매장문화재 보호 제도의 문제점과 개선방안 (Problems of Archaeological Heritage Protection System and Its Improvement Plan)

초록

매장문화재 보호는 우리나라의 최고 상위법인 헌법에서 규정하고 있는 국가의 당연한 책무이며, 매장문화재 보호의 근거가 되는 법령의 제정과 제도 및 정책의 수립․집행은 매장문화재 보호의 출발점이자 기초라고 할 수 있다.
매장문화재 제도 및 정책의 결정과 행정적 판단은 현재의 상황만을 고려한 미봉책이 되거나 국토개발을 위한 방패로 이용되어서는 안 되며, 매장문화재 보호라는 기본원칙에 충실해야 한다.
하지만, 현행 매장문화재 보호 및 조사에 관한 법률과 하위법령은 문화재보호법에 규정된 매장문화재 관련 조항과 지표조사 규정 및 발굴조사 지침을 법령의 체계에 맞게 재구성 및 관련 내용을 정비․보완하고, 각종 개발사업에 따른 구제발굴조사에 상당부분 초점이 맞추어져 제정․개정되어 왔다.
그 결과, 매장문화재 보호라는 측면이 소홀이 다루어졌으며, 법률과 하위법령의 체계성과 법령형식에 관한 헌법원칙 미흡 등으로 인해 적용과 해석에 따른 빈번한 갈등과 분쟁, 그리고 현실과의 괴리현상이 발생하고 있다.
매장문화재 보호 및 조사에 관한 법률과 하위법령은 이 글에서 제기한 문제점과 개선방안을 포함하여 매장문화재를 효율적으로 보호․관리하고, 법령형식에 관한 헌법원칙과 체계정당성의 원리에 부합하는 동시에 법령의 적용과 해석에 대한 명확성을 확보할 수 있도록 조속히 전면적으로 재검토 및 개정하는 작업을 추진해야 한다.

영어초록

Protection of archaeological heritage is an obvious obligation of our nation defined in the Constitutional Act, the supreme law of Korea. Legislation of laws which are ground for the protection of archaeological heritage, and establishment and execution of systems and policies are the starting point and foundation for the protection of archaeological heritage.
Systems and polices related to archaeological heritage and administrative decisions shall not be made as a temporary measure or a shield for national development, either. They should be in accordance with the basic principles of protection of archaeological heritage.
However, current laws related to protection and investigation of archaeological heritage and their sub-laws have been reorganized and complemented with various regulations and laws related to archaeological heritage specified in Cultural Heritage Protection Act and guidelines for excavations according to the system of the laws. They have been enacted and amended focusing on investigations for restoration of heritage excavated due to various development projects.
As a result, protection issue was overlooked in dealing with archaeological heritage, and there are frequent conflicts and disputes in application and interpretation of laws due to insufficient provisions in constitutional principles in terms of statutory forms and systematic arrangement of related laws and sub-laws, and gaps with reality.
It is required to review and amend the laws related to protection and investigation of archaeological heritage and their sub-laws in full scale and as soon as possible in order to protect and manage archaeological heritage effectively including solving the problems raised in this study and improvement plans, and secure the clarification on application and interpretation of laws as well as corresponding to the constitutional principles regarding statutory forms and the principle of system legitimacy.
