영국의 금융감독체계의 개혁 및 입법적 시사점 (Reform of the Financial Supervision System of the UK and Legislative Suggestions)

초록

우리나라의 금융감독체계는 1997년 금융감독위원회와 금융감독원의 설립 이후 몇 차례 변화의 과정을 거쳐 왔지만, 체계 전반에 대한 근본적인 변혁은 없었다고 할 수 있다. 그러나 최근에는 현행 우리나라 금융감독체계의 모델 국가였던 영국이 새로운 금융감독체계를 운영하게 되자, 우리나라에서도 금융감독체계 전반에 대한 개편논의가 적지 아니하다. 영국은 2007년 7월 금융위기가 발생하자 이를 극복하기 위한 여러 가지의 법률들을 제⋅개정하고 그에 따른 정책을 집행하고 있다. 금융법제 분야에서는 통합금융감독기구(FSA)를 분리하여 이른바 이원화된 감독체계모델(Twin-Peaks Model)을 도입하였다. 그 주된 근거법률은 2013년 4월 1일부터 시행되고 있는 2012년 금융서비스법(Financial Services Act 2012) 및 개정 2000년 금융서비스⋅시장법이다.
이 논문에서는 우선적으로 2007년 7월 금융위기 이후 영국에서 논의되었던 금융감독체계의 개혁에 관한 일련의 연구보고서와 권고의 내용을 비교적 소상히 소개하고자 하였다. 그리고 신금융감독체계를 조망한 후 주로 영국의 관련법상 금융감독기구별 기능과 권한을 분석하여 보았다. 이러한 소개와 분석을 토대로 영국의 논의와 법제에서 얻을 수 있는 시사점에 대하여 기술하였다. 기술을 함에 있어서는 ① 금융기관과 고객비용의 증가 가능성, ② 정치적 선택의 산물로서의 금융개혁, ③ 기능별 분리규제의 한계 및 금융감독기구간 이해충돌 가능성, ④ 복층적 규제체계에 따른 금융감독기구간 이해조정의 어려움, ⑤ 건전성규제기구 감독방법의 한계 등 다섯 가지로 나누어 보았다.

영어초록

Even though the financial supervisory system of Korea has been changed several times since the Financial Supervisory Commission and Financial Supervisory Service were established in 1997, these changes have not brought about any fundamental reform of the entire system; however, recently there has been considerably debate about reform of the entire financial supervisory system because the UK, which has been a model for the Korean financial supervisory system since 1997, has introduced and is operating a new financial supervisory system. After the financial crisis that occurred from July 2007, the UK passed legislation and revised many acts in accordance with policies aimed at overcoming the worst of the crisis. In particular, in the field of the financial legislative system of the UK, the unified Financial Services Authority (FSA) was divided into a twin-peaks model. The main acts that are the basis for this change are the Financial Services Act 2012, which has been effective since 1 April 2013, and the revised Financial Services and Markets Act 2000.
Initially, this article introduces in comparative detail a series of research papers and recommendations made after the UK financial crisis. Then it provides an overview of the new financial supervision system and an analysis of the functions and powers of financial regulatory bodies under the relevant UK laws.
On the basis of this introduction and analysis, this article describes legislative suggestions that are taken from the UK legislative system. The description divides the suggestions into five areas, namely ① possibility of increasing expenses for customers and financial firms, ② financial reform as a product of political selection, ③ limitations of functional regulation control and the possibility of conflicts of interest between financial regulatory bodies, ④ difficulties in the adjustment in the interests of the financial regulatory bodies owing to the dual regulation structure, and ⑤ the limits of the supervisory methods of the Prudential Regulation Authority (PRA).
