국제이주와 국적취득ㆍ박탈의 문제점 (International Migration and the Problem of the Acquisition and Deprivation of Nationality in Korea)

초록

오늘날에는 세계화라는 이름으로, 결혼, 취업, 유학 등 국적을 초월하여 한 인간이 이 지구상에서 가장 적합한 환경에서 살아가고자 하는 것이 곧 행복을 추구하는 것이다. 예를 들어 소치 올림픽의 빅토르 안은 과거의 한국의 안현수 선수였다. 그가 러시아 국적을 택한 것은 그 곳에서 선수 생활을 하기에 한 인간으로서 존엄성을 유지한 채 자기의 기량을 펼칠 수 있는 환경을 택한 것이다.
또 다른 경우는, 14년 전 부모님을 따라 미국에 가서 줄곧 불법체류자로 지내다 2012년 10월 추방유예 판정을 받고 임시 합법 신분을 취득하였다. 그녀는 미국 뉴저지주 러더포드 고교 졸업반인 박--(18세) 양으로 그녀는 이번에 하버드 대학에 합격하였다. 이는 버락 오바마 대통령이 ‘불법체류 청년 구제’의 행정 명령을 내린 결과이다. 또한 그녀는 하버드대학의 저소득청 지원에 따라 학비 전액을 면제받았다. 불법체류자에게도 이와 같이 인권과 기회가 주어지는 방향을 모색하고 있음을 알 수 있다.
이와 같이 국제이주는 이제는 일상이 되어가고 있는 추세이다. 즉 이제는 국경과 국적을 초월하여 한 인간이 어디에서 행복하게 살아갈 수 있느냐는 세계 속의 시민으로 살아가는 문제로 직결된다.
한국에도 이미 주한 외국인 체류자가 2014년 현재 160만에 이르고 있다. 이는 물론 결혼, 취업, 유학 등 여러 요인들이 있을 것이다. 그렇다고 이들이 한국에서 행복하기만 한 것인가 대한 문제는 곧 한 인간의 인권과 행복추구로 연결되는 문제이기도 하다.
이 지구상에 국가라는 존재가 있는 한 인간이 국적을 선택하는 것은 피할 수 없는 사실이나, 어디로 선택할지는 자유의지로 할 수 있는 국제적인 환경이 주어져야만 할 것이다. 물론 각 국가마다 제도와 법이 존재하여 그 전제 조건에 적합하여야 할 것이다. 그러나 그 전제조건이라는 것이 한 인간의 삶을 행복하게 하기도 하고 불행하게도 한다.
그러므로 본 논문에서는 한국에서 외국인으로 살아가는 데 어떠한 문제점들이 있는지를 분석하고자 한다. 첫째, 한국에서의 무국적자의 인권, 둘째, 결혼이주여성들의 한국 국적 취득 문제, 셋째, 복수 국적의 문제점 등을 살펴보고자 한다.

영어초록

Today, in the name of globalization, to pursue happiness means to live in the most suitable environment for marriage, work and study beyond nationality in the earth. For example, Skater Viktor Ahn in Sochi Olympics was Ahn Hyun-soo. He chose Russian nationality for an environment in which he could exhibit his talent while keeping his dignity as a human being for a life there as an athlete.
Another case is that of a woman who followed her parents to the U.S. 14 years ago, stayed there as an illegal alien, got deportation deferred in October 2012 and obtained a temporary legal status. She is Park Mi-jin (18 years old) in a graduating class of Rutherford High School, New Jersey, and was admitted to Harvard University. This is a result of an executive order of President Barack Obama's ‘Dream Act’ (Act for illegal immigrants who are college students). Also, she was exempted from the full tuition fees according to low-income group support of Harvard University. It is known that there is a direction in which human rights and opportunities would be granted even to an illegal alien.
Like this, international migration tends to become common. In other words, now, where a human being can live happily leads directly to an issue of living as a citizen in the world.
Foreigners in South Korea have already reached 1.6 million. This, of course, may be caused by several factors such as marriage, work and study. Yet, the issue of whether they are happy is related to a person's human rights and pursuit of happiness.
As long as states exist on this earth, humans cannot but choose a nationality, but an international environment should be given to their free will regarding what country they would like to choose. Of course, each country has institutions and laws, which should fit its prior conditions. However, the prior conditions make a person's life happy or unhappy.
Thus, this study attempts to analyze what problems there are in living as a foreigner in Korea. It will look into first, stateless persons' human rights in Korea; second, female marriage immigrants' acquisition of Korean citizenship; and third, the problem of dual nationality.
First, it will be focused on how to cope with immigrants whose nationality is cancelled due to fake marriage after having obtained a Korean citizenship, and they become a stateless person to protect their human rights; second, the issue in which female marriage immigrants cannot acquire Korean citizenship over 10 years even after they have passed the period of stay required by the National Act (2-3 years); and third, the problems occurring from the difference between one person's acquisition and exercise of plural nationalities will be analyzed.
