일본의 실무에서 나타난 성년후견제도의 문제점 - 우리나라에의 시사점을 중심으로 - (The Problem of the Adult Guardianship System with the Japanese Welfare Workplace- Focusing on what this means for South Korea -)

초록

2015년 1월 현재, 우리나라는 성년후견제도를 시행 한지 만 1년이 경과되었다. 성년후견제도가 제대로 활용되고 있는지, 성공적으로 정착되고 있는지 지난 1년간을 되짚어 안정적으로 제도를 정착시킬 필요가 있다고 판단된다. 현재까지 성년후견제도는 업무의 비효율성 등에 대한 문제가 제기되고 있지만, 실제 현장에서 발생하는 현실적인 문제에 대한 논의는 없는 실정이다. 반면에, 일본에서는 후견인 등의 횡령 및 부정행위, 감정생략에 따른 폐해 등 많은 문제점들이 실무로부터 나타나고 있다. 이에 일본은 성년후견제도를 사회안전망으로 기능하고 요보호자가 안심하게 이용할 수 있도록 많은 노력을 기울이고 있다. 그럼에도 불구하고 예견하지 못한 많은 문제점들이 여전히 나타나고 있다. 일본은 우리나라와 전반적인 가족제도뿐만 아니라 성년후견제도의 실시 배경 및 운용체계가 매우 유사하다. 따라서 본 논문에서는 일본의 실무현장에서 나타난 문제점을 분석하고 이를 토대로 안정적이고 성공적인 성년후견제도 정착에 도움을 줄 수 있는 시사점을 얻고자 한다.

영어초록

One year has passed since the execution of the adult guardianship system in South Korea as of January of 2015. It has been surmised that there is a need to evaluate whether the adult guardianship system has actually been well-utilized and successfully established for the past year for its secure system settlement. Generally speaking, the possibility of an outbreak of a problem is derived from past experiences and the legal system is accordingly amended based on the exact nature of the problematic issue. However, in the case where there are no precedents, it would be hard to predict what the future holds leading to the exposure of severe limitations in the actual amendments of the legal system. Manyopposing arguments have been forthcoming regarding the matter of the actual work inefficiency among others of the adult guardian system up to now, but the reality of the situation is that no actual propositions pertaining to the problems that happen in the real sites have been raised. On the other hand, various problems in the actual work have been appearing in Japan such as embezzlement and corruption on the part of the guardian as well as the harmful consequences that resulted from the absence of estimation. In response, the Japanese authorities are exerting a lot of effort so that the person requiring protection can use the adult guardianship system service safely as part of the social safety net. Despitetheir efforts however, many unforseen problems are still coming out of the woodwork. Notonly the general family policy but the Japanese adult guardianship system's executive background and management structure are very similar to that of South Korea. Therefore, this paper attempts to look at the problems that have emerged in the Japanese sites and analyze them to obtain some directive viewpoints based on the findings. In the case where the problem occurred, it wouldn't be too bad to revise the problem but it would be much better to forsee the problem and come up with appropriate measures to prevent it before it occurs. This is judged to be much more helpful in aiding the establishment of a stable and successful adult guardianship system for the future.
