미국 지방자치제와 현행 지방분권 논의의 문제점 (The problem of the current Decentralization Debate in light of the US Local Autonomy System)

초록

현 정부가 들어서면서 연방제에 준하는 수준의 지방분권을 내용으로 하는 개헌논의가 진행되는 중에 일부에서는 ‘행정권’의 분권이 아닌 ‘주권’의 분권으로 보이는 지방정부차원의 입법권(과세권 포함)과 사법권을 부여해야 한다는 주장까지 제기되는 등 풀뿌리 민주주의로서의 지방자치의 구현과는 거리가 먼 국론분열의 심각한 양상을 보이고 있다.
이러한 과도한 주장은 미국법령이 지방자치단체를 “지방정부”로 규정하고 있다는 점을 배경으로 한 것으로 보인다. 단언하건대, 미국의 지방자치는 연방정부에 대한 주정부의 권한문제가 아니라 주헌법과 주법률 내에서 주정부와 자치단체간에 이루어지는 ‘주권의 분권’이 아닌 ‘행정권의 분권’에 불과하다. 그렇기 때문에, 연방제에 준하는 지방분권을 주장하는 국내학자의 주장과 달리 미국의 주법(州法)상 지방정부의 명칭을 갖는 지방자치단체는 주권 또는 준주권의 주체인 연방정부나 주정부와 같은 입법･행정･사법권을 보유하지는 못한다.
이러한 점에서, 지방자치의 발전은 광역적인 문제가 아닌 지역적 현안에 대한 지역유권자의 자발적 참여에 의한 해소로서 현행법상의 기초지방자치단체를 기본단위로 하는 행정의 자율집행 차원에서 지방분권이 논의되어야 할 뿐 헌법개정 차원의 지방분권은 아닌 것으로 새겨야 한다. 우리에게 연방제 수준의 개헌논의가 필요하다면, 동독이 그러하였던 바와 같이 북한 내 모든 주민의 의사를 대표할 수 있는 기관이 전 주민을 위해 대한민국과의 평화적 통일을 의결하고 이를 대내외적으로 공론화한 때이다. 언급한 바와 같이 통일을 위한 연방제가 실시되어야 한다고 하더라도, 이념을 달리하였던 민족이 하나의 정부로 통합되기 위한 과도기에 그쳐야 한다.
요컨대, 지방자치의 발전을 목적으로 하는 지방분권에 관한 논의의 초점은 지역주민이 자율적으로 처리할 수 있는 새로운 행정사무를 발견하고 그 사무에 대해 주민의 자율처리권을 어떻게 보장할 것인가 하는 입법개선방안에 두어야 하고, 지방자치단체에 대해 주에 준하는 권한을 부여해야 한다는 주장은 주권의 분열을 야기할 수 있는 것으로 즉각 철회되어야 할 것이다.

영어초록

While the current government is in the process of discussing the amendment of Constitution with the level of decentralization equal to that of the federal system, some argue that decentralization should be perceived as a decentralization of sovereignty and that legislative and judicial powers should be given to local governments. These arguments can lead to the division of the state far from the implementation of local autonomy as grassroots democracy.
This excessive argument is based on the fact that the United States legislation defines a local governmental entity as a “local governments”. However, the US local government is not a state authority to the federal government but a decentralization of executive power, not a decentralization of sovereignty between the state and local governments within the state constitution and laws. In contrast to the claims of domestic scholars asserting decentralization based on federalism, local governmental Entity in the United States with the name of ‘local government’ under the state's statutes do not have legislative, administrative, and jurisdictionary powers, such as federal or state governments.
In this respect, the development of local autonomy is to be found in the promotion of voluntary participation in the issue of the village unit, not in the strengthening of the authority of the municipalities. The answer to this problem should be found in the legal guarantee of autonomous administration based on the basic local government. Thus, decentralization for local autonomy is not related to the amendment of the Constitution, but to the revision of the “Local Autonomy Law”.
If an institution that can represent all the residents in North Korea has decided to peacefully unify with the Republic of Korea and publicly publicize it internally and externally as in the case of German reunification, then we need to discuss the constitutional amendment at the federal level.   Even if the federal system is to be implemented for the unification of the two Koreas mentioned above, the period of federalism should be limited to the transition period in which the people with different ideals are integrated into one government.
In short, the focus of decentralization aimed at the development of local autonomy is gathered in legislative improvement measures to discover new administrative affairs that local residents can autonomously deal with and how to guarantee the autonomous disposition rights of residents It is not in the discussion to expand or strengthen the power of the local government as it is based on the state.
In short, the focus of discussion on decentralization aiming at the development of local autonomy should be placed on the followed; How to find a new administrative affairs that local residents can autonomously deal with and how to guarantee the autonomous disposition rights of the residents. Thus, the claim that state authority should be given to local governments should be withdrawn immediately, which could lead to divisions of sovereignty.
