적극행정 제도에 대한 공법적 일고찰 (Public Law Review on Active Administration System)

초록

현행 「감사원법」과 「국가공무원법」 하위 법령에 근거하여 적극행정 면책 제도가 시행되고 있다. 이 제도는 행정의 변화를 궁극적인 목적으로 표방하고 있다. 그러나 공법의 관점에서 보면 적극행정 제도가 행정의 변화를 견인하기에는 한계가 있다. 첫째 이 제도는 행정 내부의 법적 관계에 적용되는 제도이다. 「감사원법」에 따른 감사책임과 「국가공무원법」에 따른 징계책임은 행정기관이나 공무원이 행정 내부에서 지는 책임에 불과하다. 적극행정 개념과 같은 방향으로 행정 자체의 변화가 이루어지려면 행정의 외부적 관계에 대한 법적 평가에서 적극행정이 인정될 여지가 있어야 한다. 이는 행정이 맺는 법적 관계에 적용할 법을 어떻게 선별할 것인지의 문제와 이 법을 어떻게 해석하여 적용할 것인지의 문제라고 할 수 있다. 전자는 행정법의 법원(法源)론의 문제로 포섭되고 후자는 행정법 해석론의 문제로 포섭된다.
현재의 적극행정 제도로 행정 자체의 변화를 기대하는 것은 행정 내부의 관계와 외부의 관계를 혼동한 것이라고 할 수 있다. 공무원이 개인의 책임 문제로부터 자유롭게 소신을 갖고 공익을 추구할 수 있도록 하려면 행정에게 귀속되는 책임과 공무원 개인에게 귀속되는 책임을 구분하는 법리를 발전시킬 필요가 있다. 이런 관점에서 현행 「국가배상법」은 공무원의 행위와 행정의 행위를 구분하지 않는 문제를 안고 있다. 이에 따라 공무원이 소신을 갖고 업무를 수행한 경우에, 감사책임 및 징계책임은 적극행정 면책 제도로 면제받더라도 배상책임을 질 수 있는 문제가 있다.

영어초록

The active administrative exemption system is in effect based on the current regulations under the 「Audit Service Act」 and 「National Public Officials Act」. This system represents the ultimate purpose of administrative change. However, from the point of view of public law, there is a limit to the active administration system to drive administrative change. First, this system is applied to legal relations within the administration. The responsibility for audit under the 「Auditors Act」 and the disciplinary responsibility under the 「National Public Officials Act」 are mere internal responsibilities of administrative agencies or public officials. In order for the administration to change in the direction of the concept of active administration, there must be room for positive administration to be recognized in the legal evaluation of the external relations of the administration. This can be said to be a question of how to select the law to be applied to the legal relationship established by the administration and how to interpret and apply this law. The former is taken up as a matter of the court theory of administrative law, and the latter is taken up as a question of administrative law interpretation.
It can be said that the expectation of changes in the administration itself with the current active administration system is a confusion between the internal and external relations of the administration. In order for public officials to be free from personal responsibility issues and to pursue the public interest, it is necessary to develop a law that separates the responsibilities that belong to the administration and those that belong to individual public officials. From this point of view, the current 「National Compensation Act」 faces the problem of not distinguishing between the actions of public officials and those of the administration. Accordingly, there is a problem in that when a public official performs a task with a conviction, even if the audit responsibility and disciplinary responsibility are exempted by the active administrative immunity system, they can be held liable for compensation.
