죽음, 안락사, 생애마무리에 관한 헌법적 논의 ― ‘생애마무리 지원 법안’에 관한 내용을 중심으로 ― (Constitutional Debate on Death, Euthanasia, and Life Finish ― Focusing on the ‘Life Finishing Support Bill’ ―)

초록

존엄한 죽음을 선택할 권리를 헌법재판소가 인정하였고 연명의료 중단과 같은 존엄한 죽음의 과정을 본인이 아닌 제 3자가 결정할 수 있는 여지도 현행법상 열려있다. 그러나 생명권을 인간의 존엄성에서 도출되는 기본권으로 이해한다면 이러한 최협의의 안락사조차도 허용되어서는 아니된다. 생명권의 본질은 생명 그 자체이기 때문이다. 따라서 신체의 자유에서 파생된 권리로 이해하는 입장을 취할 때 안락사는 헌법적으로 허용 가능하기 때문에 생명권의 헌법적 근거를 신체의 자유에 찾고자 한다. 생명권을 인간의 존엄의 영역으로 해석하는 입장에서조차 존엄사는 인정하는 점을 고려하였을 때, 본질적으로 안락사의 허용이 필요하다는 점에 대한 인식은 큰 차이가 없다. 다만, 안락사는 확대되어 허용될 수 있으나, 그 방식이 무제한적인 허용을 의미하는 것이어서는 안 된다고 본다. 그러한 관점에서 볼 때, 평등권을 이유로 죽을 권리가 인정되는 것은 논리적으로는 가능하지만 생명권 등 다른 기본권과의 관계에서 어느 정도 조화로운 해석이 요구된다고 보는 것이 타당하다.
현행 연명치료중단 법률에서 인간다운 죽음 또는 인간답게 죽을 권리에 대한 인식을 법률로 승화시켰다는 점은 높은 평가를 받을 만하나 약물 등을 처방받아 스스로 목숨을 끊은 존엄사 외의 안락사에 대해서는 허용하지 않고 있기 때문에 매우 엄격하고 제한적 안락사만을 인정하고 있다. 동 법률이 보다 헌법적으로 정당화되기 위해서는 동의 요건 강화 등 당사자의 의사표시를 확인할 수 있는 방법은 더욱 명확성을 갖추어야 하고, 명시적이고 확고한 의사표시에 대한 자기결정권은 보다 강화되어 보다 넓은 의미의 안락사가 허용되는 것이 적절하다고 판단된다.
한편, 죽음을 넘어 죽음을 준비하는 과정에 관한 자기결정권 확대를 위하여 생애마무리 지원 법안이 마련되었고, 동 법안은 생애마무리에 관하여서 국가의 책임을 인정하고 법･제도적 지원 수단을 마련하는 것을 목적으로 하는 동 법안은 국가 및 지방자치단체에 대한 지원책 마련과 유산 기부 등을 활성화할 수 있는 기반을 조성할 것을 요구하고 있다.
특히 동 법안에서 의미 있는 지점은 국가와 지방자치단체에게 모든 국민에 대한 생애마무리와 그 준비를 위한 교육 기회가 동등하게 제공될 수 있도록 노력할 것을 요구하고 있는 규정이다. 모든 세대가 개별 세대의 특성에 적합한 생애마무리 교육을 받을 수 있도록 필요한 시책을 강구하도록 하여, 죽음에 대한 적절한 대비를 생활 교육의 일환으로 받아들일 수 있게 하였다는 점에서 매우 진일보한 법률안으로 평가하고 싶다.
죽음은 앞서의 안락사에 대한 헌법적 근거를 도출하는 과정에서 확인한 바와 같이 궁극적으로 자기결정권의 문제인 동시에 인간의 존엄과 관련된 영역이다. 좋은 죽음의 구성에 있어 가장 중요한 과제는 죽음 자체를 결정할 수 있는 권리에 관한 내용이지만 이에 더하여 죽음으로 이르는 매 순간 순간을 결정할 수 있는 권리를 부여하자는 것이 생애마무리 지원 법안의 핵심이라고 볼 수 있다.

영어초록

The Constitutional Court has granted the right to choose dignity of death, and there is room under current law that allows third parties, not themselves, to determine the course of dignity, such as the suspension of lifelong medical care. But even the closest euthanasia should not be allowed if the right to life is understood as a fundamental right derived from human dignity. For the very essence of the right to life is life itself. Therefore, when euthanasia takes a position to understand as a right derived from freedom of the body, euthanasia is constitutionally acceptable, and therefore, it seeks to find the constitutional basis of the right to life to freedom of the body. Even from the standpoint of interpreting the right to life as the realm of human dignity, there is no big difference in the perception that dignity is essential in view of the recognition of dignity. However, euthanasia may be extended and allowed, but the method should not be meant as an unlimited allowance. From that point of view, it is logical to say that the right to die on the ground of equality is logically possible but requires some harmonious interpretation in relation to other fundamental rights, such as the right to life.
The fact that current life-sustaining treatment cessation law sublimates the perception of human death or the right to die humanely to the law deserves high praise, but it does not allow euthanasia other than dignity death, which was prescribed by drugs and killed itself. Only very strict and limited euthanasia is recognized. In order for the law to be more constitutionally justified, the method of confirming the parties' opinions, such as the strengthening of consent requirements, should be more clear, and the right to self-determination of explicit and firm expressions is strengthened, allowing for greater euthanasia. I think it is appropriate.
On the other hand, the life-finding support legislation was established to expand self-determination over the process of preparing for death beyond death, and this bill aimed at acknowledging the responsibility of the state and providing legal and institutional support for life-finishing. The bill calls for the establishment of a foundation to support national and local governments, and to promote heritage donations.
In particular, a significant point in the bill is a regulation requiring national and local governments to endeavor to provide equal access to education for the preparation of life and for all citizens. I would like to evaluate it as a step forward from the idea that every generation should take the necessary measures to get a lifelong education that is appropriate to the characteristics of each individual generation, so that appropriate preparations for death can be taken as part of life education.
Death is, ultimately, a matter of self-determination and an area related to human dignity, as confirmed in the derivation of the constitutional basis for euthanasia. The most important task in the composition of good death is about the right to determine death itself, but in addition, to give the right to decide every moment leading to death can be seen as the core of the life support legislation.
