부패행위 신고자의 보호강화 방안 (Measures to strengthen the protection of persons who report corruption)

초록

우리나라는 각종 부패방지 정책의 도입과 개선의 노력에도 불구하고 부패 정도는 여전히 크게 개선되지 않은 것으로 평가된다. 누적된 부패 관행을 청산하기 위해서는 각종 반부패 정책의 실효성과 미비점을 종합적으로 꾸준히 검토하고 개선해 왔지만, 여전히 부패방지에 대한 공익실현을 위하여 가장 우선시 여기는 중요한 사항은 역시 부패행위에 대한 공익신고자 보호일 것이며, 신고자 보호제도의 한계점을 점검하는 일은 부패방지 제도적 개선의 전환점이 될 수 있다. 사회의 각 영역에 걸친 다양한 형태의 부패행위를 방지하고 예방하기 위해서는 공익신고가 핵심적인 역할을 수행할 수 있기 때문이다. 크고 작은 부패행위가 사회 이슈로 등장할 때마다 공익신고자 보호 문제를 지적해 왔던 사실은 신고자 보호를 위한 제도 방안으로 우리나라 반부패 수준에 있어서 지속적으로 개선될 여지가 있다. 예를 들어 부패행위 신고자의 보호를 강화하기 위한 노력에도 불구하고 여전히 공공기관의 장이 부패행위 신고 등과 관련하여 발견된 위법행위 등을 이유로 관계 법령 등에 따라 신고자에게 불리한 행정처분을 하는 경우가 있다. 또한 신고자의 비밀보장 미흡으로써 신고자의 인적사항과 관련한 비밀보장은 신고자 보호의 핵심 사항이지만, 여전히 신고자의 인적사항 유출을 방지하지 위한 방안이 미흡하다. 이와 같이 실정법상에 나타난 문제점을 인식하고 부패행위를 방지하기 위하여 신고자의 보호를 강화할 수 있는 방안을 고찰해야 한다.
사회 부조리를 개선하고 공익사회실현을 위하여 대표적으로 마련된 법률이 대표적으로 부패방지법과 공익신고자보호법이다. 부패행위 신고자의 불안정 심리적 지위와 개선해야 할 보호규범적 내용에 대하여 전개하였다. 부패행위 신고자를 보호하는 것이 최우선 과제임에는 부정할 수 없는 현실이며, 이에 대한 논의에 있어서 현실적 문제와 개선안을 제시하였다. 즉 부패행위 신고자의 확실한 보호와 그 강화를 위한 개선책을 제시하였다. 현실적이고 방법론적 강화와 추후 구제절차의 법제도적 방안으로 구분하여, 우선 현행 관련 법률에 있어서 과실에 의한 부패행위 신고자든 공익신고자의 인적사항 유출행위 또는 신고자를 알아내려고 하는 시도 등의 신분 색출행위에 대한 처벌규정의 신설을 언급했으며, 더욱이 행정소송 과정에서 신고자의 인적사항에 대한 보호 규정을 마련할 필요성도 제시하였다. 이를 통해 신분 노출에 대한 우려를 줄이고 부담 없이 부패행위 신고이든 공익신고에 임할 수 있는 법적 장치와 환경을 조성하는 것이 제도의 활성화를 위해 무엇보다 중요할 것이다. 그리고 부패행위 신고에 대한 법률적 지원이 필요하며 후속 민사 및 형사 절차에 대한 법률지원을 강화할 필요가 있다. 부패행위 신고를 활성화하기 위해서는 신고에 뒤따르는 기관 내부의 불이익방지와 각종 고소 등 법적 소송과 관련된 심리적이든 경제적 부담을 제거하도록 보장하는 것이 매우 중요하다. 부패행위 신고자 보호제도의 핵심은 공익실현을 위한 부패행위 신고와 부패행위 신고자의 보호에 있다. 부패행위 신고자가 공익을 위해 신고를 하고도 확실한 보호를 받지 못하거나 유무형의 인사상, 재정적 불이익 등을 받는다면 부패행위 신고이든 공익신고는 활성화될 것으로 기대하기 어려우며, 부패행위 신고의 활성화를 위해서는 공익 대상과 신고자 보호를 중심으로 현행 제도보다 꾸준히 개선된 조치가 필요함을 다루었다.

영어초록

Despite efforts to introduce and improve various anti-corruption policies in Korea, the degree of corruption is still not significantly improved. While the effectiveness and deficiencies of anti-corruption policies have been comprehensively reviewed and improved to address accumulated corruption practices, the top priority for anti-corruption practices will also be protection of whistleblowers. This is because public interest reporting can play a key role in preventing and preventing various forms of corruption across various areas of society. The fact that whenever large and small corruption acts emerged as a social issue, the problem of protecting whistleblowers has room for continuous improvement in the level of anti-corruption in Korea as a way to protect whistleblowers. For example, despite efforts to strengthen the protection of corruption reporters, the head of a public institution still makes administrative disposition unfavorable to the reporter in accordance with relevant laws, etc. for illegal activities found in connection with corruption reports. In addition, due to the lack of confidentiality of the reporter, confidentiality related to the reporter's personal information is a key point in protecting the reporter, but there are still insufficient measures to prevent the reporter's personal information from being leaked. As such, measures shall be considered to strengthen the protection of reporters in order to recognize the problems shown in the Act on Actual Affairs and prevent corrupt acts.
Laws representatively designed to improve social irregularities and realize a public interest society are the Anti-Corruption Act and the Protection of Public Interest Reporters Act. It developed the psychological status of the corruption reporter and the protection normative content to be improved. It is undeniable that protecting corruption reporters is a top priority, and practical issues and improvements were presented in the discussion. In other words, the government proposed measures to ensure the protection of those who report corruption and to strengthen them. It was divided into realistic and methodological strengthening and later legal measures. It first mentioned the establishment of a new regulation on punishment for identity-seeking activities, such as negligence or attempts to identify whistleblowers. Through this, it will be more important than anything else to revitalize the system to reduce concerns about exposure to status and create a legal device and environment that can freely report corruption or report public interest. It also needs legal support for reporting corruption and strengthening legal support for subsequent civil and criminal procedures. In order to activate the reporting of corruption activities, it is very important to ensure that the institution that follows the reporting prevents disadvantages and removes the psychological or economic burden related to legal lawsuits such as various complaints. The core of the protection system for corruption reporters is to report corruption to the public interest and to protect corruption reporters. If a corruption reporter does not receive clear protection for the public interest, intangible personnel management, financial disadvantages, etc., it is difficult to expect public interest reports to be activated.
