우리민법전에 대한 법제교류지원방안에 관한 연구 (A Study on Legislation Interchange Supporting Plan for Korean Civil Code)

초록

최근 우리나라 민법전에 대한 체제전환국․개발도상국의 관심이 많은 상황이다. 이에 우리민법전에 대한 법제교류지원에 관한 방법적인 고찰이 필요한 시기이다. 이때 우선적으로 인식해야 할 것은 민법전에 대한 법제교류지원에는 경제적 목적과 정치적 목적의 조화에 의한 수행이 필요하다는 점이다. 그리고 민법전이 시장거래법의 일반법전, 시민사회법의 일반법전, 국가의 기반법전이라는 측면도 고려하여야 할 것이다.
민법전에 대한 법제교류지원의 방법으로는 민법전의 형태에 대한 교류지원, 민법전의 기초·개정에의 직접적 정보교류, 민법전의 기초·개정을 위한 준비활동에 대한 교류지원, 민법전 법제교류지원에 따른 입법평가에 대한 교류지원으로 구별하여 고찰할 수 있다.
그리고, 민법전에 대한 법제교류지원의 과제로는 첫째, 민법전 자체에 대한 고려사항으로서, 민법전정비의 필요성에 대한 인식의 공유, 민법전의 기본구성, 민법전의 내용상의 문제로 나눌 수 있고, 이 중에서 민법전의 기본구성에 관련하여서는 ①판덱텐체계와 인스티투티오네스체계, ②개별입법 방식과 포괄적 법전편찬 방식, ③물권과 채권과의 관계 문제에 대한 논의가 필요하다. 또한, 민법전의 내용상의 문제로서는 ①기본용어 및 개념의 정립 문제, ②영미법적 요소와 대륙법적 요소간의 조정, ③법률행위 개념의 채택여부에 대한 검토가 필요하다. 그리고 둘째, 민법전에 상법, 소비자계약법, 지적재산법을 편입할 것인가도 고려할 필요가 있다.
이러한 모든 상황을 고려하여 우리민법전에 대한 법제교류지원을 대상국에 하고자 할 때에는 대상국의 사회․문화․경제적 여건을 고려하고, 대상국과의 충분한 협의절차를 거쳐 최적의 입법방안을 강구하여야 할 것이다.

영어초록

Recently, some transition countries-developing countries are taking much interest in Korean Civil Code. Therefore, it's necessary to review the methodological consideration of the legislation interchange support for Korean Civil Code. At this time, what to be recognized primarily about the legislation interchange support for Korean Civil Code is to require the performance by the harmony between economic purpose and political purpose. Additionally, it shall be also considered that the Civil Code is the general code of market transaction law, that of civil society law and Nation's basic law.
Methods of legislation interchange support for Korean Civil Code can be classified into and considered as the interchange support to the type of Civil Code, the direct information interchange about the enactment·amendment of Civil Code, the interchange support of the preparation activities for the enactment·amendment of Civil Code and the interchange support of legal evaluation in accordance with Civil Code legislation interchange support.
As the tasks of the legal interchange support for Civil Code, first, the consideration of Civil Code itself can be divided into the common recognition of necessity for the reorganization of Civil Code, the basic organization of Civil Code and the contents problem of Civil Code. Among those, it is necessary with regard to the basic organization of Civil Code to discuss ① Pandekten system and institutiones system, ② individual legislation mode and comprehensive code compilation mode and ③ the relationship between a real right and an obligatory right. Additionally, it is necessary with regard to the contents problem of Civil Code to review ① the formation of basic terms and definitions, ② the adjustment between the common law elements and the civil law elements and ③ the adoption of definition about legal act. Second, it is necessary to consider whether or not the Commercial Law, Consumer Contract Act and Intellectual Property Law may be incorporated into Civil Code.
When it is intended to give the legislation interchange support for Korean Civil Code to a target country after considering all of these circumstances, the social?cultural?economic conditions of the target country shall be considered and the optimum legislative plan shall be contrived through the full discussion with the target country.
Concretely, it is necessary to both develop the legislative supporting program of a supporting country for Civil Code support and construct a system for interchange support.
