초록

이 논문은 그 제목을 “묘지의 설치 및 관리와 관련한 문제점과 개선방안”이라고 정하였다. 장래에 어떠한 문제가 발생할 것인지를 현재의 시점에서 정확하게 예단하여 대비하는 것은 일정한 한계가 있다. 그러나 그것이 사회질서를 규율하는 제도라고 한다면 불합리한 결과가 발생되지 않도록 그 위험성을 최소화할 수 있는 다양한 방안들이 모색되는 것이 타당하다. 특히 현행 장사제도를 합리적으로 재편하기 위해서는 과거의 장사제도가 현재에 이르기까지의 변천과정을 면밀하게 검토하는 것이 고려되어야 하는데, 이와 관련하여 최근에 이르러 우리나라의 장사문화는 종래의 매장을 중심으로 하는 문화에서 화장을 중심으로 하는 문화로 변화하고 있다. 이러한 최근의 장사문화의 변화로 인하여 장사와 관련되어 운용되고 있는 다양한 시설에 대한 수요도 과거에 비하여 점진적으로 증가하고 있는 실정이고, 각 지방자치단체의 경우에는 최근의 장사문화의 변화에 따라 장사시설을 효율적으로 운용하기 위하여 어느 수준에서 그 사용료를 결정하는 것이 합리적인지에 대하여 적지 않은 관심을 가지고 있다. 그런데 현재 장사(葬事)시설은 비선호시설 또는 혐오(嫌惡)시설로 분류되고 있기 때문에 일반인들이 살고 있는 거주공간에 인접하여 설치되면 생활환경에 부정적 영향을 가져온다는 이유에서 장사시설의 설치를 기피하고 있는 것도 일반적인 현상이다. 이러한 이유에서 장사시설을 유치하는 것에 대하여 반대하는 경우도 있지만, 일부의 지역에서는 장사시설을 영구수입원으로 인식하여 적극적으로 유치하여 운영하는 경우도 존재하고 있다. 한편, 현재 시행중에 있는 장사 등에 관한 법률에서는 분묘의 난립을 방지하기 위해 묘지 설치 시에 신고 또는 허가를 받도록 하고 있으며, 묘지 사용기간을 최장 60년으로 제한하는 시한부 매장제도를 규정하고 있고, 장사시설 부족으로 인한 국민의 불편과 묘지 등 장사시설이 자연을 훼손하는 문제점을 해소하기 위하여 자연친화적인 자연장 제도를 시행하고 있는 것을 주요내용으로 하고 있다. 또한 묘지의 설치기간이 종료된 분묘에 대하여는 해당분묘에 설치된 시설물을 철거하고 매장된 유골을 화장하거나 봉안하도록 하여 사실상 화장을 유도하고 있다. 전술한 것처럼 장사제도는 최근에 이르러 새롭게 창출되어진 제도라기보다는 장기간에 걸쳐서 변화 및 발전되어가는 제도라는 점을 고려한다면 종래에 발생한 법적 및 법외적 문제점들을 면밀하게 파악한다면, 장래에 정립될 장사제도는 보다 합리적이고 실질적 정의에 합치될 수 있다. 이러한 이유에서 저자는 본고에서 현행 장사제도와 관련한 법적 쟁점 중에서, 특히 우리나라의 경우에 묘지의 설치 및 관리상의 법적 및 법외적 문제점을 중심으로 몇 가지 논점을 검토하면서 그 개선방안을 제시하였다.

영어초록

The title of this thesis is ‘problems and improvement in connection with the installation and management of graveyard’. Of course, it would be difficult at the present moment to predict exactly what problems may arise in the future. However, there should be efforts to find solutions for problems related to regulation of public order so that the risk of causing unreasonable consequences can be minimized. Therefore, to rationally reorganize the funeral system, it is necessary to evaluate how this system has changed through the years. Korean funeral culture is changed from burial-oriented to cremation-oriented and the demand on cremating facilities is increasing. So local governments begin to take profound interest in determinating the reasonable rental fee of cremating facilities. The funeral facility is equipped near the resistance district where people can live. But stating life environment reason, it is classified the unpleasant facility where effect on environment such as landfills, power plants including atomic one, garbage incineration plants, and so on, hence it is avoided and excluded. So it shows that people oppose attracting funeral facilities or prevent building it. On the other hand, there are examples that some local governments attract funeral facility directly and manage it because they judge it as a permanent income. The current Funeral Law regulates the construction of graveyards by requiring notice or permission in order to prevent the inefficient usage of land due to large numbers of tombs when a graveyard is constructed, to limit the period of installation of a tomb to a maximum of 60 years, and to implement a nature-friendly funeral system for solving problems, which are inconvenienced from the insufficiency of funeral facilities and damage to nature from the graveyard, etc. Also, the current funeral law regulates to dismantle installed facilities of each applicable tomb and cremate or enshrine buried the remains at the time of expiration of a period of installation of the tomb. Therefore, the current funeral law actually recommends and supports cremation. Since funeral system is not something that is being newly developed but is a system which has evolved along with the history of mankind, a thorough examination of past problems can lead to a future legal system that is more rational and accords with substantial justice. I explained about the main contents of funeral system and dealt with the important contents of funeral system and suggested especially the legal and other matters and improvements in connection with the installation and management of graveyard in korea.
