형법 제34조 제1항과 정범배후(正犯背後)의 정범(正犯)의 적용문제 (The applicability of Pragraph 1 Article 34 of Criminal Act and another offender behind a principal offender)

초록

본 연구는 위험사회에서 형법의 임무를 고려하여 종국적으로 형법 제34조 제1항에서 정범배후의 정범의 적용가능성에 대하여 검토를 하였다. 이를 위하여 우선 간접정범의 개념과 본질 및 판례의 입장을 분석하였으며, 이러한 분석을 통하여 간접정범의 속성과 정범배후의 정범의 관계성을 파악하게 되었다. 즉, 간접정범은 타인을 범행의 도구로 이용하여 범죄를 실행하는 자이다. 이러한 간접정범은 배후조종자가 우월한 의사지배로 타인을 장악하여 배후에서 범죄를 실행하게 되는 것이다. 그렇다면 현실적으로 형법 제34조 제1항에 규정된 간접정범의 성립범위에 한정하여 고도로 지능화되고 있는 각종 범죄에 대하여 형법적 대응이 가능한가? 하는 것이다.
이러한 의문점에 대한 해결책을 제시하고자 간접정범의 유형과 형태를 검토하였으며, 그 결과 간접정범의 구조는 이용자가 배후에서 피이용자를 도구로 활용하여 범죄를 실행하는 것이기 때문에 실질적으로 이용자가 범죄를 직접 실행하는 것과 본질상으로 차이가 없다고 생각된다. 따라서 간접정범은 정범으로서의 속성을 가지기 때문에 정범배후의 정범을 적용할 수 있으며, 아울러 피이용자의 귀책원칙에 대하여 완화하는 방향으로 형법 제34조 제1항을 입법하는 것이 위험사회에서 형법의 임무에 충실한 것으로 생각된다.
사실 형법 제34조 제1항에 규정된 간접정범의 유형으로 정범배후의 정범, 즉 배후정범을 입법하게 되면 피이용자를 교묘하게 이용하는 각종 지능범죄의 배후인물에 대한 합리적인 형사처벌이 가능하다는 측면에서 매우 유용하다고 생각된다. 무엇보다도 형법 제34조 제1항과 정범배후의 정범의 관계성을 검토한 결과, 다양하게 지능화되는 각종 범죄의 예방과 형사실무에서의 합리적인 형사처벌을 위하여 형법 제34조 제1항에 정범배후의 정범을 처벌하는 규정을 입법하는 것이 바람직하다고 생각된다.
이와 관련하여 독일 형법 제25조 제1항의 입법론을 참고할 필요도 있겠지만, 사실상 배후자가 교사 또는 방조가 아닌 다른 방법으로 피이용자를 이용하여 간접적으로 범죄를 실행하였기 때문에 간접정범의 형태로서 우리 형법 제34조 제1항을 적용하여도 무리가 될 것은 없다고 생각된다. 따라서 간접정범과 관련된 조항을 무리하게 개정을 하기보다는 현행 형법 제34조 제1항의 틀을 유지하면서 배후정범(背後正犯)을 간접정범의 유형으로 인정하여 형법 제34조 제1항에 ‘배후에 의하여 정범으로 처벌되는 자’를 추가하고, ‘교사 또는 방조하여’를 ‘이용하여’로 자구를 수정하는 입법적 방안이 효율적이라고 생각된다. 이에 따라 형법 제34조 제1항에 배후정범을 처벌하는 규정을 입법하게 되면 형사실무에서도 각종 지능범죄의 배후자를 정범으로 처벌할 수 있어 법적용상 논란의 해소와 형사정책적 측면에서도 효과가 있을 것으로 판단된다.

영어초록

In the light of the criminal justice duties in a dangerous society, I ultimately reviewed the applicability of another offender behind a principal offender in the criminal justice system under Article 34 paragraph 1. To do this, I analyzed the concept and nature of indirect crime and the position of the judicial precedent, and this analysis provided me with an understanding of the nature of indirect crime and its relationship with another offender behind the crime. In other words, indirect crime is a person who uses others as a tool for committing a crime. This indirect crime means that a manipulator takes control of others and carries out crimes behind them. So, the question is whether it is possible to take legal actions against various crimes highly intelligent in the future only within the scope of the establishment of indirect crimes as provided under Article 34 paragraph 1 of the Criminal Act.
I reviewed the types and forms of indirect crime to provide a solution to these questions, and as a result, I think that the structure of indirect crime does not differ substantially from the actual practice of executing the crime directly by the users as a tool. Therefore, indirect crime could be applied to another offender behind the crime in that it has properties as direct crime. And it would be considered desirable to legislate Article 34 paragraph 1 of the Criminal Act in a direction that mitigates the principle of imputation of the users as indirect criminals from the point of view of the duty of the Criminal Act in a dangerous society.
In fact, the type of indirect crime prescribed in Article 34, 1 of the Criminal Act. so if we legislate an Article about another offender behind an offender, it is possible to punish another offender behind an offender and it is thought that in various useful intelligence crimes, to ensure reasonable criminal justice, indirect crime should be dealt in the same way. First of all, as a result of reviewing the relationship between Article 34 of the Criminal Act and an offender, I think that the provisions of Article 34 of the Criminal Act should be considered in Article 1 of the Criminal Act in order to prevent various crimes and to ensure reasonable criminal justice.
With regards to this, it may be necessary to review the legislation of Article 25 paragraph 1 of the German Criminal Act, but in fact, since the person behind the scenes committed the crime indirectly, using the user, not by teaching or abetting it, the application of Article 34, 1 of our Criminal Act as a form of indirect crime is not too much to be tolerated. Therefore, I do not think it is good to revise the provisions relating to indirect crime. Rather it might be better to add to ‘A regular offender who is punished by a crime behind’ in keeping with the framework of Article 34 paragraph 1 of the current Criminal Act, and revise ‘by instigating or aiding and abetting another person who is under his control and supervision’ into ‘by using another person who is under his control and supervision.’ Accordingly, if Article 34 of the Criminal Act provides legislation to punish those behind the principal offender, it will also punish those behind intellectual crimes as regular criminals, which will be effective in solving legal disputes and criminal policy aspects.
