일본 노인수형자의 교정처우 (Study on the improvement of correctional treatment for elderly offenders)

초록

고령사회를 목전에 두고, 「Aging Korea」에 대한 준비가 지금까지의 어느 시기보다도 강조되는 현 시점에서 그 이미지가 변해가고 있는 노인범죄자와 범죄 및 범죄자 처우에 관한 형사정책의 분야, 그 중에서도 특히 교정처우에 있어서의 새로운 관계를 설정하는 작업은 당면한 시급한 과제가 아닐 수 없다. 교정처우에서 노인범죄자에 대한 새로운 관계를 설정함에 있어서 고려해야 할 것으로는 먼저, 노인수형자에의 양호적･복지적인 교정처우의 배려에 대한 국민일반의 이해를 어디까지 얻을 수 있을까라고 하는 점이다. 노인이라고 하더라도 형법상의 징역수형자이며 복지시설에 수용된 수용자와는 본질적으로 다르다. 이 점에 있어서 고령(복지)과 형벌(징역)과의 상호 대립하는 이념을 어떻게 조화시킬 것인가가 과제인 것이다. 이러한 점에서 우리나라 보다 앞서 고령화 사회를 경험하고 특히 형사정책분야에서 노인범죄에 주목하여 일찍부터 이에 대한 형사정책적 고려를 강구해온 일본의 경험은 우리에게 시사하는 바가 크다고 할 것이다.
본고에서는 우리나라 보다 앞서 고령화 사회에 진입하여 형사정책 분야에서의 고령화 문제를 경험한 일본의 노인범죄에 대한 형사정책적 동향, 특히 교정단계에서의 처우 대책을 중심으로 살펴보았다. 이러한 비교법적 검토는 급속한 고령화가 진행되고 있는 우리나라의 노인범죄에 대한 형사정책이 지향해 나가야 할 바와 그 대책이 필요한 부분에 관한 함의를 제공할 것이다. 이 점을 염두에 두고, 향후 우리나라 노인수형자의 교정처우에 있어서의 시사점으로서 다음의 사항을 제시하였다. 첫째, 노인수형자의 분류와 수용의 기준으로서 연령만을 이용하는 것이 아니라 수형자 개인의 특성을 배려한 처우를 행할 필요가 있다. 둘째, 행형시설 및 설비의 개선이 요구된다. 셋째, 의료서비스 및 시설의 개선이 요구된다. 넷째, 노인수형자를 위한 특별 프로그램의 준비가 요구된다.

영어초록

As Korea enters the aged society at a rapid pace, it faces huge social changes. In particular, crimes committed by the elderly have emerged as an urgent issue in the criminal policy field. In this situation, it is necessary that coming up with appropriate measure regarding correctional treatment of elderly offenders. However, before setting up new standards of treating them in terms of their welfare and protection, it is needed to consider to what extent the general public understand and accept preferential treatment of elderly offenders. Even though the offenders are old, the undeniable fact is that they committed crimes and have to serve their prison terms under the criminal law. Therefore, they, elderly criminal offenders, should be differently treated from those who are in welfare facilities. Regarding that, ideological conflict between welfare for senior citizens and punishment should be harmonized to appropriate dealing with the issues about the elderly offenders. In this regard, Japan’s experience has great implications to us as Japan entered into aging society earlier than Korea and has made efforts to establish criminal policy on elderly offender issues.
Japan became an aging society at a rapid pace, which greatly affects criminal policy. Especially aging of inmates in correction facilities comes into a question. It is notable that the number of elderly offenders increases and crime rate of elderly offenders, scaled by population size is on the rise. According to statistics of Detention Centers in Japan, as of December 31, 2010, the number of inmate aged 60 and over in detention centers accounts for 16% of total inmates. The figure implies that the number of elderly offenders has increased in correction facilities. This paper examines the current trend in criminal policy in Japan which witnesses issues relating crimes committed by the elderly. In particular, this paper mainly focuses on treatment of elderly offenders in rehabilitation process. This comparative study on treatment of elderly offenders shows a future direction of criminal policy regarding crimes by elderly offenders in Korea which is entering into an aged society at an unprecedented rate.
Given that, this paper suggests measures to improve treatment of elderly inmates. First, not only age but individual characteristic of inmate has to be considered in establishing standards of classification and detention of elderly inmates. Second, detention and rehabilitation facilities and equipment should be improved. Third, medical facilities with their equipment should be improved. The last, special programs for elderly inmates should be established.
