일제의 관습조사와 전국적 관습의 확립과정 연구 ―『관습조사보고서』의 편찬을 중심으로 (Study on Custom Investigation of Japanese Empire and Establishment Process of National Custom : Centered on Compilation of Korean Custom Investigation Report)

초록

근대시기 일제에 의하여 조사되어 기록된 관습은 당시의 시대적 상황을 반영하고 있다. 관습조사사업은 한국침략의 수단으로서 근대적 민법의 편찬이라는 목표 하에서 추진되었다. 일제는 전국적으로 소통이 가능한 단일한 관습의 확립을 위하여 전국 48개 지역을 표본 조사하고 해당 지역의 조사보고서를 모두 작성하였으며 일부 사항에 관해서는 특별조사서도 작성하였다.
일제에 의하여 조사된 관습은 일본 민법의 체계와 용어를 기초로 조사하였다는 점을 고려할 필요가 있다. 이 방식은 일본 민법과 한국 관습의 차이를 드러낼 수 있는 방법이면서도 다른 한편으로는 일본 민법의 내용으로 한국 관습을 재해석하여 기록하도록 하는 결과를 초래하기도 하였다. 따라서 일제에 의하여 조사된 관습은 대한제국의 관습을 토대로 일본 민법적 개념과 용어가 일부 투영된 방식으로 기록되기도 하였다.
또한, 각 지역의 조사보고서와 특별조사서 등을 총괄하여 『관습조사보고서』를 편찬하는 과정에서도 일정한 선별원칙이 있었다. 왜냐하면 각 지역의 조사보고서에서 채록된 관습은 한국을 대표하는 표준적 관습은 아니었으며 한국인들의 관습이 모두 단일하게 성립한 것도 아니었기 때문이다. 뿐만 아니라 『관습조사보고서』는 근대적 민법을 제정하기 위하여 작성되었기 때문에 해당 관습도 근대적 원칙 하에서 일부 조정할 필요도 있었다.
이렇게 조사되어 기록된 한국 관습은 일제에 의하여 전국적 관습으로 인정받았으며 식민지 법을 제정하는 과정에서 큰 역할을 수행하였고 식민지 민사재판에서도 法源으로의 역할을 수행했다.

영어초록

The customs investigated and recorded by the Japanese Empire in modern times reflect the historical situation of that time. The custom investigation project was promoted under the objective called compilation of modern civil law. The Japanese Empire had performed sampling investigation of 48 regions nationwide for the establishment of national custom, prepared investigative report of corresponding regions and also prepared special report on some details.
It is necessary to consider the fact that the custom investigated by the Japanese Empire was based on system and terminology of Japanese civil law. While this method is the one that can reveal the difference between Japanese civil law and Korea custom, it had caused the result of recording by reinterpreting Korean custom using the details of Japanese civil law. Accordingly, the custom investigated by the Japanese Empire was recorded with a method in which some Japanese civil law concept and terminology was projected based on the custom of Korean Empire.
Also, there were certain sorting rules even in the process of compiling the Korean custom investigation report after generalizing the investigative report and special report of each region. That's because the customs recorded from the investigative report of each region were not the standard custom representing Korea and also not the ones in which all customs of Korean people was established in unity. Not only this, but because the Korean custom investigation report was prepared in order to legislate the modern civil law, it was also necessary to adjust corresponding customs under the modern rule.
The Korean customs investigated and recorded this way was recognized as national custom by the Japanese Empire, played a great role in the process of legislating the law and also performed role as the source of law even in the civil trial of the colony.
