2018. 9. 19. 남북 정상회담을 위해 방북한 문재인 대통령이 평양 한복판에 있는 능라도 5·1 경기장에서 평양시민 15만 명을 앞에 두고 연설을 한 장면은 분단 이후 단 한 번도 볼 수 없었던 고무적인 광경이었다. 연설의 내용처럼 우리 민족은 5,000년을 함께 살고, 70년을 헤어져 살았다. 남북이 한 민족으로 함께 한 5,000년은 분단 70년을 너끈히 극복해 낼 만큼 장구한 힘을 가졌음을 부인할 수 없지만, 불과 2년이 지난 현재의 남북 상황을 보면 분단은 과거의 시간만으로는 극복할 수 없는 현실의 문제임을 상기하게 된다.
남과 북이 헤어져 산 70년 동안, 남북의 법과 제도는 서로 다른 발전 과정을 거쳐 왔고, 법치주의의 인식과 수준에도 상당한 차이를 가지고 있다. 그중에서도 형사 법제의 차이는 신변안전 보장과 관련하여 교류협력 과정에서도 상당한 불안요소로 작용해왔다. 개성공단 사업은 남북이 현재까지 만들어낸 가장 높은 수준의 교류협력 모델이지만, 민사적 분쟁 해결을 위한 남북상사중재위원회의 구성은 중단 상태에 있고, 형사 사건 처리와 관련해서는 금강산 관광객 피살 사건에서 한 걸음도 앞으로 나가지 못하고 있다.
남북의 관계가 원점 회귀를 반복하지 않고 실질적인 발전을 해나가기 위해서는 정치적인 타협과 임기응변이 아닌 법과 제도의 마련으로 돌이킬 수 없는 교류협력의 밑그림을 그려나가야 한다. 현재는 개성공단 사업이 전면 중단되어 있지만, 남북관계의 개선에 따라 언제든지 재개될 가능성이 열려 있다. 재개의 시점까지 우리는 왕성한 가동 시기에 돌아보지 못했던 법과 제도를 정비할 기회를 얻었다. 그중에서 최저임금법, 도로교통법, 산업재해법 등 개성공단에서의 남한 행정형법 적용 문제는 시급하게 해결책을 세워야 할 부분이다. 이 글에서는 동·서독 형사법 충돌 해결 이론과 종래 실무 차원에서 수집된 국내의 다양한 견해들을 지금 시점에서 면밀하게 검토해 보고, 실제 발생했던 행정법 위반 사례에 대한 각 견해의 결론상의 차이점을 살펴보았다. 이를 바탕으로 개성공단에서의 남한 행정형법 적용에 대한 합리적인 적용 기준을 검토하여, 향후 개성공단 재개 시 보다 안정적으로 사업이 진행되도록 법제 분야에서 미리 준비하는 다양한 노력들에 실마리를 제공하는 것에 목적을 두었다.

영어초록

On 19 September 2018, the scene where President Moon Jae-in, who visited North Korea for the Inter-Korean summit, gave a speech in front of 150,000 Pyongyang citizens at the Rungrado May Day stadium in Pyongyang, was an inspiring sight that had never been seen since the division. As he said, our people lived together for 5,000 years and apart for 70 years. The 5,000 years has enough power to overcome the 70 years of division, but the current situation in the Korean peninsula, just two years after the summit, reminds us that division is a matter of reality that cannot be simply overcome by the past.
During the past 70 years of division, the laws and systems of the two Koreas have established through different development processes, and there are also considerable differences in the perception and level of the rule of law. Especially, the differences of criminal laws have been a significant source of anxiety in the process of exchange and cooperation, with regard to the guarantee of personal safety. The Kaesong Industrial Complex project is the highest level of exchange and cooperation model that the two Koreas have created so far, but the organization of an inter-Korean Commercial Arbitration Committee to resolve civil disputes has been suspended, and the issue of criminal cases has not taken a step forward after the murder of a South Korean tourist at Mt. Geumgang.
In order for inter-Korean relations to make substantial progress without going back to square one, it is necessary to lay the foundation for exchange and cooperation through laws and systems rather than by political compromise and expedient. Although the Kaesong Industrial Complex project is currently suspended, it may resume at any time in accordance with the improvement of inter-Korean relations. Until it resumes, we are given a chance to review laws and systems that were not examined when it was in full operation. Above all, it is urgent to solve the issue of the application of South Korean Administrative criminal law in the Kaesong Industrial Complex, such as Minimum Wage Act, Road Traffic Act, Industrial Accident Compensation Insurance Act, etc.
This article looks into the theories on the resolution of conflict between criminal laws of East and West Germany and domestic variety of views at the working level, and then examines the difference of the conclusions about real cases involving violations of administrative law from each point of view. Based on this, the paper aims to review the reasonable application criteria of the South Korean administrative criminal law in the Kaesong Industrial Complex and provide the basis for various efforts in the field of legislation to ensure that the project is carried out more reliably in the future when the Kaesong Industrial Complex resumes.
