대의제 민주주의 하에서 정당과 지방자치의 관계 (The Relationship between Political Parties and Local Autonomy under Representative Democracy)

초록

헌법상의 기본제도로서 정당과 지방자치는 대의제 민주주의 하에서 국민의 민주적 의사형성이라는 동일한 목적을 달성하고자 한다. 하지만 정당과 지방자치는 해당 목적을 달성하기 위해 사용하는 수단인 국가권력의 성향이 권력집중적인지, 아니면 권력분산적인지의 여부에 있어서 차이를 보이며, 이러한 차이는 정당과 지방자치가 형성하는 관계의 형태를 긴장 내지 갈등으로 만드는 원인이 되기도 하였다.
그러나 대의제 민주주의 하에서 정당과 지방자치가 제기능을 발휘하기 위해서는 양자가 상호보완관계를 형성하는 것이 필요하다. 이 때 국민의사의 최대한의 반영이라는 측면에서의 ‘민주적 정당성’과 각 제도의 효율적인 역할 수행이라는 측면에서의 ‘공직의 전문성’, 그리고 그 사이의 조율점으로써 ‘지역대표성’은 정당과 지방자치의 실질적 조화를 위해 작용하는 기준적 가치라고 할 수 있다.
정당과 지방자치는 지방선거를 매개로 연결되는 만큼, 정당과 지방자치의 상호보완관계는 지방선거의 과정에서도 드러나야 한다. 그렇기 때문에 정당의 광역자치단체 선거참여 또는 기초자치단체 선거참여의 타당성 판단은 그러한 정당참여가 정당과 지방자치의 민주적 정당성과 공직의 전문성을 얼마만큼 실현시키고 있는지의 판단으로 구체화될 수 있을 것이다. 이런 입장에서 정당의 기초의회의원 선거참여는 여전히 첨예한 견해대립이 존재하는 부분이다.
정당과 지방자치의 관계 내에서 지방자치를 향한 정당의 영향력 행사를 무조건적으로 배제하는 것은 타당하지 않을 것이며, 그런 맥락에서 지방자치 선거에서의 정당참여를 무조건적으로 부정하는 것 역시 타당하지 않을 것이다. 지방선거의 공천과정에서 나타나는 정당의 영향력이 부정적인 방향으로 흐를 수 있는 이유는 정당만이 공천을 할 수 있는 독점적 지위에 있기 때문이다. 따라서 정당에게 주어진 독점적 지위를 배제하는 방안으로서 선거인단체의 공천을 허용하는 방안이나, 지역대표성을 반영한 지방정당을 허용하여 전국정당과 지방정당이 공정하게 경쟁하는 환경을 조성하는 방안 등을 고려해볼 수 있을 것이다.

영어초록

As the basic constitutional system, political parties and local autonomy seek to achieve the same goal of democratic decision-making of the people under representative democracy. However political parties and local autonomy use different means to achieve their goals. Political parties use the power-intensive means, while local autonomy uses the power-decentralized means. These differences in the means used have caused the relationship between political parties and local autonomy to become tensions or conflicts.
However in order for political parties and local autonomy to function properly under representative democracy, it is necessary for the them to form a complementary relationship. At this time, the standard values that act for practical harmony between political parties and local autonomy are ‘democratic legitimacy’ in terms of the maximum reflection of the public opinion, ‘professionality of public offices’ in terms of effective role performance of each system, and ‘regional representation’ as a coordination point between the democratic legitimacy and professionality of public offices.
As political parties and local autonomy are linked through local elections, the complementary relationship between political parties and local autonomy must be revealed in the process of local elections. Therefore, the judgment of the validity of a political party's participation in the elections of metropolitan governments or the elections of primary local governments can be embodied by determining how much such political party's participation realizes the democratic legitimacy and professionality of public offices in the political party itself and local government. From this standpoint, there is still a sharp disagreement with the political party's participation in the election of the basic council members.
It would not be reasonable to unconditionally exclude political parties from exercising their influence on local autonomy within the relationship between political parties and local autonomy. And in that context, it would not make sense to unconditionally deny a political party's participation in local government elections. The reason that political parties' influence in the process of nominating local elections can flow in a negative direction is that only political parties are in a monopolistic position to nominate. Therefore, as a plan to exclude the monopoly status given to political parties, it is possible to consider a plan to allow the nomination of an electoral group or to allow a local party that reflects regional representation to compete fairly in the existing national party and local elections.
