criminal law are prepared. and ease of access.
