저작권법상 보상금 관리단체의 분배율 개선방안 (Measures to improve the distribution ratio of remuneration management organization under the Copyright Act)

초록

저작권법은 저작자와 저작인접권자가 적정한 대가를 받을 수 있도록 재산권을 부여하고 있다. 재산권으로 저작물 이용에 대해 권리자의 허락을 받아야 하는 배타적 권리와 권리자의 허락 없이 저작물을 이용하고 사후적으로 권리자에게 보상금을 지급하는 보상청구권이 있다. 저작물 이용에 대해 저작권자에게 주어지는 경제적 보상은 배타적 권리의 경우 이용자는 저작물 이용에 대해 저작권자의 허락을 받아야 하므로 이용허락을 받는 과정에서 경제적인 보상 조건도 결정되게 된다. 그러나 보상청구권의 경우 저작권자의 허락 없이 저작물을 이용하고 사후적으로 보상하는 형식을 취하는 구조이므로 저작권자에게 얼마의 보상을 할 것인가와 저작권자에게 어떻게 분배할 것인가에 대한 문제가 대두된다. 우리 저작권법은 이러한 문제를 해결하기 위해 저작권자의 보상청구권은 보상금 관리단체를 지정하여 그 단체를 통하여 행사하도록 하고 있다.
보상금 관리단체의 핵심 기능은 저작권자를 대신하여 보상금을 징수하여 저작권자에게 분배하는 것이다. 그런데 보상금 관리단체가 징수하여 저작권자에게 분배하는 보상금의 분배율이 70% 이하 수준으로 분배율 개선이 절실하다.
이러한 문제점을 개선하기 위해서는 보상금 징수 시 산정 기준을 저작물 사용량을 기준으로 하는 종량징수 방식으로 개선하고, 고아저작물이 발생하지 않도록 저작권 등록제도를 활성화하는 한편 상업용음반의 경우「음악산업진행에관한법률시행령」을 보완하여 저작자 및 실연자도 의무적으로 표시하도록 하여야 한다. 그리고 저작물을 교과용 도서에 게재할 경우 저작자에게 통지하도록 하고, 보상을 받을 의사가 없는 학위논문을 포함한 비매용 자료에 대한 보상금을 면제할 필요가 있으며, 미분배 보상금의 일부를 보상금을 받을 권리가 있는 것으로 추정되는 권리자에게 일괄분배하는 것으로 개선하는 것도 고려할 필요가 있다.

영어초록

The Copyright Act grants property rights so that the author and neighboring right holder can get paid appropriately. As property rights, there are exclusive rights that require permission from the copyright holder to use his copyrighted work; whereas there are right to claim remuneration that the users use the copyrighted work of a copyright holder in advance and pay the remunerations afterwards. Economic remuneration given to the author for the use of the copyrighted work requires the user to obtain permission from the copyright holder for the use of the copyrighted work in the case of exclusive rights, so economic remuneration conditions are also determined in the process of obtaining permission. However, in the case of the right to claim for remuneration, the question arises of how much remuneration to the copyright holder and how to distribute it to the copyright holder because it takes the form of using the work in advance without the permission of the copyright holder. To solve this problem, the Copyright Act requires the copyright holder to claim remuneration to designate a remuneration management organization and exercise it through the organization.
The core function of the remuneration management organization is to collect the remuneration on behalf of the copyright holder and distribute it to him/her. However, the distribution rate of remuneration collected by the remuneration management organization and distributed to the copyright holders is lower than 70%, which requires urgent improvement.
In order to improve this problem, the criteria for calculating of collecting the remuneration should be improved by pay as you go system based on the amount of the copyrighted works used, and the copyright registration system needs to be activated to prevent the orphaned copyrighted works. Additionally, the “Enforcement Decree of the Music Industry Progress Act” is supplemented so that authors and performers can also be mandatory to be displayed in case of commercial phonogram. Moreover, the authors should be notified when his/her copyrighted work is published in a subject book and it is necessary to waive remuneration for non-purchase materials, including degree papers that are not willing to receive the remuneration. Furthemore, it is also necessary to consider improving some of the undistributed remuneration by collectively distributing it to copyright holders who are believed to have the right to receive the remuneration.
