헌법개정에 있어서 의원내각제와 대통령제에 관한 제도분석 (The Institutional Analysis on Both Presidential and Parliamentary System in Constitutional Amendment)

초록

헌법은 일련의 집단적 의사결정과정의 결과이고, 또한 다른 집단적 행위를 촉진하는 제도이다. 헌법의 기본목적은 행정권에 대한 입법적 기초를 확립하고, 헌법이 조직하고 수권하는 특별한 정부기관에 행정권을 배분하며, 또 헌법개정의 절차를 포함하여 실정법과 정책의 발전을 위한 지침을 제공하는 것이다. 이 글은 다음과 같은 이슈들을 분석하고 있다.
첫째, 현행 대통령제가 어떻게 제왕적 대통령제로 운영되었는지를 검토하고, 동시에, 대의기관들이 유권자의 선호와 이익에서 벗어나서 유권자들이 선출한 대통령과 의회는 잠재적으로 자신들의 선호와 이익에 따르는 대리비용을 검토한다. 많은 국가들에서 대통령제와 의원내각제의 선택이 권력분립의 원리와 합의민주주의와 다수지배민주주의에 달려있다.
둘째, 현행 대통령제 하에서 영합게임인 대통령선거와 총선거의 결과로서 출현한 분점정부의 원인과 그 폐해를 다루고 있다. 행정부의 압도적 우위에 기초한 대통령제의 분점정부에서 여당과 야당은 정치적 충돌을 하였다. 대통령과 의회의 대리비용을 낮추고, 또 분점정부의 정치적 충돌을 억제하기 위해서 국민투표와 국민발안의 직접민주주의를 고려해야 한다.
셋째, 의원내각제의 헌법은 여당과 야당 간의 권력분립의 원칙이 어떻게 적용되는지를 검토한다. 특히, 의원내각제 헌법은 여야 간의 정치적 갈등을 조정하는 수단으로서 내각의 의회해산권을 보장하고, 또한 대통령제와 의원내각제 중에서 무엇이 보다 더 유효한 선택기준인지를 검토한다.
끝으로, 왜 현행 헌법의 대통령제가 개정되어야 하는 이유와 헌법개정의 방안으로 두 가지의 순수대통령제와 의원내각제의 개정방안을 제시하면서, 특히, 우리나라의 헌정사에 있어서 대의민주제에 대한 경제분석으로서 공공선택의 시사점을 검토하고 있다.

영어초록

Constitutions are themselves institutions that result from a series of collective decision-making processes and motivate other forms of collective actions. The primary objectives of constitutions is to establish the legitimate foundations of governmental powers, to allocate those powers among the specific organs of government that the constitution creates or recognizes, and to provide a road map for the development of positive law and policy, including instructions for constitutional change. I am concerned with some issues in this paper as following:First, I am going to review how to run the existing presidential institution as an imperial presidency, and at the same time, representatives raise a problem of agency costs by elected president and parliament whose preferences or self interests potentially diverge from those of their constituencies. The Choice in many countries between presidential system and parliamentary system can be relied upon by the check and balance of powers and a consensual democracy and a majority democracy.
Second, I will deal explicitly with their reason and side-effects how the divided government did emerged under existed presidential system which has been resulted from the presidential election of a zero-sum game. The divided government on the basis of the presidential government of executive supremacy has been politically quarreled by the ins and outs. We can take into consideration of holding the direct democracy as a plebiscite and people's initiatives which is going to decrease an agency costs of both president and parliament and to prevent the political collisions between the ins and the outs under the divided government.
Third, we can review how the constitution of parliamentary government can apply the rule of check and balance between the ins and the outs. In particular, that parliamentary system may guarantee the right to dissolve of the House of Representatives which can reconcile from their collisions between the ins and the outs, and I am going to examine the more effective selection criteria between presidential system and parliamentary system.
In short, we have to review some issues as follows: why we have to change the presidential government through the Constitution's Amendment soon? I do raise both the genuine presidency and parliamentary government as the perspectives of Constitution's amendment, and refer to the public choice's implication of economic analysis of the representative democracy in Korean constitutional political history.
