유전자원 ‘특허’와 WTO TRIPs ‘비차별 주의’에 대한 소고 - 나고야의정서 제11조 제1항 월경성 협력을 중심으로 - (A study on Genetic Resources Patent and WTO TRIPs Non - discrimination principle; Focusing on the Nagoya Protocol Article 11 Section 1 Transboundary Cooperation)

초록

‘동일한’ 유전자원이 복수의 국가에 존재할 경우(월경성 상황), 특허의 ‘동일성’에 대하여 판단해야 한다. 유전자원의 ‘동일성’과 특허 허여의 상관관계, 생물다양성 협약 및 나고야의정서의 소급효 적용과 선출원 지위의 상관관계, 불법적 상황과 무권리자의 특허 출원 및 특허의 상관관계에 대하여 타당성을 검토해야 한다. 다음으로, 월경성 상황의 유전자원 ‘특허’와 ‘비차별주의’의 충돌 쟁점을 분석해야 한다. 비차별주의는 ‘내국민대우’와 ‘최혜국대우’로 구성되며, 나고야의정서의 사전통보승인(PIC)과 점검기관의 이행준수(Compliance)와 충돌할 수 있다. 사전통보승인(PIC)과 충돌 가능한 ‘비차별주의’는 첫째, 내국인과 외국인과의 차별 금지, 둘째, PIC 신청방법에 관한 ‘정보’ 제공, 셋째, 유전자원 이용 단계별 PIC 절차의 ‘변경’ 방법의 문제가 있다. ‘점검기관’과 비차별주의 쟁점은, 국내 점검기관이 이원화 되어 있고, ‘서면’ 요건을 요구하는 ‘허가’ 제도와, 타 법률안으로 신고를 갈음하는 경우로 분리되어 있다. 또한 나고야의정서에서 요구된 ‘국제인증서’와 국내 법률의 ‘허가’ 요건 사이의 괴리가 발생한다. 월경성 상황이 발생할 경우, 대응할 수 있는 방안은, 나고야의정서의 접근(Access), 이익 공유(Benefit-Sharing), 이행 준수(Compliance)로 구분할 수 있다. 접근(Access) 단계에서는 PIC와 중첩 국가 별 점검기관의 연동화 시스템이 구축되어야 한다. 이익 공유(Benefit-Sharing) 단계는 연구 단계부터, 계약법상 유전자원 출처 공개를 의무화 하는 방안이 구축 되어야 한다. 이행 준수(Compliance) 단계는, 한국의 법률 서비스 시장을 국제화하기 위하여, 특허법원을 통한 대체적 분쟁해결제도를 활성화해야한다.

영어초록

The purpose of this article is to examine the links between the patent of genetic resources and WTO TRIPs non-discrimination principle in transboundary cooperation. This analysis looks at the transboundary cooperation of the Nagoya protocol article 11 sec. 1 which states that "In instances where the same genetic resources are found in situ within the territory of more than one party, those parties shall endeavour to cooperate, as appropriate, with the involvement of indigenous and local communities concerned, where applicable, with a view to implementing this protocol." Unfortunately, this protocol leaves unanswered the question of how could we cooperate in the transboundary situation.
This paper proposes a theoretical framework that analyzes the transboundary situation and its relation to the non-discrimination principle of WTO TRIPs. First, it analyzes the transboundary situation of genetic resources patent by examining the correlation between the same genetic resources and the patent application. Then the first-to-file system is applied while checking the retroactive effect of CBD and nagoya protocol and finally considers the patent application of unentitled persons in illegal situations. This comprises the first main feature of Transboundary situation of genetic resources patent with direct relevance to the Non-discrimination principle of WTO TRIPs. Non-discrimination principle is composed of National treatment and Most favored nation principles.
Secondly, this paper considers the Prior Informed Consent(PIC) and Designation of checkpoints related with the Non-discrimination principle. In the case of the PIC, great attention has been given to the question of discrimination between domestic and foreign users. In addition, measures should be taken to avoid discrimination of the application method of PIC. Next this paper notes the importance of checkpoints designation. Regretfully, research on "checkpoints designation" of domestic law related with nagoya protocol is still in its early stages.
Thirdly, this article suggests the transboundary cooperation between Nagoya protocol and WTO TRIPs. First, the PIC and 'checkpoints designation' should be linked with nations in the transboundary situation. Second, when applying R&D steps there is need to meet the disclosure requirement of genetic resources and lastly is the invigoration of the legal service of Intellectual property dispute settlement center in the patent court when implementing compliance steps.
This paper hopes to serve as a platform for the discussion of transboundary cooperation of genetic resources' patent.
