초록

2018년 3월 26일 대통령은 ‘대한민국헌법 개정안’을 제안하였다. 기본권과 지방자치를 강화하고, 행정입법사법등 권력구조에 있어 민주성, 공정성을 강화하며 독립성을 확보하는 방향이 금번 헌법개정안의 주요골자라 할 수 있겠다. 특히 감사원제도는 금번 헌법 개정안에서는 변화의 폭이 매우 큰 제도 중 하나라 할 것이다. 금번 헌법개정안에서는 감사원의 독립기관화를 명시하고, 감사원의 직무상 독립성을 강화하기 위해 현행 헌법 제4장제2절 행정부의 제4관에서 규정하던 감사원 규정을 제7장으로 편제를 달리하여 독립기관으로 규정하였다. 또한 감사원을 원장을 포함한 9명의 감사위원으로 구성하며, 감사위원은 대통령이 임명하도록 하되, 그 중 3명은 국회에서 선출하고, 3명은 대법관회의에서 선출하도록 함으로써 감사원 구성에서 국가권력 간의 균형을 도모하였다. 더불어 감사원장은 감사위원 중에서 국회의 동의를 받아 대통령이 임명하도록 함으로써 독립기관의 장으로서 민주적 정당성을 제고하는 한편, 대통령의 인사권을 합리적으로 조정하였다. 금번 헌법 개정안에서 특별히 주목한 부분은 감사원장의 선출과 감사위원의 선출방식의 변화라 할 것이다. 이는 결국 감사원의 직무상 독립성을 확보 하는데 있어서 가장 중요한 핵심요소이기 때문이다. 비록 금번 헌법 개정안의 법적 효력이 상실된 상황이지만 금번 헌법개정안에서 감사원의 독립성을 확보하기 위하여 감사원장 및 감사위원의 선출방식에 대한 변화가 어떠한 논의와 토론을 거쳐서 이뤄졌는지 파악하는 것은 향후 헌법개정에 있어 매우 중요한 가늠자가 된다. 이 논문에서는 감사원장 및 감사위원의 선출방식에 대한 국회 헌법개정특별위원회의 논의와 토론의 과정에 대하여 비판적으로 검토하였다. 또한 헌법상 독립기구로서 제5의 권력분립기관으로 재정통제권능을 갖는 감사원의 위상에 부합하는 감사원 구성에 관한 제도구현과 설계의 방식과 방향을 모색하였다.

영어초록

On March 26, 2018, the President proposed an amendment to the Constitution of the Republic of Korea. Strengthening basic rights and local autonomy, strengthening democracy and fairness in the power structure, such as administrative legislative justice, and securing independence are the main goals of the amendment bill. In particular, the BAI system will be one of the very big changes in the Constitution. In order to strengthen the independence of the Board of Audit and Inspection under the Constitution, Article 4, Chapter 2, Section 2 of the Constitution, and Article 7 of the Audit Office, . In addition, the Board of Audit and Inspection was composed of nine members including the director. The members of the auditing committee were appointed by the president, three of them were elected by the National Assembly, and three were elected by the Supreme Court. . In addition, the Auditor General, with the consent of the National Assembly, approved the appointment of the President of the Audit Committee, thereby enhancing the democratic legitimacy of the chairman of the independent body, and rationally adjusting the president's personnel rights. Particularly noteworthy in the amendment of the Constitution is the change in the selection of the President of the Audit Committee and the Audit Commissioner. This is because it is the most important key factor in securing the independent independence of the BAI. In order to secure independence of the Board of Audit and Inspection in the amendment of the Constitution, it is necessary to understand how the changes in the election method of the President of the Audit Committee and the Audit Commissioner were conducted through discussions and discussions, It becomes a very important clue. This paper critically examined the process of discussion and debate by the Special Committee on the Constitutional Amendment of the Constitution on the election of tthe President of the Audit Committee and the Audit Commissioner. In addition, as the independent body of the Constitution, the fifth power separation institution was searched for the method and direction of the system implementation and design of the BAI in accordance with the status of the auditor with financial control authority.
