보조참가인의 참가이익의 기준에 관한 연구 (Research on the Standard in participating profits of the supplementary Intervenor)

초록

보조참가란 소송의 계속중에 그 소송의 결과에 관하여 이해관계를 갖는 제3자가 당사자의 한쪽을 보조하여 승소시킴에 따라 자기의 이익을 지킬 목적으로, 그 소송에 참가하는 것이다.
이와 같이 보조참가제도는 자기의 이익과 밀접한 관계가 있는 타인간의 소송에서 자기에게 불리한 판결이 나오면 장차 자기와 상대방 사이의 소송에 영향을 미치기 때문에 이를 상대방 사이의 제2의 분쟁을 미리 일거에 해결할 수 있는 분쟁의 해결목적도 기대할 수 있는 제도적 의의가 있는 것이다.
그러나 실제의 소송절차에 있어서는 참가허가 여부의 판단은 반드시 이와 같이 정태적이지 않고 오히려 탄력적·동태적이이라 할 수 있다. 즉, 이상과 같은 이익의 상황이 존재할 뿐만 아니라 분쟁의 성격, 사건의 진행정도 등이 복합적으로 판단된다는 것이다.
필자는 소송의 주요한 쟁점에 대한 판단을 전제로 하여 참가인의 권리관계의 법적 지위를 결정할 수 있는 관계는 물론, 피참가인이 받는 판결의 판단에 의해 참가인의 법적 지위가 사실상 불리한 영향을 받을 우려가 있는 관계를 보조참가의 이익이 인정되는 기준으로 하는 것이 타당하다고 생각한다. 따라서 보조 참가신청이 허용되는 이익의 기준을 어떻게 설정할 것인가 하는 문제를 해결하고자 기존의 논의를 검토하고 새로운 제안과 정리를 하였다.
구체적으로는 참가신청의 시기, 이의를 제기한 것이 상대방인가 피참가인인가, 참가신청인의 수는 몇 명 인가, 보조참가가 되는 경우에 피참가인측의 소송자료· 증거자료에 충실한지 여부, 반대로 보조참가에 의해 소송이 복잡하게 되어 있지 않은가, 보조 참가인이 병행 하여 자기 자신의 별소를 수행하고 있는 경우에 그 소송에서 독자적으로 법원의 판단을 받을 수 있을지 등이 심사되는 것일 것이다. 따라서 “소송의 결과”와 “이해관계”는 일체적으로 판단되어야 하는 하나의 구성요소이지 각각 별개의 요소로 할 수 없는 것이라 이해하고자 한다.

영어초록

The supplementary Intervention is the purpose of protecting one's profits as the third party who has an interest about the result of the lawsuit during continuation of a lawsuit assists one of the two of the party concerned and makes him win the case, and it says participating in the lawsuit.
Since an supplementary intervention system will affect the lawsuit between itself and the other party in the future if there is a close relation to its profits and also the disadvantageous judgment for itself is passed by lawsuit of man, there is the purpose to this will be prevented beforehand and guarantee supplementary intervenor's profits.
An author studies the standard allowed supplementary intervention in this paper,and presents a new proposal and solution.
And I think that it is not necessary to limit the legal interest to interdependence.
Therefore, the relation which can determine an intervenor's right-related legal standing on the assumption that the judgment over the main points at issue of a lawsuit, of course, By judgment of the judgment an intervenor is sentenced, it is appropriate to consider it as the standard the profits of supplementary intervention are accepted to be, and it will carry out a relation with a possibility that it may be subject to influence with an intervenor's legal standing disadvantageous as a matter of fact.
However, judgment of the existence of permission of participation by actual legal proceedings is not stasis-like certainly, and can be referred to as rather flexible and fluid.
That is, the situation of the above profits not only exists, but the character of dispute, the grade of incident advance, etc. are judged complexly.
After all, the author can affirm the profits of participation, when the point at issue judged in a rationale for a verdict also has influence to supplementary intervention people's profits strongly, If premised on this, "the result of a lawsuit" and an "interest" will be one component which must be entirely judged by the target, and will think that they will understand that it is being unable to do with a respectively separate element.
