누범가중처벌은 책임원칙에 반하는지 여부 (Whether an Aggravated Cumulative Offense Contrary to the Principles of Responsibility)

초록

현행법은 일반형법과 다양한 특별형법에 누범을 가중 처벌하는 규정을 두고 있다.
누범가중은 형법 제35조의 일반규정이 적용되므로 모든 범죄를 대상으로 하고 있으며, 경우에 따라서는 상습범가중의 대상이 되는 범죄와 공통되는 경우도 있다.
따라서 상습범이 1개의 범죄를 범한 경우에 상습범가중과 누범가중을 받는 경우도 발생한다.
누범에 대한 현행법의 이중·삼중의 대책은 헌법이 요구하는 비례성의 원칙, 특히 과잉처벌 금지의 원칙에 위배되어 위헌이라는 지적이 유력하며, 실용적인 면에서도 범죄예방, 특히 행위자의 특별예방의 효과가 있는가에 대하여 회의적이다.
그렇다면 누범가중이 책임원칙에 합당한가?만약 합당치 못하다면 그 이유는 무엇인가? 그래서 가중규정이 폐지된다면 그에 대한 대안은 무엇인가? 의 산적한 의문을 갖고 이에 대한 해답을 찾기 위한 노력을 차례로 논증해 보려고 한다.
이를 위해 일반형법과 특별형법에 산재해 있는 누범의 가중처벌규정을 개관하고(Ⅱ),누범가중처벌의 근거에 대한 기존의 논의를 검토하고 이에 반대 입장에 서서 책임원칙에 반하는지 여부를 논증하고(Ⅲ),마지막으로 누범가중처벌의 폐지대안으로서 보호감호도입문제와 연계하여 검토하려고 한다(Ⅳ).
늘 반복되면서도 언제나 잊지 말아야 할 것은 형법이 사회통제 전체체계에서 최후수단의 위치에 있다는 사실이다.
결국 누범규정은 책임원칙에 반하고, 위헌이므로 폐지함이 좋다고 하겠다.

영어초록

Current criminal act states that a cumulative offense shall be additionally punished according to the general criminal rule and variety of special criminal rule. Aggravated cumulative offenses may become an all kinds of crimes because it is applied the general provision of the Article 35 of the Criminal Act. In some cases, this crime has something in common with aggravated habitual crime. Therefore, in the case of recidivist commit a crime she may be punished both aggravated cumulative offense and aggravated habitual crime.


There is a strong contrasting view that multiple counter-measure of current criminal act on the aggravated cumulative offense is unconstitutional because it violated the principle of proportionality, particularly, the prohibition of excessive punishment. In a practical point of view, skeptical idea about the prevention of crime, especially whether there is a special precaution for the wrongdoer is raised.


If so, is aggravated cumulative offense suitable for the principle of proportionality? If this is not fit for the principle, what is the main reason? Therefore, if additionally punished provision must be repealed, what is the suggested statute as an alternative? In this article, because the question hasn't been answered yet, I challenge to solve those issues with kid-glove doubt. For this purpose, in part II, I take a general view on the aggravated cumulative offenses over scattered general criminal rules and special criminal acts. In part III, I examine prior arguments of the academic society on the punishment grounds of the aggravated cumulative offenses. Here, I will stand on the opposite side of the traditional angle. Finally, in part IV, I review the introduction of the security measure as an alternative of the repeal the punishment of the aggravated cumulative offense.


Repeatedly emphasize and so shall be noted that is the criminal rule must be the last resort in the social system to control society through punishment. By the reason of this fundamental idea, the security measure which related to the crime protection should be restricted at a minimum level that is required. This is the principle of proportionality in the true sense of the word and it can be fully carried out the rule of law principles.
