자치경찰제의 개선방안에 관한 고찰 (Review of Improvement Plans for the Local Municipal Police System)

국문초록

2021년 7월 1일부터 시행된 전면적 자치경찰제는 국가경찰조직으로 일원화된 자치경찰제 모형을 도입하였다. 이 모형에 대해서는 지역실정에 부합하는 생활안전활동의 시행보다는「경찰청과 그 소속기관 직제」의 규정에 따라 경찰청이 결정하고 시·도경찰청과 경찰서 그리고 지구대와 파출소로 이어지는 계선조직에 따라 과거와 같이 지역실정에 부합되기 어려운 획일적인 경찰활동만이 반복될 가능성이 크다는 비판이 적지 아니하다. 그런 측면에서 자치경찰제의 도입취지에 비추어볼 때 중앙집권적인 국가경찰제를 극복했는지에 대해서도 의문점은 여전히 남는다. 본고에서는 현행 자치경찰제에 대한 문제점을 첫째, 경찰법상 사무유형별 권한배분문제, 둘째, 경찰법상 자치경찰사무의 법적 성격, 셋째, 시·도의회와 자치경찰의 관계, 넷째, 시·도지사와 자치경찰의 관계, 다섯째, 시·도자치경찰위원회의 독자성문제, 여섯째, 현행법상 실질적인 주민참여 흠결 등으로 나누어 살펴보았다.
향후 자치경찰제의 개선방안으로 첫째, 자치경찰의 일원화 모델의 한계 극복, 둘째, 지방자치 법현실을 고려한 자치경찰사무 구분의 필요, 셋째, 시·도의회와 자치경찰의 관계 재정립, 넷째, 실질적인 주민참여형 자치경찰제 정착을 위한 노력 등에 대해 살펴보았고 그 밖에도 사회적 약자 보호를 위한 자치경찰의 역할의 재정립, 자치경찰사무의 확대에 따른 자치경찰인력의 증원의 필요, 자치경찰 관련 안정적 재원 확보방안 등도 고찰하였다.
향후 경찰법령의 개정을 통해 지방자치의 실질적 보장의 제도화와 함께 자치경찰의 근본적 지향점을 명확히 할 필요가 있다. 아울러 경찰이 지역주민들과 긴밀한 협력관계를 조성하고, 이를 통해 안정적인 지역치안을 유지하려는 노력인 지역사회 경찰활동(Community Policing), 경찰서비스 경쟁 유도, 주민참여 실질화 및 경찰협력단체와의 협력 강화 등을 통한 경찰서비스의 현장대응성 제고 등과 같은 민주적 자치경찰제의 장점의 실천과 함께 주민들의 강력한 여론인 자치경찰에 대한 사회적 약자 보호 임무를 실현하는데 필요한 인력과 예산의 확보를 위한 적극적 노력이 필요하다고 본다.

Abstract

The comprehensive municipal police system, which took effect from July 1, 2021, introduced a model of the municipal police system unified into the national police organization in consideration of various legal realities. The problem is that the current autonomous police system is highly likely to only engage in uniform police activities that do not coincide with local conditions as in the past. For example, rather than implementing life safety activities in line with local circumstances, autonomous police follows the mooring organization that leads to city and provincial police agencies, police stations, and district corps and police boxes by the decision of the National Police Agency in accordance with the provisions of “Organization of the National Police Agency and its affiliated agencies”. In that respect, questions still remain as to whether autonomous police has been overcome the centralized national police system.
This study examined the evaluation of the current self-governing police system below: first, the issue of power distribution by task type under the Police Act, second, the legal nature of autonomous police work under the Police Act, third, the relationship between city and provincial councils and the autonomous police, fourth, the relationship between the mayor/governor and the autonomous police, fifth, the independence of city/provincial police committees, and sixth, the problems of lack of actual resident participation under the current law.
And as one of the future tasks, it was confirmed that they should take measures in consideration of the social environment in which various social anxiety about a wide range of crimes against women, including dating violence, illegal filming, stalking, and sexual crimes, is growing. Therefore, the role of the autonomous police to protect the socially disadvantaged such as youth, women, children, the elderly, housewives, and the disabled needs to be substantiated, and its main role needs to be stipulated in protecting the socially disadvantaged in the region.
The Korean-style autonomous police is especially meaningful in promoting national development through competitive development based on the unique circumstances of each region, which is the essence of local autonomy. The practical task for this is to make an effort to establish the ideological model of the autonomous police system at an early stage through creative efforts based on the uniqueness of each local government.
In the future, it is necessary to institutionalize the practical guarantee of local autonomy through the revision of the Police Act and to clearly define the fundamental direction of the autonomous police. In addition, active efforts are required to secure manpower and budget that the advantages of a democratic autonomous police system are realized, such as local community policing, inducing competition for police services, realizing resident participation and strengthening cooperation with police cooperative organizations, enhancing on-site responsiveness of police services through joint production of public affairs, etc. and mission protecting the socially disadvantaged by autonomous police are realized.
