캐나다 연방 교정청(CSC)의 다인종․다문화 수형자 처우와 정책적 함의 (Ethnocultural Inmates Treatment of Correctional Service of Canada(CSC) and its Political Implications)

초록

이 연구에서는 캐나다 연방 교정청의 다인종․다문화 수형자들에 대한 교정처우의 기본이념과 내용, 주요 프로그램을 살펴보고 이를 통해 우리나라 교정당국이 활용할 수 있는 다양한 정책적 방안을 모색하고자 하였다.
연구결과, 캐나다 연방 교정청은 원주민 수형자들에 대한 효과적 처우를 위해 국가적 차원의 처우 계획을 수립하고 있는 것으로 나타났다. 또한 힐링 롯지(healing lodges)를 운영하여 그들의 심리적 개선과 회복에 중점을 두고 있는 가운데 높은 수준의 원주민 수형자 가석방 취소율을 개선하기 위해 ‘원주민 중재 센터(Indigenous Interventions Centers)’를 중심으로 원주민 사회와의 재통합에도 심혈을 기울이고 있었다.
타 국가에서 캐나다로 이주한 이주 수형자들을 위해서는 ‘국가 다인종․다문화 자문위원회(NEAC: National Ethnocultural Advisory Committees)’를 중심으로 언어, 문화, 인종, 민족성 등 다양성에 근거한 처우 프로세스와 프로그램을 제공하고 있었다. 그리고 이들의 원활한 사회복귀를 위해 각종 교육과 직업훈련의 기회를 제공하고 있으며, 지역 사회 교정 센터(CCCs: Community Correctional Centres)와 지역사회 고용센터(The Community Employment Centres)를 통해 이주 수형자들의 원활한 사회적응을 지원하고 있는 것으로 나타났다.
따라서 우리나라 교정당국에서는 첫째, 「형의 집행 및 수용자의 처우에 관한 법률」 등 관련 법령을 개정하여 다문화 수형자들의 처우 기준과 내용을보다 명확히 적시하고, 다문화 수형자 처우에 대한 중장기적 계획을 수립해야할 것이다. 둘째, 다문화 수형자들의 특성을 반영한 권리 보장과 처우 확대를위해 관련 위원회를 신설하고 전담교도소의 교정 공무원에 대한 다문화 감수성 교육을 확대해야 할 것이다. 셋째, 관련 법령의 개정을 통해 외국인 수형자에게 제공되는 교육훈련에 대한 구체적인 사항을 적시하고, 교육훈련 프로그램의 개발과 운영에 있어 다양한 관계기관이 참여할 수 있도록 해야 할 것이다.
그리고 귀화 국민이나 이주 외국인 가정 출신 수형자들을 위해서는 이들에 대한 기초적 사회 재적응 교육은 물론 정규 학위 과정과 자격훈련 과정, 취업알선에 이르는 체계적이고 전문적인 교육훈련 프로그램을 개발해야 할 것이다.
넷째, 지역사회와의 협력을 통해 귀화 국민이나 이주 외국인 가정 출신 출소예정자나 출소자를 대상으로 하는 다양한 지역사회 연계 프로그램을 개발, 운영해야 할 것 이다.

영어초록

This study intended to examine the basic ideology, details and main programs of Correctional Service of Canada toward ethnocultural inmates, and search for various political measures that our prison service can use through the foregoing.
Study results show that Correctional Service of Canada has established a treatment plan at the national level for effective treatment of native inmates. While placing emphasis on psychological improvement and recovery of inmates by operating healing lodges, CSC is also devoted to reunion with native society centering around Indigenous Interventions Centers’to improve high parole cancellation rate of native inmates.
And for inmates who migrated from other countries to Canada, CSC provides treatment process and program based on the diversity such as language, culture, race and ethnicity centering around National Ethnocultural Advisory Committees (NEAC). CSC also provides arious education courses and opportunities for vocational training for their smooth rehabilitation to the society, supporting for smooth social adjustment of migrant inmates through Community Correctional Centres(CCCs) and The Community Employment Centres.
Therefore, our prison service need to First, specify the standard and details of treatment for ethnocultural inmates more clearly by revising relevant regulations such as「The Act of Penal Execution and Correctional Treatment」etc., and establish a mid and long-term plan for treatment of ethnocultural inmates. Second, it is necessary to organize relevant committees for guarantee of rights and expansion of treatment reflecting characteristics of ethnocultural inmates, and expand ethnocultural sensitivity education for corrective officers in the exclusive prison. Third, it is required to specify detailed contents of education and training provided to foreign inmates and allow various relevant agencies to participate in development and operation of education and training programs through revision of relevant regulations. And for naturalized inmates or the ones from families of migrant foreigners, it is needed to develop systematic and specialized education and training programs for regular degree course, qualification training course and job placement as well as basic education for their social readjustment. Fourth, it is necessary to develop and operate various programs by connecting with local communities for naturalized inmates or the ones from families of migrant foreigners to be released or those who are already released through cooperation with local communities.
