민간조사업법 제정과 조사대상자의 인권 (Private Investigation Act enacted in accordance with the human rights of those surveyed)

초록

미아ㆍ가출인의 소재 파악 등 치안인력 부족의 보완 필요성, 흥신소 및 심부름센터 등의 불법행위 방지를 위한 양성화 필요성, 새로운 일자리 창출 등을 고려해보면 기본적으로는 민간조사업법을 제정하는 것이 바람직하다고 생각한다. 민간조사업제도의 도입에 대한 견해 중 “개인의 사생활 조사가 민간조사업무의 전부라는 잘못된 인식은 사회적 논의를 엉뚱한 방향으로 호도하여 왔으며, 이제는 법원과 수사기관의 업무, 기업의 산업기밀과 영업기밀의 보호, 보험회사의 보험사고 조사 등 개인보다는 국가시스템과 기업 중심의 보안산업 영역에서 보다 큰 비중을 가지고 민간조사업제도의 필요성을 확인하는 노력이 요구된다”는 주장이 있는데 이는 설득력이 있다. 하지만 국민의 치안수요에 대한 만족과 사건이나 범죄피해자의 기본권보장을 위한 민간조사업제도의 도입논의가 오히려 일반 국민의 인권을 과도하게 침해할 수 있다는 점을 항상 염두에 두어야 한다. 따라서 민간조사업제도도입의 필요성은 긍정되지만 그 도입은 조사대상자의 인권침해를 최소화 할 수 있는 범위에서 이루어져야 한다고 생각한다.
그러한 의미에서 민간조사업법법 제정시 업무범위에 관하여는 기존에 제시된 민간조사업법안의 업무범위 중 개인의 인권침해를 최소화하면서 민간조사업무의 순기능을 극대화 시킬 수 있는 “①미아, 가출인, 실종자, 소재불명한 불법행위자에 대한 소재파악과 관련된 조사, ②도난, 분실, 도피자산의 추적 및 소재확인과 관련된 조사, ③교통사고의 원인 및 책임의 조사, ④변호사가 수임한 사건과 관련하여 해당 변호사로부터 의뢰받은 자료의 수집” 범위로 정하는 것이 타당하다고 생각된다.

영어초록

Enacting the Private Investigation Law basically is thought to be desirable given trying to consider the necessity of supplementing a lack of security personnel such as grasping location of missing child or runaway person, the necessity of legalization for preventing illegal act of a detective agency and errand center, and the creation of new job. Among opinions about the introduction of the private investigation law, there is argument as saying that “the wrong recognition as saying that the investigation into an individual's privacy is the whole of private investigation service has misled social discussion to inordinate direction, thus an effort is demanded now to try to confirm necessity of the private investigation system with having the bigger weight in the sphere of security industry of focusing on national system and enterprise rather than an individual such as the task of a court and investigative agency, the protection of industrial secret and business secret in an enterprise, and the investigation into insurance accident of insurance company.” This has persuasive power. However, there is a need of always giving a thought to a point as saying that the discussion about introducing the private investigation system for satisfying people's demand for security and for securing basic legal right of case or criminal victims may rather violate general people's human rights excessively. Accordingly, the necessity of introducing the private investigation system comes to be positive. However, its introduction is thought to be necessarily made in a boundary available for minimizing investigation subjects' human rights abuse.
In such sense, the scope of services given enacting the private investigation law is thought to be valid to be set for the bounds of “① investigation related to grasping location of missing child, runaway person, missing person, and offender with unknown whereabouts, ② investigation related to tracing robbery, missing article, and capital flight and to confirming location, ③ investigation into a cause and responsibility for traffic accident, ④ collection of data from a corresponding lawyer in relation to a case that the lawyer accepted” available for maximizing the right function of the private investigation service while minimizing an individual's human rights abuse amidst the service scope of the private investigation bill, which was suggested conventionally.
