권리범위확인심판에서는 법원이 진보성 판단을 할 수 없는가? (Can a Court Test the Inventive Step in a Trial to Confirm the Scope of a Patent?)

초록

대법원은 2010다95390 전원합의체판결을 통하여 무효심결 확정 전이라고 하더라도특허발명의 진보성이 부정되어 특허가 무효로 될 것임이 명백한 경우에는 침해금지등의 청구는 특별한 사정이 없는 한 권리남용에 해당하여 허용되지 아니한다고 하면서, 침해소송법원도 특허권자의 청구가 권리남용에 해당한다는 항변이 있는 경우 특허발명의 진보성 여부에 대하여 심리ㆍ판단할 수 있다고 판시하였다. 그리고 나아가서 이 전원합의체판결은 진보성 판단을 부인했던 91마540 결정 및 98다7209 판결을변경하였다.
그런데 2010다95390 전원합의체판결이 변경하지 아니하였다고 하여, 신규성 판단은 할 수 있으나 진보성 판단은 이를 할 수 없다고 판시했던 97후2095 판결의 판시를그대로 적용하여 권리범위확인심판에서 진보성 판단을 하지 않게 되면 권리범위를인정하여 심판청구를 인용하는 심결을 내리게 될 것이다. 그러나 침해소송법원은 진보성 판단을 할 수 있게 되었으므로 진보성 판단을 통하여 권리범위를 부인하여 침해를 인정하지 않을 것이다. 결국 권리범위확인심판에서 특허발명에 진보성이 없는 것이 명백함에도 불구하고 진보성 판단을 하지 않고 권리범위를 인정한 채 내리는 심결은 무의미한 것이 된다. 따라서 권리범위확인심판에서 진보성이 결여된 것이 명백하여 권리에 속하지 않는다는 주장이 있는 경우 그 주장의 당부를 판단하기 위한 전제로서 법원은 특허발명의 진보성을 판단할 수 있다고 하여야 할 것이다.

영어초록

The Korean Supreme Court in a unanimous en banc decision (hereinafter, En Banc Decision) (Supreme Court en banc Decision 2010Da95390 Decided January 19, 2012) held that Korean civil courts could dismiss a patent injunction or damages claim for a patent abuse even before a patent is formally invalidated by the Intellectual Property Tribunal of the Korean Intellectual Property Office (KIPO) when it was obvious that the patent would be invalidated in ‘Invalidation Trial of Patent’, and that civil courts could decide whether the patented invention had an inventive step when there was an argument that the patent injunction or damages claim based on the patent without an inventive step was a patent abuse. Furthermore, the En Banc Decision overruled Supreme Court Order 91Ma540decided June 2, 1992 and Supreme Court 98Da7209 decided March 23, 2001, which held that in the patent infringement litigation where an inventive step did not exist, although novelty existed, the court should not reject the scope of the right unless the patent invalidation decision was finalized in the separate proceedings.
On the other hand, the En Banc Decision did not overrule Supreme Court 97hu2095decided October 27, 1998 in which the Korean Supreme Court ruled that the Tribunal of the KIPO in “a Trial to Confirm the Scope of a Patent” could not decide whether the patented invention had an inventive step, and that the Tribunal should not reject the scope of the right. If the Tribunal does not examine the inventive step of a patented invention even if the invention has no inventive step, the Tribunal will accept the argument of the plaintiff of the trial. However, the court in infringement litigation will examine the inventive step requirement and deny the scope of the patent. This makes the decision by the Tribunal in “a Trial to Confirm the Scope of a Patent” meaningless. Therefore, it is necessary that the Tribunal or the courts in “a Trial to Confirm the Scope of a Patent”decide whether a patented invention has an inventive step when the defendant argues that the patented invention has no inventive step and thus the patent is invalid.
