초록

고차원적 정보처리 능력(인지, 학습, 추론)을 구현하는 기술을 말하며, 인공지능 기술은 인간 정보처리 활동의 원리를 분석하는 기초 기술과 ICT를 통해 이를 구현하는 인공지능 SW 및 HW 기술을 말한다. 이처럼 지능정보기술에 기반을 둔 지능정보화의 급속한 진전으로 인해 전 세계적으로 경제시스템과 사회구조는 근본적으로 변화하는 패러다임의 전환기에 있다고 할 수 있다. 이러한 지능화된 서비스는 인간 삶의 질을 향상시키고 새로운 지식에 접근성을 향상 시키는 등 새로운 기회를 제공할 것으로 예상된다. 그러나 지능정보화의 진전은 다양한 사회문제를 노출할 가능성도 동시에 갖고 있다. 이처럼 지능정보사회의 도래는 지금까지와는 다른 새로운 차원의 이슈를 제기하면서 새로운 규범체계의 정립을 요구하고 있다. 지능정보기술 및 지능정보기술과 다른 기술이나 서비스 등의 융합을 바탕으로 정치ㆍ경제ㆍ사회ㆍ문화를 포함한 모든 분야에서 새로운 가치를 창출하고 발전을 이끌어가는 사회가 지능정보사회이어야만 한다면, 이제 우리는 어떠한 지능정보사회에서 살아야 하는지에 대한 진지한 고민이 필요하다. 지능정보사회에 대응하는 법제정비방안 논의가 활발히 진행되고 있는 바, 이 논문에서는 지능정보사회에서 헌법의 역할과 기능이란 관점에서 검토한 결과, 지능정보사회를 규율하기 위한 국가의 책무로 지속가능성보장, 인공지능기술의 발전에 따른 투명성확보, 자율규제기구를 통한 지능정보사회 문제의 일차적 해결, 국가의 정보기반시설구축 책임, 지능정보사회의 신뢰기반 구축, 지능정보기술의 발전에 따른 새로운 분쟁해결절차의 강화를 제시하고자 한다.

영어초록

“Intelligence Information Technology(IIT)” is a technology that realize high level information processing ability of machine such as recognition·learning·reasoning·etc. of human by integrating artificial intelligence technology and data utilization technology. And It means artificial intelligence SW and HW technology that realize the analysis of principle information processing activity through basic technology and ICT.
Due to the rapid progress of intelligent informatization based on intelligent information technology, the economic system and social structure around the world are at the turning point of paradigm that fundamentally change. These kind of intelligent services are expected to provide new opportunities, such as improving the quality of human life and improving access to new knowledge. However, the progress of intelligent informatization has the possibility of exposing various social problems at the same time. The emergence of intelligent information society calls for the establishment of new normative system by raising new issues. If the society that creates new values and drives development in all fields including politics·economy·society·culture based on the fusion of intelligence information technology and intelligence information technology and other technologies or services should be intelligent information society, now we need to seriously consider how we do live in information society. There is an active discussion on legal measures to deal with intelligence information society. In this study, I intend to strengthen the new dispute settlement procedure as responsibility of the government for the regulation of the intelligence information society from the perspective of role and function of the constitution in the intelligence information society according to the guarantee of sustainability, transparency through the development of artificial intelligence technology, primary resolution of the intelligence information society problem through self-regulatory organization, establishment of national intelligence infrastructure, building trust of intelligence information society development of intelligence information technology.
