민법 내 소비자계약법 일반제도의 신설 (Incorporation of the General Institutions of the Consumer Contract Act into the Civil Law)

초록

소비자계약법의 민법 편입에 관한 이론적 논의는 우리나라에서 10년 전에 이미 상당히 많이 이루어졌다. 민법 개정작업에서도 제1분과의 의뢰하에 법무부에서 연구용역을 발주하여 연구가 이루어졌지만, 아쉽게도 이를 바탕으로 한 논의와 최종적인 개정안의 제출은 이루어지지 못하였다. 2022년에 들어와서 논의의 변화가 보인다. 민사법학회에는 자체적으로 민법개정위원회 제1분과에서 소비자법의 민법편입 방안을 집중적으로 다루었다. 이와 동시에 소비자법학회에서는 법무부로부터 연구용역을 발주받아 소비자계약법의 제정안을 연구하였다.
소비자계약법이 민법으로 편입함에 있어서 법정책적・법이론적 타당성에 관한 논의는 당연히 선행되어야 할 것이다. 그러나 비교법적으로 보면 이미 독일, 프랑스 등 많은 법제에서는 소비자법을 민법의 일부로 받아들여서 더 이상 소비자법이 민법이라는 기본법제의 이종물로 취급하는 것은 어렵게 되었다고 생각한다. 즉 소비자계약법은 민법의 일부로 볼 수 있다. 이러한 경향에 맞추어 법무부와 민사법학회에서도 소비자계약법의 기본개념과 제도를 민법의 형식에 맞추어서 도입하는 것을 그 목표로 설정하였다는 점을 밝힌다.
본 논문에서는 민법개정위원회 제1분과에서 자세히 논의되었던 내용을 바탕으로 필자가 제시하고 수정한 최종안의 내용을 설명하고 이와 함께 논의되었던 주된 쟁점들을 소개하는 것으로 만족하려고 한다. 이를 위하여 우선 소비자계약법을 민법의 편입하면서 기본적 제도화를 위한 목표와 과제에 관하여 살펴 보았다(Ⅱ). 그 다음으로 편입된 조문의 위치와 체계와 관련된 논의를 소개한 후(Ⅲ) 구체적인 조문의 내용에 대하여 살펴보았다(Ⅳ). 마지막으로 본 논의에 포함되지 않았지만, 편입 대상이 될 수 있는 소비자계약법 제도에 관하여 간단히 언급하고 논문을 마무리하였다(Ⅴ).

영어초록

Theoretical discussions on the incorporation of the Consumer Contract Act into Civil Law were already made quite a lot in South Korea 10 years ago. In the Civil Law revision process, research was conducted by ordering research services from the Ministry of Justice at the request of the first division of the Civil Law Amendment Committee. Still, unfortunately, discussions based on this research and the submission of the final revision were not made. Entering 2022, we see a change in the discussion. The Korean Association of Civil Law intensively dealt with the method of incorporating the the Consumer Act int Civil Law, which was discussed in the first division of the Civil Law Amendment Committee. At the same time, the Korea Consumer Law Society received a research service from the Ministry of Justice and researched the enactment of the Consumer Contract Act.
Discussions on the validity of legal policy and theory must be preceded when incorporating the Consumer Contract Act into Civil Law. However, from a comparative law point of view, many legal systems, such as Germany and France, have already accepted Consumer Act as a part of Civil law, so it is challenging to treat Consumer Act as a different product of the basic legal system of Civil Law. In other words, the Consumer Contract Act can be viewed as part of Civil Law. In line with this trend, it is revealed that the Ministry of Justice and the Korean Association of Civil Law have set the goal of introducing the basic concepts and systems of the Consumer Contract Act in conformity with the form of Civil Law.
In this paper, the goal is to explain the contents of the final draft presented and revised by the present writer based on the details discussed in the first division of the Civil Law Amendment Committee and introduce the main issues discussed along with it. To this end, while incorporating the Consumer Contract Act into Civil Law, we first looked at the goals and tasks for basic institutionalization(II). Next, the position and system of the incorporated provisions were introduced(III), and the specific contents of the provisions were examined(IV). Finally, the paper was concluded by briefly mentioning the Consumer Contract Act system, which may be subject to incorporation, although it is not included in this discussion(V).
