미국 원격의료제도의 연구현황과 시사점 (The Present Condition of the Telemedicine System in the United State and Its Implications for Korea)

초록

유비쿼터스사회·초고령화사회로 접어들면서, 원격의료에 대한 국민들의 수요가 증가하고 있으며, 국민의 의료접근성 향상과 의료비용의 절약 및 의료서비스의 질적 향상을 위하여 의료법에서는 원격의료를 규정하고 있다. 우리나라는 스마트폰 보유율이 2015년도 88%로 세계 1위이며, 무선 초고속인터넷 가입자 수가 5375만명으로 한국인구 5132만명보다 많을 정도로 인터넷통신이 발달됨으로써 의료서비스와 인터넷이 만나는 원격의료에 대한 국민들 요구가 증대되고 있다.
의료법 제34조와 동법 시행규칙 제29조가 정보통신시설을 이용한 원격의료를 인정하고 있으나, 원격의료의 허용범위를 의사와 의료인 간의 의료기술지원에 한정하고, 원격의료에 대한 세부적인 규정을 두지 않았기에, 실질적으로는 의료인 간의 ‘의료자문’ 수준에 머물러 있다고 볼 수 있다.
2013년과 2014년에 두 번에 걸쳐 정부에서 ‘의사-환자’ 간의 원격의료를 인정하고, 다소 구체적인 원격의료대상과 의사의 책임문제에 대한 내용을 담은 의료법개정법률안을 제안하였으나, 정부, 의료계 및 산업계의 이해대립으로 표류하고 있다.
현행 의료법이 허용하는 원격의료의 주체, 행위 및 객체는 최소한에 그치고 있으며, 개정법률안이 예정하고 있는 것도 체계적이지 못하는 불완전한 상태에 머물러 있으므로, 비교법적 연구가 필요하다. 그러므로 원격의료를 시행하고 있는 세계 각국의 제도를 검토해 볼 필요가 있으며, 특히 원격의료가 가장 발달된 미국의 관련 규정을 구체적으로 검토하여 시사점을 얻는 것이 필요하다.
미국의 원격의료는 대부분 연방사무가 아닌 주(州)의 사무에 속하고 각 주마다 서로 다르게 규정하고 있으므로 각 주의 원격의료제도를 구체적으로 살펴 볼 필요가 있음에도 불구하고, 대부분의 국내연구는 연방차원에서의 원격의료가 소개되어 있어 원격의료 관련법령의 정비에 활용하기에는 다소 부족한 면이 있다.
시장질서에 바탕으로 두고, 대부분 사법적 기구에 의하여 면허제도가 운영되고, 보험체계에 의존하여 원격의료가 시행되는 미국의 원격의료 상황을 고려하면서, 미국의 각주에서 운영되고 있는 원격의료의 근거 법령들을 구체적으로 분석해 볼 필요가 있기에, 우리나라에 소개된 미국의 원격의료제도에 대하여 검토하고, 시사점을 살펴보고자 한다.
