재건축현금청산의 감정평가시점에 관한 연구 (A study on the timing of appraisal of reconstruction cash settlement)

초록

재건축현금청산이란 재건축사업이 진행될 때 재건축조합원이 그 조합원으로서 지위를 포기하고 해당 금액을 현금으로 보상받는 것을 의미한다. 재건축현금산은 「도시 및 주거환경정비법」이 2017년에 전면 개정되기 전에는 매도청구를 준용하도록 했다. 개정 후에는 「도시 및 주거환경정비법」 제73조에서 재건축현금청산에 관하여 명확하게 규정하고 있다. 같은 법 제73조 규정에 따르면 사업시행자는 관리처분계획이 인가ㆍ고시된 다음 날부터 90일 이내에 현금청산대상자와 토지, 건축물 또는 그 밖의 권리의 손실보상에 관한 협의를 하여야 한다. 다만, 사업시행자는 분양신청기간 종료일의 다음 날부터 협의를 시작할 수 있다. 이에 관한 협의가 성립되지 아니하면 사업시행자는 위의 90일이 종료된 다음 날부터 60일 이내에 매도청구소송을 제기하여야 한다. 또한 사업시행자는 그 60일을 넘겨서 매도청구소송을 제기한 경우에는 지연일수(遲延日數)에 따른 이자를 지급하여야 한다고 규정하고 있다.
위의 제73조 규정을 분설해 보면, 첫째, 재건축현금청산에 있어서 매도청구소송으로 표현되어 있어서 본래의 매도청구와 구별하고 있지 않다. 둘째, 재건축현금청산 금액의 산정에 관한 규정이 명확하게 규정되어 있지 않다. 셋째, 분양신청기간 종료일의 다음 날부터 협의를 시작할 수 있다라는 규정 때문에 감정평가시점의 판단에 논란이 있다. 넷째, 지연일수에 따른 이자지급의 규정이 위의 60일을 넘겨서 매도청구소송을 제기했을 경우에만 적용되는지 문제가 있다. 본 논문에서는 이러한 문제를 해결하기 위한 방안에 대해서 연구하였다. 본래의 매도청구는 조합설립에 동의하지 아니하거나 사업시행자 지정에 동의하지 아니한 자에게 매도할 것을 청구하는 것을 말한다. 재건축현금청산에 관한 매도청구는 대부분 조합설립에는 동의했으나 분양신청 또는 분양계약을 하지 아니한 자에게 현금으로 청산하는 것을 말한다. 이와 같이 본래의 매도청구와 재건축현금청산의 매도청구에 대해서 서로 요건이 다르다. 따라서 용어를 명확하게 구별할 수 있도록 규정해야 한다. 또한 현금청산 금액의 산정은 매도청구소송을 제기했을 때 법원의 감정평가에 의해 산정되므로 현금대상자에게 불이익이 있을 수 있다. 따라서 현금청산액을 산정할 때 현금청산대상자도 참여할 수 있는 기회를 열어줘야 할 것이다. 그리고 감정평가 시점에 대해서는 여러 견해가 대립되고 있으나 위의 법 제73조 단서 규정상 조합이 임의적으로 정한 협의기간이 종료된 다음 날을 감정평가시점으로 보아야 할 것이다. 그러나 현실적인 실무에서는 조합의 상황을 고려하여 각 사업장별로 평가시점을 정하는 경우도 있다. 따라서 위의 재건축현금청산에 관한 문제점을 해결하기 위해서는 현행법에 명문화해야 한다.

영어초록

Cash settlement for reconstruction refers to the fact that when a reconstruction project is in progress, a reconstruction cooperative member gives up his or her status as a cooperative member and receives the corresponding amount in cash compensation. Cash settlement for reconstruction was applied to the sale claim before the Urban and Residential Environment Improvement Act was comprehensively revised in 2017. After the revision, Article 73 of the Urban and Residential Environment Improvement Act clearly stipulates cash settlement for reconstruction. According to Article 73 of the same Act, the project implementer shall negotiate with the cash settlement target regarding compensation for loss of land, buildings, or other rights within 90 days from the day following the approval and announcement of the management disposal plan. However, the project implementer may begin negotiations from the day following the end of the subscription application period. If an agreement is not reached, the project implementer shall file a sale claim lawsuit within 60 days from the day following the end of the above 90 days. In addition, it is stipulated that if the business operator files a sale claim lawsuit after 60 days, he/she must pay interest according to the number of days of delay.
If we break down the above Article 73 provisions, first, in the case of reconstruction cash settlement, it is expressed as a sale claim lawsuit, so it is not distinguished from the original sale claim. Second, the provisions on calculating the amount of reconstruction cash settlement are not clearly stipulated. Third, there is controversy over the judgment of the time of appraisal because of the provision that negotiations can begin from the day after the end of the subscription application period. Fourth, there is a problem whether the provision on interest payment according to the number of days of delay is applied only when a sale claim lawsuit is filed after the above 60 days. This paper studies measures to solve these problems.
The original sale request refers to a request to sell to a person who did not agree to the establishment of the association or did not agree to the designation of the project operator. The sale request for reconstruction cash settlement mostly refers to cash settlement to a person who agreed to the establishment of the association but did not apply for a sale or make a sale contract. As such, the requirements for the original sale request and the sale request for reconstruction cash settlement are different. Therefore, the terms should be clearly stipulated so that they can be distinguished. In addition, since the calculation of the cash settlement amount is calculated by the court’s appraisal when the cash lawsuit, i.e. the sale claim lawsuit, is filed, it may be disadvantageous to the cash target. Therefore, when calculating the cash settlement amount, the cash settlement target should also be given the opportunity to participate. In addition, although there are conflicting views on the timing of the appraisal, the appraisal should be considered to be the day after the end of the consultation period arbitrarily set by the association according to the provisions of the proviso to Article 73 of the above Act. However, in practical practice, there are cases where the evaluation time is determined for each workplace by considering the situation of the union. Therefore, in order to solve the above problems related to cash settlement for reconstruction, it should be clearly stated in the current law.
