중국 일대일로 추진에 따른 PPP 관련 법제 연구 (Study on the PPP-related legislative systems for the promotion of ‘Belt and Road Initiative’ in China)

초록

최근 베이징에서 개최된 '일대일로 국제협력 정상포럼'에서 중국은 일대일로 참가국에게 향후 5년간 약 168조원의 투자를 할 것이라는 계획을 밝혔으며, 그 핵심 투자대상으로 인프라 건설 분야를 지목했다. 중국은 최근 몇 년 동안 일대일로 정책과 함께 국내 도시화 계획 추진으로 국내외 인프라 건설사업의 꾸준한 증가세를 이어오고 있다. 이 같은 인프라 건설 사업에 있어서 중국정부는 PPP 방식을 통한 참여를 적극 촉구하고 있고, 현재는 전 세계 PPP사업 총액규모 기준 수주 1위 국가로 도약했다.
그러나 중국 PPP사업의 실제 상황을 살펴보면 많은 문제점들이 있다. 지방정부의 계약경시, 정보공개 취약, 수익보장제도 미흡 등이다. 이로 인해 상대적으로 국영기업의 참여도가 높고, 반면 순수 민간자본은 공정경쟁과 이익보장에 대한 불확실성으로 인해 참여에 소극적 자세를 취하고 있다. 이에 대한 가장 근본적인 문제로 PPP 관련 통일된 국가 차원의 법률 부재와 핵심적 이익 보장에 대한 법적 강제력의 미흡이 지적되고 있다. 이를 해결하기 위해 중앙 차원에서의 적극적인 입법 활동과 관련 정책 발표가 다수 있었지만 부처 간의 경쟁적 입법과 해석의 차이 등은 혼란만 가중시키고 있어 통일된 입법에 대한 요구가 지속적으로 제기되고 있다.
향후 우리 기업의 중국 PPP시장 진출에 대한 기대가 높아진 상황에서 PPP 방식의 이론적 연구는 다수 있지만 중국 특색의 PPP제도 이해에 대한 연구는 충분하지 못한 실정이다. 이에 본 연구는 중국 PPP 관련 가장 상위 법령인 <기반시설과 공공사업 특별허가 경영관리 판법>과 PPP법제의 통일화를 위해 최근 입법예고 절차를 마친 <정부와 사회자본 합작법> 입법안의 비교분석을 통해 규제간, 그리고 주무부처간의 이해충돌과 해석차이로 인한 주요 문제점을 살펴보고 중국 현 PPP제도의 현황을 이해하고자 한다.

The Chinese government clarified its plan to invest approximately 168 trillion won for the next five years into countries that participate in the ‘Belt and Road Initiative’ in the Belt and Road Forum for International Cooperation recently held in Beijing and pointed out the infrastructure construction field for the key investment target. China has carried out the domestic urbanization plan with the ‘Belt and Road Initiative’ and continued an increment in the domestic and foreign infrastructure construction business in recent years. When it comes to the business, the Chinese government positively urges itself to participate in it through the PPP method. Recently, China has ranked first on obtaining order based on a scale of the sum total of the PPP business all over the world.
However, there are many problems in the actual status of the business in China. For example, the local government’s negligence on a contract, the weakness of release of the information, a lack of revenue assurance systems, and others are problematic. Accordingly, relatively, state-run firms highly participate in it, whereas the private capitals feel defensive about the participation due to the uncertainty of a fair competition and profit assurance. It is pointed out that the most fundamental problems for this are the absence of laws at unified state levels regarding the PPP method and a lack of the legal force for the key profit assurance. To solve them, China has positively led legislative activities and announced the relevant policies as the central government level, but it actually intensifies the confusion due to the competitive legislation and discrepancy in interpretations between government departments. Hence, a lot of requirements for the unification legislations are consistently raised.
There are a lot of expectations about the entry of Korean companies in the Chinese PPP market in the future, and many theory studies have been carried out by the PPP method. However, there is not enough research on the understanding of the Chinese PPP systems. For this, the research compares and analyzes consultation paper about <Law of Cooperation for Government and Social Capital> that has recently completed the acceptance of opinions in order to unify the PPP systems and <Measures for the Administration of Concession for Infrastructure and Public Utilities> that are the most upper law related the Chinese PPP systems, examines major problems attributable to a conflict of interests and discrepancy in interpretations between competent authorities, and understands the current status of the Chinese PPP systems.
