근로기준법 제62조 연차유급휴가 대체의 쟁점과 입법적 보완 방안 (The study of the issues and legislative complements of the substituting system for annual paid leave)

초록

근로기준법 제62조의 연차유급휴가 대체 제도는 근로자들의 인식과 활용도가 매우 높다. 그러나 근로기준법 제62조는 매우 함축적이고 추상적으로 규정되어 있고 체계적인 해석론도 정립되어 있지 않다.
이 연구에서는, 연차유급휴가 대체 제도를 운용함에 있어서 최초 입법 당시의 상황과 달리 현재에는 휴가 취득 일수 확대보다는 근로자의 시기지정권을 더욱 실질적으로 보장하는 방향에 중점을 두어야 한다는 관점을 제시하고 그와 같은 지향점에 부합하는 해석론의 재정립을 시도했다. 그리고 근로기준법 제62조를 해석하기 위하여 먼저 규명되어야 하는 개념인 근로자 대표, 서면합의 등의 의미와 법적성질에 대하여 비교적 상세히 분석하고자 하였다. 구체적으로는 대표이론 적용을 통해 근로자 대표의 권한을 규명하였고, 근로자 대표의 민주적 선출 절차 정립 및 근로자의 주도에 의한 근로자 대표 사전적 선출 인정, 근로자 대표 임기 인정 필요성 등이다. 서면합의에 대해서도 근로계약, 취업규칙, 단체협약에 대한 변경적 효력이 인정되어야 한다는 점을 논증하였으나, 근로자의 시기지정권과의 조화를 위해서는 일본의 계획연휴제도를 참조하여 연차유급휴가 대체의 적용이 허용되지 않고 절대적인 시기지정권의 행사 대상이 되는 일정 휴가 일수를 유보하는 입법적 개선방안에 대한 검토 필요성을 제안하였다. 해석을 통한 구체화에는 한계가 있으므로 종국적으로는 입법적 해결방안이 가장 바람직할 것이다.

영어초록

The substituting system for annual paid leave under Article 62 of the Korean Labor Standards Act is a system that is very actively used. However, the academic interpretation theory of Article 62 of the Labor Standards Act has not been established. It is only operated by the fragmentary administrative interpretation of the administrative agencies. It is stipulated that a written agreement with the worker representative is required for the implementation of the annual paid leave alternative system, but the meaning and legal character of the worker representative and written agreement are not clearly understood yet.
Focusing on these problems, I reviewed the history and background of the introduction of the substituting system for annual paid leave stipulated in the Labor Standards Act. At the time when an substituting system for annual paid leave was created, it was important to increase the number of days that people could take annual paid leave, but nowadays the right to specify the time that they can use their leave at any time is becoming more important. Based on these assumptions, I tried to systematically reestablish the interpretation theory regarding the substituting system for annual paid leave.
Specifically, I suggested the theory of representatives is applied to investigate the authority of the representatives of workers, democratical electing process of the worker representative, and the system for selecting worker representatives in advance in response to workers' demands and so on. Finally, I proposed a solution through the legislation of the labor representative's conduct law. And I have demonstrated that the written agreement‘s effect is superior to labor contracts, work rules and collective agreements. Finally, I suggested that the planned consecutive holidays system of Japan should be refered to protect workers' right to designate the appoint time.
I think such academic indifference is an important reason why even the majority of workers wishing to substitute their annual paid leave have fallen into a system that has no choice but to await the disposal of employers. I hope that it will be thoroughly analyzed from Article 62 of the Labor Standards Act, and that it will be further systematically and logically interpreted.
