초록

행정법의 본질은 경찰법이라고 해도 무방할 정도로 행정에 있어 경찰작용은 본질적인 것이며, 이는 지방자치행정에 있어서도 다르지 않다. 그러한 이유에서 지방자치 내지 지방분권의 논의에 있어서 자치경찰제의 문제는 매우 중요한 법적 과제로 다루어지고 있지만, 그럼에도 불구하고 그 구체적 제도화에 대해서는 다양한 논의가 끊이지 않고 있으며, 실정법제화가 시도될 때마다 격렬한 찬반의 논쟁 끝에 결국 결실을 거두지 못하고 있는 것이 현실이다. 그러한 문제상황은 여러 가지 이유에서 기인하지만, 본 고에서 지적하고 싶은 것은 그간의 자치경찰 논의는 주로 자치경찰제의 효율적 운영에 관한 정책적 관점을 중심으로 하여 왔을 뿐, 자치경찰의 본질에 대한 법리적인 접근, 특히 지방자치법원리에 대한 고려가 미흡하였기 때문이 아닌가 하는 점이다.
그러한 문제의식에서 본 고는 그간의 자치경찰제 논의와는 달리, 자치경찰의 구체적 제도화의 문제보다는 지방자치권의 본질이라는 차원에서 경찰개념을 통한 자치경찰제의 본질 및 자치경찰의 제도화의 방향성에 대해 고찰해 보고자 한다.
우선적으로 자치경찰의 대상과 관련하여, 경찰개념을 행정경찰과 사법경찰로 분류할 때, 자치경찰제의 논의에 있어서는 일단 제도적 의미의 경찰에 의한 행정경찰, 즉 학문상 보안경찰이 그 대상이 되어야 한다. 협의의 행정경찰은 자치경찰의 문제가 아닌, 일반적인 행정상의 자치권의 문제로 귀결되며, 동시에 사법경찰은 사법작용의 일환인 점에서 지방자치의 본질상 자치경찰제의 원칙적인 대상과 범위는 아니라고 할 것이다. 물론 법적 근거를 통해 자치경찰이 사법경찰작용을 수행할 수도 있으나, 그러한 경우에도 이는 자치사무가 아닌 위임사무로 보아야 하는바, 그 법원리적 의미는 전혀 상이하게 된다.
한편 자치경찰제를 법원리적으로 고찰하여 본다면, 지방자치의 헌법적 보장은 지방자치단체에 대해 지역적 사무에 대한 전권한성과 자기책임성을 보장한다. 그러한 관점에서 볼 때, ‘지역적 사무’의 개념이 불확정개념이기는 하지만, 그럼에도 불구하고 보안경찰사무는 기본적으로 지역적 사무로서 자치사무에 해당하며, 따라서 자치경찰은 당연히 자치권의 범위에 포함된다고 보아야 할 것이다. 지방자치단체의 관할 구역에서의 공공의 안녕과 질서유지는 전형적인 공간적 요소로서, 지역과의 관련성을 가진 사무이며, 특히 지역에서의 치안 및 질서 유지는 지방자치단체의 다른 행정작용, 가령 복리사무의 수행을 위한 당연한 전제인 점에서, 전형적인 지역적 사무로서 지방자치단체의 사무라고 할 것이기 때문이다.
결론적으로 지역에서의 공공의 안녕과 질서유지에 대한 경찰행정은 법원리적으로 당연히 지방자치 영역에 포함되어야 하는 것으로, 자치경찰제 실시의 당위성은 헌법상 보장된 지방자치의 원리로부터 도출된다고 할 것이다. 따라서 종래 국가경찰제와 자치경찰제 사이의 선택의 문제를 입법정책적 문제라고 이해하는 입장도 다수 있으나, 지방자치를 헌법이 직접 보장하고 있는 현행 법제 하에서는 자치경찰제의 도입은 입법정책적인 문제가 아니라, 헌법규범의 실현으로 보아야 하며, 단지 어떠한 제도와 내용으로 자치경찰제를 구체적으로 제도화할 것인지에 대해서는 입법정책적 재량이 인정되는 것이라고 할 것이다.

영어초록

Police action is so essential in the administration that the administrative law is called the police law. It is the same in the local autonomous administration, therefore, the autonomous police system is a very important legal issue in the local government system. Nevertheless, the discussion on the introduction of the autonomous police system is still controversial and has failed to achieve the success of legislation. There may be many reasons for this, but the most important reason is that the autonomous police debate in the past focused on only the policy aspects of the efficiency of the autonomous police system, not the legal approach to the nature of the autonomous police system, especially in the principle of local autonomy.
In this sense, this paper intends to study the legal nature of the autonomous police system and the legal direction of institutionalization in terms of the nature of local autonomy rather than the problem of concrete institutionalization of autonomous police system.
In the administrative law, the concept of police is divided into administrative police and judicial police. On the premise of this distinction, in the discussion of the autonomous police system, the administrative police should be the target, and at the same time be the institutional police by the police agency, in other words, the so-called security police is the object of the autonomous police system. Because the administrative police in consultation is not a problem of autonomous police and it results in the problem of general administrative autonomy. At the same time, judicial police are not administrative and are not part of the autonomous police system, as they are part of the judicial process. Of course, although the autonomous police can perform the judicial police function through special legal grounds, in such a case, it is a delegated task, not an autonomous task, so the legal status is completely different.
On the other hand, from a legal point of view, the constitutional guarantee of local autonomy guarantees local governments the right to autonomy over local affairs. Although the concept of local affairs is vague, it should nevertheless be seen that security police work essentially constitutes an autonomous task as a local affairs. Because the maintenance of security in the territories of municipalities is typically associated with the area of local governments, in particular, the maintenance of public well-being and order in the region is a prerequisite for the performance of other administrative functions.
In conclusion, the police function for maintaining the local public order should be included in the domain of local autonomy as a matter of law, In conclusion, the police function for the maintenance of public well-being and order in the region should be included as a natural part of the local autonomy from the viewpoint of constitutional guarantee of local autonomy. From this, the necessity of introducing the autonomous police system is derived, in other words, the introduction of the autonomous police system is not a policy issue, but a legal order based on the Constitution. However, a considerable legislative discretion is recognized in the institutionalization of the autonomous police system, therefore, further research is needed on how to institutionalize the autonomous police system specifically.
